Book excerpt: Several high-profile police shootings and other law enforcement-related deaths in the United States have sparked intense protests throughout the country and a fierce debate in Congress concerning the appropriate level of force police officers should wield in a society that equally values public safety and the lives of each of its citizens under law. These incidents have been the subject of several congressional hearings, have prompted the introduction of various legislative measures, and have catalyzed a new civil rights movement in the United States aimed at reforming the criminal justice system. Reformers claim that police work too closely with local prosecutors resulting in insufficient oversight and have called for greater involvement by the federal government. The law enforcement community and its supporters have countered that these recent deaths are anomalous in otherwise exemplary police conduct, and that placing the federal government in direct regulation of state and local police would present an unwarranted intrusion into state and local affairs. To provide legal context for this debate, this book will address three overarching questions: what are the constitutional rules governing an officer's use of force; what role has Congress played in providing a remedy for a violation of these rules; and what are the potential reforms to these rules and remedies? The authors of this book advocate for democratic ideals within law enforcement to combat the mindset that law enforcement officers are at war with the people they serve.

The first goal was to develop a better picture of the structure and nature of SWAT teams in American law enforcement. The second goal of the research project was to increase the amount of knowledge about how SWAT teams prepare for and execute operations. The project's third goal was to develop information about one specific aspect of SWAT operations : the use of force, especially deadly force, by both officers and suspects. To gather this information, the SWAT Operations Survey (SOS) was conducted. This was a nationwide survey of law enforcement agencies with 50 or more sworn officers. The survey sought information about the agencies' emergency response capabilities and structures. The SOS included two instruments : (1) the Operations Form, completed by a total of 341 agencies, and containing variables about the organization and functioning of SWAT teams, and (2) the Firearms Discharge Report, which includes a total of 273 shootings of interest, as well as items about incidents in which SWAT officers and suspects discharged firearms during SWAT operations ... This book examines the issue of militarization in a post-Ferguson environment from the perspective of those inside policing. Drawing from a variety of data—including historical analysis of newspaper articles to examine the use of firearms in policing; original data from police respondents attending the Federal Bureau of Investigation’s National Academy in Quantico, Virginia; interviews with police chiefs and tactical officers regarding their direct experiences; and a sample of National Academy attendees reporting on the deployment of patrol rifles in policing—this work provides a nuanced look at police militarization that will inform future conceptual discussions and empirical research into the phenomenon. Considerations identified for police policy-makers include politics, media, leadership, and marketing.
