La question environnementale devient alors une problématique universelle, objet de tous les débats, même si en ces temps, les pollutions demeuraient encore relativement localisées à certains éléments de la nature comme les cours d’eaux d’importance internationale. Il s’agit alors d’appréhender la question de la protection de l’environnement marin par le droit international. Résultant de la complexité des relations entre l’homme et la nature (qui constitue d’ailleurs son cadre de vie), il apparait nécessaire de réguler les rapports de celui-ci avec cette dernière pour sa survie existentielle mais aussi et surtout pour la préservation des droits (à la vie) des générations futures. La nécessité de préciser les contours de la notion d’environnement marin peut s’expliquer et se justifier par toute une série de notions voisines renvoyant de manière fort utile à la même réalité -de préservation de la vie présente et future par la pratique de l’équité intergénérationnelle- en partant de : écologie, nature, espace maritime, biodiversité, ressources halieutiques, minières... et aboutissant à la notion synthétique de développement durable. La notion d’environnement marin est donc toute aussi vaste que l’espace auquel il s’applique. L’environnement s’appréhende comme une notion polysémique. Du point de vue de la littérature, l’expression environnement signifie l’ensemble des éléments naturels et artificiels qui entourent un individu humain, animal ou végétal ou une espèce. Aussi apparait-elle comme la composition des éléments objectifs et subjectifs qui constituent le cadre de vie de l’individu. Vu sous cet angle, l’environnement demeure une notion superficielle dans la mesure où elle est présentée comme un phénomène matériel et statique dont l’existence semble à première vue éternelle. Elle serait non évolutive, non dégradable car cette définition littérale établie une relation de passivité de l’homme avec cette dernière. Or l’homme est un être insatiable et abusant de son voisin environnement. En tant qu’unique être doué de raison, il a toujours eu un ascendant sur la nature, selon une conception anthropocentriste.

Book excerpt: Recent international conflicts have raised fundamental questions about the relationship between international law and armed conflict. The notion that the rules of general international environmental law continue to apply during armed conflict is now well accepted, but the principles that are usually cited remain at a very high level of abstraction. In this paper, the author, a legal adviser in the Office of the Prosecutor for the International Criminal Tribunal for the former Yugoslavia, The Hague, examines the extent to which international law has developed more detailed rules to protect the environment in international armed conflict. After a discussion of the main legal issues, the author focuses on the marine environment, examining the relationship between naval warfare, on one hand, and multilateral environmental treaties on marine safety and the prevention of marine pollution, on the other. She argues that the majority of these treaties do not apply during armed conflict, either because war damage is expressly excluded or because the treaties do not apply to warships. As for the treaties that are in principle applicable during armed conflict, her analysis shows that, under international law, belligerent and neutral states have the legal right to suspend those treaties, wholly or in part. The author concludes that very few of the treaties considered take the new law of armed conflict into account and that there remains a need for more detailed rules on environmental standards for military operations. The paper concludes with an extensive bibliography of journal articles, books, manuals, monographs, symposia and conference reports, selected special reports, and selected official documents and publications.
