Book excerpt: Excerpt from Practice Reports in the Supreme Court and Court of Appeals of the State of New York, Vol. 45 An action by a tax-payer of a town to perpetually enjoin and restrain com missioners from issuing the bonds of the town, for the purpose of aiding in the construction of a railroad, cannot be maintained Where the allegations of the complaint do not show that the alleged commissioners are officers of the town having any authority by legal appointment or color of appointment to act as commissioners for the purpose of bonding the town. The only fact stated on the subject being that they either are or claim to be commissioners, with an allegation of ignorance as to the truth of the claim. This is to be construed most strongly against the pleader, and it amounts to this: That here are certain persons who say they are commissioners of the town, but Whether they are so or not we neither affirm nor deny. An attempt or threat by an individual or individuals to do an act which, when done, would be a nullity, neither binding upon nor injurious to any one, according to the allegations of fact in a complaint, or, for aught appears there, lays no foundation whatever for an action to restrain the commission of such act. If a new trial is had and the appellant succeeds in changing the entire result, then the judgment of the court below is re versed. The construction I have placed upon the provision cited, it seems to me, is the only rational interpretation which can be given, and is consistent with the apparent intention of the legislature. Its object was to enable a prevailing party to modify a judgment for too large an amount if he chose to do so, and thus prevent unnecessary and expensive litigation. The defendant, by his attorney, brought an appeal, and in his notice of appeal claimed that the judgment should have been more favorable to him, in that it should have been for only $40.00. Within fifteen days after service of the notice of appeal, the respondent, by his attorney, served upon the justice, and also on the appellant, personally, a written offer that the judgment might be reduced to $88.00. After verdict in the county court both parties had their costs duly taxed, and the clerk thereupon docketed a judgment in favor of the respondent, including therein respondent's costs. Laws 1813, p. 300, 80) all resting upon the doctrine of necessity, which becomes imperious in its demands. The Board of Health may and should be regarded as the representatives Of the people of this city on the subject for which they were organized, to be aided in all respects in the lawful exercise of their authority, which looks to the high and noble duty Of preserving health and saving life. This action was brought originally against Bernice B. Smith, as commissioner of highways, of the town of New Lebanon, and it has since been continued against his successors in office. The demand made by the plaintiff was for damages occasioned to a horse by reason of an injury created by passing his leg down a hole in a defective bridge, on one of the public highways of the town. It was claimed that the highway commissioner had received notice of the unsafe character of the bridge, the year before the injury was sustained, and that he had negligently omitted to cause it to be repaired. If such was the fact, as the evidence tended to prove it was, then the delinquent commissioner was guilty of a wrong, rendering him liable for all its consequences to those who might be injured by means of it. It was his wrong exclusively, and not that of his successors in office, and he might have been sued for it as a mere individual, relying upon his official obligation to establish the duty he had violated. It was not a case, therefore, where the action could be continued against his successor in office, for that right is limited to those cases when a contract has been entered into, or a liability may have been incurred, in behalf of the town, within the scope of the officer's authority. (3 R. S. 5th ed., 775, 111.) If the liability relied upon, existed at all, it was not acurred on behalf of the town neither was it within the scope of his authority, for no authority was any where conferred upon him to involve the town in liability, on account of his negligent omission of duty. Such liability would invert the established principle of law, requiring a subordinate wrong-doer to indemnify his superior against the consequences of his wrong.
