Book excerpt: Federal agencies must use appropriate authorities and follow proper procedures in converting political appointees to career positions, including obtaining prior approval from OPM. GAO was asked to provide information on political conversions and examine the implementation and effectiveness of OPM’s policy for reviewing them. GAO, as part of its review, examined (1) conversion requests submitted by agencies and reviewed by OPM, (2) whether agencies used appropriate authorities and proper procedures in conversions approved by OPM, and (3) conversion requests denied by OPM and referred to OSC. GAO recommends that OPM (1) ensure its finalized records schedule lists all documentation that must be saved in OPM’s case files, and (2) establish a policy requiring its staff to verify they reviewed all documentation required by OPM checklists before recommending approval or denial of a conversion request.

Book excerpt: Pursuant to a congressional request, GAO reviewed the career appointments that agencies granted to employees who held either noncareer Senior Executive Service (SES) or Schedule C appointments before their career appointments, focusing on: (1) whether the appointments adhered to merit system principles dealing with fair and open competition and Office of Personnel Management (OPM) implementing regulations; and (2) OPM oversight of the appointments. GAO found that: (1) the propriety of conversions and agencies' adherence to merit system principles are difficult to ensure, because officials can easily give the appearance that fair and open competition was achieved when it was not; (2) of 46 conversions made in the period February 1988 through December 1989, 37 appeared proper, 7 were questionable, and 2 did not fully comply with merit staffing requirements; (3) OPM has established a review process that has identified and prevented some improper conversions; and (4) the subjectivity in the selection process will continue to make it difficult for OPM to oversee conversions.

GAO was asked to provide information on political conversions. This report identifies (1) the number of conversions of political appointees to career positions reported by executive branch agencies from January 1, 2010, to October 1, 2015; (2) the extent to which agencies complied with OPM requirements to receive approval before making such conversions and the results of that approval process; and (3) the status of OPM's efforts to comply with reporting requirements mandated by the Transitions Act. GAO obtained OPM data on the number of conversion requests reviewed from January 1, 2010, to October 1, 2015, for 30 agencies. This time period begins with the implementation of OPM's January 2010 policy requiring OPM's prior approval of political conversions, and continues through the end of fiscal year 2015. GAO asked agencies to verify conversion requests made to OPM and the numbers of conversions completed during this period.

However, the circumstances surrounding six of the appointments could, in GAO's opinion, give the appearance that the appointments had received favoritism or preference that increased these individuals' chances of getting the job. For example, in two cases, the vacancy announcements appeared tailored to include specific work experiences possessed by the two appointees.

Although merit system principles require that selections be determined solely on the basis of merit after fair and open competition, questions have been raised about whether some individuals have received political favoritism or an unfair advantage, even the appearance of which could adversely compromise the integrity of the system. The 45 agencies GAO surveyed reported that 100 employees converted from political appointments and 11 converted from congressional staff positions from October 1998 through April 2001. All the conversions took place at 21 agencies. Ninety-five of the 111 conversions were to positions at the GS-12 level and above. GAO found that the 21 agencies used appropriate appointment authorities, such as civil service certificates from the competitive selection process, and generally followed merit system procedures. In 17 instances, however, the appointments could give the appearance that individuals had received political favoritism or preferences.

GAO found that: (1) 25 of the 33 federal departments and agencies surveyed had 121 conversions and noncompetitive appointments from January 1992 through March 1993; (2) all of the conversions and appointments met basic procedural requirements, but in nine cases, the appointees may have received preferential treatment; (3) six of the appointments were exempt from the Office of Personnel Management's (OPM) preappointment review because the employees had reinstatement rights earned through their prior career status or were being appointed to the excepted service; (4) the other noncompetitive appointments under the Ramspeck Act were also not subject to any preappointment review; (5) eight additional cases involved noncompetitive appointees returned to congressional service for brief periods of time and OPM ordered two of these persons removed from their positions; (6) OPM suspended SES processing during the 1992 presidential transition at only five agencies where the agency head was resigning because neither the White House nor the transition team requested other suspensions; (7) 76 allegations of improper personnel practices were substantiated and 163 were unsubstantiated; and (8) 52 other allegations involving a variety of practices were referred to the appropriate agency inspectors general for their review.
