Book Principles of Law for New Zealand Business Students

Download or read book Principles of Law for New Zealand Business Students written by Jeremy James Evelyn Hubbard and published by . This book was released on 2009-07-02 with total page 678 pages. Available in PDF, EPUB and Kindle. Book excerpt: PRINCIPLES OF LAW FOR NEW ZEALAND BUSINESS STUDENTS is designed for students of the commercial law paper in the National Diploma in Business Studies, and those taking introductory law courses for business degrees. The book is also suitable for the Legal Executives Course paper, 'Introduction to the Legal System'. The text is divided into three parts: (1) the basis of New Zealand law; (2) the law of contract; and (3) particular aspects of commercial law. Supplements: A Companion Website is available, and contains a variety of self-testing questions for students, as well as lecturer resources: www.pearsoned.co.nz/hubbard. The fourth edition has been updated and substantially rewritten in response to changes in prescriptions as well as in the law itself. The chapter on history of the law has been combined with the introduction in Chapter 1. Similarly there is no longer a separate chapter on negligence. This material has been transferred to a single chapter on tort. The other significant change has been the reintroduction (from the first edition) of a chapter on intellectual property. There has also been a conscious attempt to streamline and simplify the material to better meet the needs of the users. Each chapter starts with its intended learning outcomes, to serve as a guide to the student. The writing style is lively, and interesting examples from actual cases are used to illustrate the legal points made. Chapter summaries, lists of key words and revision exercises help students to assess their understanding of the contents. Full referencing provides convenient 'signposting' for readers. Included are a list of abbreviations, a table of cases, tables of New Zealand and overseas legislation, a glossary and an index.

Selected content is drawn from the Company and Securities Law in New Zealand treatise and has been updated, reworked and significantly expanded to embrace developments in company and corporate law.

Book The principle of non discrimination in international and European tax law

Download or read book The principle of non discrimination in international and European tax law written by Niels Bammens and published by IBFD. This book was released on 2012 with total page 1151 pages. Available in PDF, EPUB and Kindle. Book excerpt: The principle of non-discrimination plays a vital role in international and European tax law. This dissertation analyses the interpretation given to that principle in tax treaty practice and in the direct tax case law of the Court of Justice of the European Union (ECJ) on the fundamental freedoms. The objective of this analysis is twofold: to give a clear and thorough overview of both standards and to determine whether they share a common, underlying principle of non-discrimination. In order to achieve these objectives, a comprehensive selection of case law is discussed from the perspective of the two constitutive elements of discrimination, comparability and the existence of different treatment. Moreover, attention is drawn to the question whether a domestic measure that is found to be discriminatory may nevertheless be justified on the basis of reasons of public interest. Finally, the possible interplay between both standards is addressed.

Available in PDF, EPUB and Kindle. Book excerpt: Major enterprises shape our lives in countless ways: big tech and 'surveillance media' that affect democratic debate, algorithms that influence online shopping, transport to work and home, energy and agriculture corporations that drive climate damage, and public services that provide our education, health, water, and housing. The twentieth century experienced swings between private and public ownership, between capitalism and socialism, without any settled, principled outcome, and without settling major questions of how enterprises should be financed, governed and the rights we have in them. This book's main question is 'are there principles of enterprise law', and, if they are missing, 'what principles of enterprise law should there be'? Principles of Enterprise Law gives a functional account of the 'general' enterprise laws of companies, investment, labour, competition and insolvency, before moving into specific enterprises, from universities to the military. It is an original guide to our economic constitution and human rights.
