Book excerpt: A historical reference work on Morocco must take as its subject al-maghrib al-aqsa (the far west) as the Arabic scholars have generally referred to the approximate region of present-day Morocco, roughly the north-west corner of Africa but at times including much of the Iberian peninsula, because the modern nation-state is a relatively recent creation owing much to events in the late 19th and early 20th centuries. External influences on Morocco tend to come across the narrow straits of Gibraltar to the north, from the east along the Mediterranean litoral, or up from the Sahara. In each case, access is constrained by geography and continued control from outside the region has been difficult to manage over the long term. Although many of the dynasties that came to power in Morocco conquered much broader regions, history and topology have so conspired that there is still more coherence to an historical focus on al-maghrib al-aqsa than is the case for most modern nation-states. This third edition of Historical Dictionary of Morocco contains a chronology, an introduction, a glossary, and an extensive bibliography. In international investment law, the prism of indirect expropriation includes a broad range of measures – such as regulatory measures – which do not involve a transfer of property but result in a serious interference with an investment. The definition of compensable taking is a very sensitive issue situated at the crossroads between the protection of investors' private rights and the safeguarding of the state's sovereign prerogatives. This book explores, through the example of environmental regulation, the law applicable to this controversial topic. It suggests that the traditional approach – based on an extension of the concept of expropriation – is inappropriate and it contributes to clarifying the scope of the international protection of the investor on the ground of the law of state responsibility.

Book excerpt: This book contains selected contributions presented during the workshop “Establishing Filiation: Towards a Social Definition of the Family in Islamic and Middle Eastern Law?”, which was convened in Beirut, Lebanon in November 2017. Filiation is a multifaceted concept in Muslim jurisdictions. Beyond its legal aspect, it encompasses the notion of inclusion and belonging, thereby holding significant social implications. Being the child of someone, carrying one’s father’s name, and inheriting from both parents form important pillars of personal identity. This volume explores filiation (nasab) and alternative forms of a full parent-child relationship in Muslim jurisdictions. Eleven country reports ranging from Morocco to Malaysia examine how maternal and paternal filiation is established – be it by operation of the law, by the parties’ exercise of autonomy, such as acknowledgement, or by scientific means, DNA testing in particular – and how lawmakers, courts, and society at large view and treat children who fall outside those legal structures, especially children born out of wedlock or under dubious circumstances. In a second step, alternative care schemes in place for the protection of parentless children are examined and their potential to recreate a legal parent-child relationship is discussed. In addition to the countr y-specific analyses included in this book, three further contributions explore the subject matter from perspectives of premodern Sunni legal doctrine, premodern Shiite legal doctrine and the private international law regimes of contemporary Arab countries. Finally, a comparative analysis of the themes explored is presented in the synopsis at the end of this volume. The book is aimed at scholars in the fields of Muslim family law and comparative family law and is of high practical relevance to legal practitioners working in the area of international child law. Second, it proposes an open and informed debate on feasible policy options for making SSNs more effective and responsive to the population's needs. In order to do this, the authors illustrate how the main goals for SSNs-promoting social inclusion, better livelihood, and resilience to shocks-have already been achieved in some parts of the region, notwithstanding huge challenges. They also identify the groups that regional SSNs should make a priority: children and people living in rural and lagging areas. The study relies on newly collected data on citizens' preferences concerning redistribution and SSN design, discussing how political economy considerations could be taken into account in designing better SSNs, and proposing an agenda for reform, using global experiences and the new evidence presented in the book itself.
