Book excerpt: In The Laws of Late Medieval Italy Mario Ascheri examines the features of the Italian legal world and explains why it should be regarded as a foundation for the future European continental system. The deep feuds among the Empire, the Churches unified by Roman papacy and the flourishing cities gave rise to very new legal ideas with the strong cooperation of the universities, beginning with that of Bologna. The teaching of Roman law and of the new papal laws, which quickly spread all over Europe, built up a professional group of lawyers and notaries which shaped the new, 'modern', public institutions, including efficient courts (like the Inquisition). Politically divided, Italy was partly unified by the legal system, so-called (Continental) common law (ius commune), which became a pattern for all of Europe onwards. Early modern Europe had for long time to work with it, and parts of it are still alive as a common cultural heritage behind a new European law system.

Book excerpt: Amongst the oldest universities that of the Roman curia is the Great Unkown; little is known of the university of Rome (and of Avignon till 1378). To compensate the loss of sources materials mainly from the Vatican were intensively analysed and a prosopography of the dons and students (694 biograms in annex) drawn up. Some results: all three were legal universities of the southern type. The curial university was itinerant, it was continued at the general councils. Only when the curia resided there untroubled, the local schools of Rome (and Avignon) became great, international universities and different forms of association with the curial university were tried on. Rome was sought after by students from all over Europe for study of legal theory whereas praxis was learned at the papal court. Another attraction of Rome were the possibilities of attaining higher academic grades without much ceremony (first in theology, later also in law).

Steinberg reveals how Dante imagines an afterlife dominated by sophisticated laws, hierarchical jurisdictions, and rationalized punishments and rewards. He makes the compelling case that Dante deliberately exploits this highly structured legal system to explore the phenomenon of exceptions to it, crucially introducing Dante to current debates about literature’s relation to law, exceptionality, and sovereignty. Examining how Dante probes the limits of the law in this juridical otherworld, Steinberg argues that exceptions were vital to the medieval legal order and that Dante’s otherworld represents an ideal “system of exception.” In the real world, Dante saw this system as increasingly threatened by the dual crises of church and empire: the abuses and overreaching of the popes and the absence of an effective Holy Roman Emperor. Steinberg shows that Dante’s imagination of the afterlife seeks to address this gap between the universal validity of Roman law and the lack of a sovereign power to enforce it. Exploring the institutional role of disgrace, the entwined phenomena of judicial discretion and artistic freedom, medieval ideas about privilege and immunity, and the place of judgment in the poem, this cogently argued book brings to life Dante’s sense of justice.

The first articles deal with the settlement of Rhodes, the conflicts with the Turks, and with the Hospitallers’ participation in crusading expeditions. As important, however, is the question of how they managed to support their military achievements. Drawing on the results of many years’ research into the archives of the Hospital, both in Malta and in the provincial archives, Dr Luttrell examines their administration of the Rhodian islands and details some of the resources they drew from elsewhere, notably the West, whether in terms of recruitment, money raising or the exploitation of their estates. Particular attention is given to the Hospitaller properties in Italy and Spain, and to the nature of Hospitaller life in these western priories and commanderies. Imperial rescripts, reports of urban prefects, letters of bishops, and exchanges of letters between popes and emperors, some of which only this compilation preserves, constitute an exceptional documentary collection for researchers of various sectors of antiquity. This volume is the first publication to reconstruct the history of this compilation through the fascinating questions that it poses to the scholar. There are essays on its general structure, and on some of the most singular texts preserved therein. Other papers offer a comparison between this compilation and the other canonical collections compiled in Italy between the fourth and sixth centuries, as well as between the CA and other contemporary literary products. Adopting a new approach, some contributions also ascertain who could physically have access to the materials that were collected in the CA, and where the compiler could find them.
