Book excerpt: " Ports, waterways, and vessels handle billions of dollars in cargo annually and an attack on this maritime transportation system could impact the global economy. November 2012 marks the 10-year anniversary of MTSA, which required a wide range of security improvements. DHS is the lead federal department responsible for implementing MTSA and it relies on its component agencies, such as the Coast Guard and CBP, to help implement the act. The Coast Guard is responsible for U.S. maritime security interests and CBP is responsible for screening arriving vessel crew and cargo. This testimony summarizes GAO's work on implementation of MTSA requirements over the last decade and addresses (1) progress the federal government has made in improving maritime security and (2) key challenges that DHS and its component agencies have encountered in implementing maritime security-related programs. GAO was unable to identify all related federal spending, but estimated funding for certain programs. For example, from 2004 through May 2012, CBP obligated over $390 million to fund its program to partner with companies to review the security of their supply chains. This statement is based on GAO products issued from August 2002 through July 2012, as well as updates on the status of recommendations made and budget data obtained in August 2012. "

Ports are inherently vulnerable to terrorist attacks because of their size, general proximity to metropolitan areas, the volume of cargo being processed, and their link to the global supply chain-that is, the flow of goods from manufacturers to retailers. Balancing security concerns with facilitation of the free flow of people and commerce remains an ongoing challenge for federal, state, local, and private stakeholders operating in ports. Within DHS, several components are responsible for port security activities. These activities include, among other things, promoting maritime domain awareness, conducting port facility inspections, and screening incoming vessels' cargoes for the presence of contraband such as weapons of mass destruction, illicit drugs, or explosives. This statement discusses progress and challenges in key areas of DHS port security programs. It is based on work GAO has previously conducted from September 2003 to September 2013 with selected updates conducted through May 2014. For these updates, GAO contacted DHS officials and reviewed relevant documents. "

Piracy may be a marginal problem in itself, but the connections between organised piracy and wider criminal networks and corruption on land make it an element of a phenomenon that can have a weakening effect on states and a destabilising one on the regions in which it is found. Furthermore, it is also an aspect of a broader problem of disorder at sea that, exacerbated by the increasing pressure on littoral waters from growing numbers of people and organisations seeking to exploit maritime resources, encourages maritime criminality and gives insurgents and terrorists the freedom to operate. In this context, maritime terrorism, though currently only a low-level threat, has the potential to spread and become more effective in the event of political change on land. It is only by addressing the issue of generalised maritime disorder that the problems of piracy and maritime terrorism may be controlled in the long term.

The Security and Accountability for Every Port Act (SAFE Port Act), modified existing legislation and created and codified new programs related to maritime security. The Department of Homeland Security (DHS) and its U.S Coast Guard, Transportation Security Agency, and U.S. Customs and Border Protection have key maritime security responsibilities. This synthesizes the results of the Government Accountability Office's (GAO) completed work and preliminary observations from GAO's ongoing work pertaining to overall port security, security at individual facilities, and cargo container security. GAO has made recommendations to DHS to develop strategic plans, better plan the use of its human capital, establish performance measures, and otherwise improve program operations. DHS has generally concurred with our recommendations and is making progress implementing them.--Highlights.

Homeland Security Presidential Directive-13 (HSPD-13, also referred to as National Security Presidential Directive-41) directs the coordination of U.S. maritime security policy through the creation of a National Strategy for Maritime Security and supporting implementation plans. GAO was asked to evaluate this strategy and its eight supporting plans. This report discusses: (1) the extent to which the strategy and its supporting plans contain desirable characteristics of an effective national strategy, and (2) the reported status of the implementation of these plans. To conduct this work, GAO evaluated the National Strategy for Maritime Security and its supporting plans against the desirable characteristics of an effective national strategy that GAO identified in February 2004, reviewed HSPD-13 and supporting plans, and reviewed documents on the status of the plans' implementation. Of the six desirable characteristics of an effective national strategy that GAO identified in 2004, the National Strategy for Maritime Security and its eight supporting implementation plans address four and partially address the remaining two. Documents provided by the Maritime Security Working Group--an interagency body responsible for monitoring and assessing the implementation of the maritime strategy--indicate that the implementation status of the eight supporting plans varies. For example, as of November 2007, implementation of one plan had been completed, while another has reached the assessment phase (e.g., lessons learned and best practices), and a third has reached the execution phase (e.g., exercises and operations). The other five plans remain primarily in the planning phase. The working group is monitoring the implementation of 76 actions across the plans, and reported 6 of these are completed and 70 are ongoing.
