Book excerpt: The issue of minority ethnic groups' experiences of the criminal justice process, and in particular whether they are subject to disadvantageous treatment, has received much attention in recent years following high-profile events such as the publication of the Macpherson report in 1999 and the riots involving British-born Asian youths in northern towns in 2001. At the same time there has been a burgeoning body of research evidence about the needs and experiences of minority ethnic offenders, the behaviour of racially motivated offenders, and concern with 'What Works' to reduce recidivism by members of both groups. This book reviews this field, drawing upon the largest study of minority ethnic probationers ever conducted in Europe, and seeks to understand the 'stark contrast between the experience of white and black minority ethnicpeople in some areas of the criminal justice system'. Part 1 of the book sets out the context of recent policy, research and practice initiatives; Part 2 focuses on the needs and experiences of minority ethnic offenders; Part 3 discusses aspects of recent practice and policy; Part 4 reviews conclusions and the way forward. Race and Probation also contributes to the wider debate about race and crime. The lessons learned will be of key importance as new arrangements linked to NOMS (National Offender Management Service) come in to place. It will be essential reading forprobation trainees and students of criminal justice, for probation practitioners and managers, and for academics and researchers in the field.

Book excerpt: At year end 2016 over 3.7 million Americans were under probationary supervision. In response to institutional overcrowding, the U.S. has been increasingly reliant on community corrections. Though there has been extensive research into various aspects of the criminal justice system, the area of community corrections, specifically probation, has seen relatively little scrutiny. Through quantitative analysis of probationary data, this study examined a Midwestern population of closed probationary cases. Through a framework of intersectionality, various intersectional identities are examined for likelihood of failure. Focusing on the prevalence of negative outcomes for not only racial and ethnic minorities, but also intersections of race, ethnicity, and gender. Utilizing logistic regression analysis, each model examines race, ethnicity, and sex against probation failure. After an initial baseline model, intersections of race/ethnicity were run. Using probation success as a control outcome in each of the models. Across all models, race and ethnicity were found to be significantly and positively associated with probation failure. Additionally, standardized coefficients indicate Black and Black/Hispanic categories to represent strong effect on negative probation outcome. Of note, sex though unreliable in numerous models, was found only to be a significant and strong predictor in the model examining Black probationers. Possible explanations, study limitation, future research, and policy implication are offered in the discussion and conclusion section.

Book excerpt: This 2-year study compared the treatment of white and minority offenders at key decision points in the criminal justice processing of approximately 1,400 male prison inmates in California, Michigan, and Texas. Study data came from the California Offender-Based Transaction Statistics which tracks offender-processing from arrest to sentencing, and the Rand Inmate Survey which yielded data from self-reports of approximately 1,400 male prison inmates in California, Michigan, and Texas. Prior research on discrimination in the criminal justice system produced controversial and contradictory findings. Section II discusses the problems with this research and briefly describes the data and methodology. Section III describes the workings of the criminal justice system and identifies racial differences in case-processing revealed in some of the data. Section IV analyzes more of the data for racial differences in crime-commission rates and the probability of being arrested. Section V looks at racial differences following the imposition of a court sentence. Section VI explores racial differences in offender characteristics, specifically: crime motivation, weapon use, and prison violence. Section VII summarizes the findings and presents the conclusions of the study. Although the case-processing system generally treated offenders similarly, there were racial differences at two key points. Minority suspects were more likely than whites to be released after arrest; however, after a felony conviction, minority offenders were more likely than whites to be given longer sentences and to be put in prison instead of jail. There were no statistically significant differences that implied discrimination against minorities in corrections.

Anti-Racist Probation Practice addresses this conundrum and drawing on the experiences of black people makes practical proposals for moving forward in non-tokenistic ways. These include core areas of practice, for example court reports monitoring systems; resource allocation; and working relations. Arguing that process, procedures and outcomes in the work done must be taken together if individual, institutional and cultural racism are to be eradicated, the book shows that anti-racist probation practice must be taken seriously by both black and white people if it is to materialise.
