Book Procedural and Organizational Aspects of Constitutional Justice in Albania

Download or read book Procedural and Organizational Aspects of Constitutional Justice in Albania written by Erind Merkuri and published by Nova Sciencepublishers Incorporated. This book was released on 2020-10-22 with total page 315 pages. Available in PDF, EPUB and Kindle. Book excerpt: How do you defend democracy? How do you protect your rights? How can you repeal a law that interferes with your sphere of rights? These are some of the questions that any citizen in a democratic country should know in order to enjoy his/her freedom and rights. Even a small country like Albania is no exception. New and modern Constitutions, aim to regulate the exercise of state power, based on the principle of separation of powers and to the respect for human rights and fundamental freedoms. Despite the fact that this important principle helps to control the activity between different state institutions, the history has shown that this has not always been an efficient solution. So, the world is full of examples where a parliamentary majority, that have come to power through democratic processes, has used its power to control the others power of a country and had violated the human rights and fundamental freedoms. For this reason, the drafters of the constitution after the Second World War in Western Europe and after the fall of communism in Eastern European countries, have established and regulated the creation of the Constitutional Court as an institution which can defend the sphere of the competencies of other institutions with constitutional nature and the protection of human rights and fundamental freedoms. This possibility can only be realized using procedural means, through which the Constitutional Court is put into motion. The purpose of this book is precisely, to analyze these procedural mechanisms with regard to the principles of the constitutional process, the jurisdictions, the admissibility of the applications, the procedural position of the parties, the terms and their calculation, procedural acts and evidence that can be used, as well as, procedural characteristics for each constitutional process. A good knowledge of these principles and rules of procedure helps the different applicants who presented themselves to the Constitutional Court to have higher chances to succeed and to be accepted instead of being dismissing because of procedural deficiencies. This book show all of this aspects in the content of the Albanian experience.

Available in PDF, EPUB and Kindle. Book excerpt: The International Court of Justice is the principal judicial organ of the United Nations and plays a central role in both the peaceful settlement of international disputes and the development of international law. This comprehensive Commentary on the Statute of the International Court of Justice, now in its second edition, analyses in detail not only the Statute of the Court itself but also the related provisions of the United Nations Charter as well as the relevant provisions of the Court's Rules of Procedure. Five years after the first edition was published, the second edition of the Commentary embraces current events before the International Court of Justice as well as before other courts and tribunals relevant for the interpretation and application of its Statute. The Commentary provides a comprehensive overview and analysis of all legal questions and issues the Court has had to address in the past and will have to address in the future. It illuminates the central issues of procedure and substance that the Court and counsel appearing before it face in their day-to-day work. In addition to commentary covering all of the articles of the Statute of the ICJ, plus the relevant articles of the Charter of the United Nations, the book includes three scene-setting chapters: Historical Introduction, General Principles of Procedural Law, and Discontinuation and Withdrawal. The second edition of the Commentary adds two important and instructive chapters on Counter-Claims and Evidentiary Issues. The combination of expert editors and commentators, and their assessment of new developments in the important work of the ICJ, make this a landmark publication in the field of international law.

Book A Practical Guide to Constitution Building

Download or read book A Practical Guide to Constitution Building written by Winluck Wahiu and published by . This book was released on 2011 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: "A Practical Guide to Constitution Building provides an essential foundation for understanding constitutions and constitution building. Full of world examples of ground-breaking agreements and innovative provisions adopted during processes of constitutional change, the Guide offers a wide range of examples of how constitutions develop and how their development can establish and entrench democratic values. Beyond comparative examples, the Guide contains in-depth analysis of key components of constitutions and the forces of change that shape them. The Guide analyzes the adoption of the substantive elements of a new constitution by looking at forces for the aggregation or dissemination of governmental power, and forces for greater legalization or politicization of governmental power, and examining how these forces influence the content of the constitution. It urges practitioners to look carefully at the forces at play within their individual contexts in order to better understand constitutional dynamics and play a role in shaping a constitution that will put into place a functioning democratic government and foster lasting peace."--

Book Judicial Dissent in European Constitutional Courts

Download or read book Judicial Dissent in European Constitutional Courts written by Katalin Kelemen and published by Routledge. This book was released on 2017-09-28 with total page 242 pages. Available in PDF, EPUB and Kindle. Book excerpt: Dissent in courts has always existed. It is natural and healthy that judges disagree on legal issues of a certain importance and difficulty. The question is if it is reasonable to conceal dissent. Not every legal system allows judges to explain their disagreement to the public in a separate opinion attached to the judgment of the court. Most constitutional courts do. This book presents a comparative analysis of the practice of judicial dissent in constitutional courts from the perspective of the civil law tradition. It discusses the theoretical background, presents the history of the institution and today’s practice, thus laying down the basis for an accurate consideration of the phenomenon from a legal perspective.

Book Nations in Transit 2000 2001

Download or read book Nations in Transit 2000 2001 written by Alexander Motyl and published by Routledge. This book was released on 2020-03-12 with total page 611 pages. Available in PDF, EPUB and Kindle. Book excerpt: How are democracy and market reforms faring in East Central Europe and the former Soviet Union? Is civil society expanding or shrinking? Are the media free or fettered by official constraints? To what degree are nations governed by the rule of law? Are human rights respected? Do taxation and trade policies, property rights reforms, banking laws, privatization, and macroeconomic policies encourage or encumber private sector development and economic growth?, In Nations in Transit 2001, Freedom House asked leading regional specialists and in-house experts to answer a checklist of more than 70 indicators for 27 post-Communist countries in ten key areas: political process; civil society; independent media; governance and public administration; constitutional, legislative and judicial framework; corruption; privatization; macroeconomic policy; microeconomic policy; and social sector indicators. The survey, organized in a new essay format, was reviewed by an oversight board of leading U.S. scholars and by experts from Central and Eastern and the former Soviet Union., The results are incisive, authoritative, and comprehensive country-by-country reports that assess the progress of East Central European and former Soviet countries in ridding themselves of repressive political systems and inefficient statist economies. As an added dimension, Freedom House-which for nearly 25 years has rated global political rights and civil liberties in its benchmark Freedom in the World surveys-has developed a rating system that allows for a comparative analysis of democratic and market reforms in the countries covered by the survey., Nations in Transit 2001 is an invaluable resource and reference tool for governmental and nongovernmental institutions, schools and universities, and anyone else interested in better understanding the political, economic, and legal structures and institutions that constitute the infrastructure on which the transition to open societies and markets depends.
