Al di là, comunque, delle mille obiezioni che pure, legittimamente, possono essere mosse, è importante innanzitutto muoversi sul versante della Begriffsgeschichte; pertanto, osservandone la genesi concettuale, è facile osservare come il paradigma in questione del Feindstrafrecht promani da un contesto teorico determinato, ovvero il funzionalismo sistemico di Luhmann che il penalista e filosofo del diritto tedesco Günther Jakobs ‘riadatta’ sul versante della dogmatica penale. Non mancano, però, nel discorso, riferimenti continui a Kelsen e a Hegel, a testimoniare una linea di continuità nella scienza giuridica tedesca. Ciò detto il presente lavoro si propone proprio di indagare la prestazione jakobsiana (sul sottosistema del Feindstrafrecht e, in generale, sulle ‘conversione funzionalista’ delle categorie del reato e della pena) inserendola all’interno di uno scenario speculativo più ampio: quello relativo cioè all’evoluzione della penalistica italiana e tedesca nel secondo Novecento.
