Book excerpt: In recent decades, we have seen an explosion in expectations for greater accountability of public policymaking. But, as accountability has increased, trust in governments and politicians has fallen. By focusing on the heart of public accountability--the reason-giving by policymakers for their policy decisions (i.e. deliberative accountability)--this work offers an empirical route for understanding why more accountability may not always deliver more public trust. The focus is on the British Parliament, where both the Treasury Select Committee and the House of Lords Economic Affairs Committee hold hearings on monetary policy, financial stability, and fiscal policy. The intent in these hearings is to challenge policymakers to explain their decisions, and thus the dialogue is expected to be deliberative. But how do we judge the quality of this deliberative accountability? Three metrics are explored and measured: respect, non-partisanship, and reciprocity. The approach is multi-method, including (1) quantitative text analysis to gauge the verbatim transcripts in committee hearings; (2) qualitative coding combined with an experimental design to gauge the role of nonverbal communication in the hearings; and (3) interviews with the MPs, peers, central bankers, and Treasury officials who participated in the hearings. The first method measures the content of 'what' was said, the second examines 'how' the words and arguments were expressed, and the third provides a more reflective 'why' component by asking participants to explain their motivations. This merging of the 'what', the 'how', and the 'why' offers a novel template for studying both accountability and deliberation.

Book excerpt: The recent empowerment of the European Parliament makes this a timely study of the impact of its internal organisation on legislative politics, interest representation and democracy within the Union. Using data on all legislators and legislative proposals in the 6th parliamentary term, the book confronts alternative theories of legislative organisation in rigorous statistical analyses supported by rich interview information. The findings indicate that the internal setup and legislative output of the parliamentary committees serve the policy goals of parties in the European Parliament, and in particular the working majority party, rather than special interests or purely informational needs, which the author explains with the formal and informal parliamentary rules. As the committees advance party politics instead of particularistic policies, she concludes that legislating within the committees is positive for democracy in the European Union and raises concerns about the loss in transparency, legitimacy and accountability that the increasingly common fast-track bicameral decision-making outside the committees entails.

Book excerpt: The constitutional background of both legislatures and their procedures are described and where possible compared. Currently unsolved problems often have much in common, in vexed areas such as ethics requirements or how procedural rules permit minorities fair access to legislative time before majorities prevail. British successes include the enhanced authority and effectiveness of select committees and the acquisition of more debating time by the creation of a parallel Chamber. Unsolved problems at Westminster begin with the powers and status of the Lords, and go on through the search for more effective review of EU activities, adapting parliamentary scrutiny to more sophisticated government financial information, and making better use of legislative time without diminishing back-bench rights. The accelerated pace and extent of procedural changes in Congress is problematic. Constant pursuit of campaign funds, increased party exploitation of Members' ethical shortcomings, and partisan reapportionments, have diminished collegiality and compromise. Business is conducted with greater predictability, with fewer quorum calls, postponement and clustering of votes, and by utilization of ad hoc special orders, often in derogation of openness and minority rights in the House. Minority complaints have been frequent and occasionally extreme. Conversely constant filibuster threats in the Senate have enhanced minority party power there. An 'inverse ratio' between the greater complexity, importance, and urgency of pending legislation on the one hand, and diminution of deliberative capacity, fairness. and transparency on the other, has been repeatedly demonstrated, especially at the stage of final compromises between the Houses.

The final chapter describes the work undertaken on monitoring action taken by the Government in response to incompatibilities with Convention rights, arising from Strasbourg judgments and declarations of incompatibility by UK courts.

It takes up the recommendationmade by this committiee's predecessor Committee (in the Government by Inquiry Report) that there should be a parliamentary mechanism for initiating inquiries. These would take the form of Parliamentary Commissions of Inquiry, composed of parliamentarians and others. In the Report, the committee examines the justification for creating Parliamentary Commissions of Inquiry in particular, that they would enable Parliament to hold the Executive to account more effectively. Then it covers some of the practical issues involved in setting up inquiries of this nature: how Parliament could instigate an inquiry, its composition, and its operation and powers. The committee concludes that it is crucial, in constitutional sense, that Parliament has the necessary powers and abilities to scrutinise the Executive and hold it to account. Proper parliamentary scrutiny should include the ability to establish and undertake inquiries into significant matters of public concern. Parliament has, in the past, conducted investigationsof this kind and as the great forum of the nation, should be expected to do so. The committee's recommendation for Parliamentary Commissions of Inquiry would promoteeffective parliamentary accountability by creating a process for Parliament to initiate inquirieswhere it rather than the Executive sees fit.
