Non mancano, però, nel discorso, riferimenti continui a Kelsen e a Hegel, a testimoniare una linea di continuità nella scienza giuridica tedesca. Ciò detto il presente lavoro si propone proprio di indagare la prestazione jakobsiana (sul sottosistema del Feindstrafrecht e, in generale, sulle ‘conversione funzionalista’ delle categorie del reato e della pena) inserendola all’interno di uno scenario speculativo più ampio: quello relativo cioè all’evoluzione della penalistica italiana e tedesca nel secondo Novecento.
