It emphasizes the point that lawyers must not only practice their craft with absolute integrity but should also be well behaved and civil to each other, the courts and other court users. Lawyers are first and foremost officers of the court; it is their duty to assist the court come to a proper and just determination of the issues in dispute, serving before the court. A lawyer’s duty to the court includes candour, honesty, and fairness. Lawyers, especially in an adversarial system, are required to act professionally with scrupulous fairness and integrity and to aid the court in promoting the cause of justice. There is an obligation on a lawyer not to take on a case in circumstances where the lawyer is plainly unqualified for the complexity of the task or has an inadequate knowledge of the area of law concerned. It is the duty of every lawyer to assist the judge by simplification and concentration and not to advance a multitude of ingenious arguments in the hope that one of the many arguments will win the day. Litigants and their lawyers are not entitled to the uncontrolled use of a trial judge’s time. Litigants are only entitled to so much of the trial judge’s time as is necessary for the proper determination of the relevant issues. Without this assistance from lawyers, the courts are unlikely to succeed in their endeavour to administer justice in a timely and efficient manner.

It highlights the vitality and continued relevance of customary justice at a time when customary courts have waned or even disappeared in many postcolonial African nations. Taking Botswana as a casestudy from in-depth fieldwork over a fifty-year period, the book shows, the ‘customary’ is robustly enduring, central to settling interpersonal disputes and constitutive of the local as well as the national public ethics. Customary law continues to be constitutionally protected, authorised by the country’s past as an authentic, viable legacy, from the British colonial period of indirect rule to the postcolonial state’s present development as a highly bureaucratised democracy. Along with a theoretical overview of the underlying issues for the anthropology and sociology of law, the book documents customary law as living law in the context of legal pluralism. It takes a legal realist approach and highlights the need to pay close attention to the lived experience of justice and its role in the production of legal subjectivities. The employment relationship between the servant and the state is considered starting from his/her entry into the service. Some "public" servants like the Attorney-General, Auditor- General, judges and magistrates have protected tenure. This tenure is constitutionally guaranteed. The Supervisor of Elections who has now been superseded by th Independent Electoral commission also had such tenure, which was passed on to the Secretary to the Commission and the other members. The processes that follow appointment into the public are considered. The processes are probation, promotion, suspension, discipline and dismissal. There are also other factors, which come into play once a public servant has been appointed. These factors include conventions and traditions and traditions governing his/her position as a public servant. In this regard, the study discusses the principle of political neutrality, permanency, anonymity, accountability and autonomy.

Some have argued that the use of a non-consenting subject or a subject whose consent is often doubtful, such as is the case with children, is wrong whether or not there is any risk posed to the subject. Others support such research provided it involves no discernible risk to the children. Social science researchers may enlist children in their studies of social processes for a variety of reasons. Such research raises a number of complex ethical and legal problems and challenges that have unfortunately not been addressed in many countries including Botswana. For example, may the researcher obtain the information he needs based on the consent of the child or his parent or both? What are the obligations of the researcher who learns of secrets that the child would rather keep from his parents, to his own detriment? These are some of the questions that this article will attempt to address. It begins by showing why children constitute a special research population that deserve special attention. It then considers some of the fundamental ethical principles that usually apply in social research involving children. This is followed by an attempt to identify some of the legal principles that could be invoked to protect children in such situations. It is contended that the sensitive nature of children and the fact that their use in social research, whilst sometimes unavoidable and beneficial, carries certain risks that justify the introduction of legislation in Botswana to regulate and protect them from any abuse they may be exposed to due to their immaturity.

These core values, commonly referred to as ‘Bangalore Principles of Judicial Conduct’ were agreed upon by the Judicial Integrity Group in Bangalore, India, in February 2001. In 2003, the United Nations Human Rights Commission (UNHRC) endorsed the above principles, considered amongst common and civil law jurisdictions as the authoritative statement on the values that should inform judicial conduct. Judges must be independent and impartial. Independence means a judge should not take any instructions from anyone or be influenced in any way in determining any matter by anyone. Impartiality means that a judge should treat the parties before him equally, providing them with equal opportunity to say their side of the story. He should have no personal interest in the outcome of the case. Every judge is a product of his time. It is through this prism that his objectivity must be assessed and critiqued. The purpose of objectivity is to be dispassionate. This objectivity is not always easy, but it is attainable. Similarly, the primary function of a judge is to dispense justice. It has always been a revered principle of liberty and freedom that judges are no respecters of persons but the Law, ever vigilant to ensure that any governmental action is justified. Today’s judge is required to give effect to the values of a pluralistic society that cherishes democracy, human rights, tolerance and diversity. This book exemplifies these values.
