Dans quelle mesure ce phénomène contribue-t-il à l’évolution du discours sur le droit international, voire même à l’évolution des règles de droit international ? Alors qu’elle est devenue un thème récurrent de l’étude des relations internationales et des sciences économiques, l’émergence suscite de nombreuses interrogations en droit international auxquelles le présent ouvrage essaie d’ apporter quelques réponses. Les contributeurs cherchent ainsi à mieux saisir la place et le positionnement des pays émergents dans les principaux domaines de la discipline (droits de l’homme, droit de l’environnement, droit international économique). Outre la délimitation des contours de la notion d’émergence, il s’agit de s’interroger sur le regard que portent les Etats relevant de cette catégorie sur les normes juridiques internationales, notamment au travers des positions qu’ils adoptent au sein des institutions internationales. D’autre part, il s’agit d’évaluer comment les autres Etats réagissent aux positions adoptées par les pays émergents et, plus largement, de déterminer dans quelle mesure les règles de droit international permettent à ces Etats d’émerger. Puis la banque d'investissement Goldman Sachs parle pour la première fois des BRIC en 2001 (devenu BRICS en 2011 avec l'ajout de l'Afrique du Sud). Dans cet ouvrage issu d'un colloque organisé à Dijon en 2019, on part « à la recherche des pays émergents » : existent-ils ?Ont-ils une fonction dans l'ordre international économique ? Les réflexions se placent dans l'interrogation plus que dans les certitudes car il est quasiment impossible de définir une catégorie et, a fortiori, une catégorie juridique des pays émergents. On trouve cependant un sentiment collectif qu'il en existe et que ces pays se ressentent eux-mêmes comme tels, dans une espèce d'auto-élection.À défaut d'une identification précise de ces pays, on peut s'interroger sur un éventuel rôle fonctionnel de l'émergence, notamment par la remise en cause de règles de droit international supposées défavorables aux pays émergents. Ces derniers, sans chercher forcément à faire table rase des règles existantes, souhaitent des adaptations tenant compte de leurs intérêts. On assiste alors au déploiement de groupements plus ponctuels que globaux dans le monde non structuré issu de la mondialisation.Le colloque où furent présentées les contributions rassemblées dans cet ouvrage était organisé conjointement par l'UCLouvain, l'Université de Liège, le Centre de recherche sur le droit des marchés et des investissements internationaux (CREDIMI) de l'Université de Bourgogne Franche-Comté et l'Association Internationale de Droit Économique (A.I.D.E.). Les auteurs des contributions ont revu leur texte à la lumière du débat scientifique qui a suivi les présentations et des développements plus récents.

These twin characteristics explain why international society is also riddled with the two major forms of injustice which Nancy Fraser identified as afflicting national societies. First, the economic and social disparities between states caused outcry in the 1950s when the first steps were taken towards decolonisation. These inequalities, to which a number of emerging states now contribute, are still glaring and still pose the problem of the gap between formal equality and true equality. Second, international society is increasingly confronted with culture- and identity-related claims, stretching the dividing line between equality and difference. The less-favoured states, those that feel stigmatised, but also native peoples, ethnic groups, minorities and women now aspire to both legal recognition of their equal dignity and the protection of their identities and cultures. Some even seek reparation for injustices arising from the past violation of their identities and the confiscation of their property or land. In answer to these two forms of claim, the subjects of international society have come up with two types of remedy encapsulated in legal rules: the law of development and the law of recognition. These two sets of rights are neither wholly autonomous and individualised branches of law nor formalised sets of rules. They are imperfect and have their dark side. Yet they can be seen as the first milestones towards what might become a fairer international society; one that is both equitable (as an answer to socio-economic injustice) and decent (as an answer to cultural injustice). This book explores this evolution in international society, setting it in historical perspective and examining its presuppositions and implications.

Monthly data for all European Union member countries are sourced from the COMEXT database maintained by EUROSTAT. Annual data reported to the United Nations COMTRADE database are incorporated in DOTS for countries that do not report to the IMF. Furthermore, the availability of partner data makes it possible to calculate estimates of countries for which data are not obtainable from other sources. Estimation occurs if a reporting country does not report trade with its partners for a specific period. Data are estimated for all partners. In the absence of some or all of the monthly DOTS, quarterly or annual reported DOTS are used. Because imports are valued on a cost, insurance, and freight (CIF) basis and exports on a free on board (FOB) basis, the data are adjusted for the cost of freight and insurance.

Book excerpt: This paper discusses those countries that have never reported data by trade partners to the IMF or to the United Nations COMTRADE, estimates are obtained by using directly the corresponding bilateral flow reported by counterpart countries. For example, if country B has never reported trade statistics with a geographical breakdown, but country A has reported imports from country B, then A’s data for imports are used to estimate B’s exports. Because imports are valued on a cost, insurance, and freight (CIF) basis and exports on a free on board (FOB) basis, the data are adjusted for the cost of freight and insurance. A CIF/FOB factor of 1.06 is currently used. Reported imports CIF are divided by 1.06 (i.e., the CIF/FOB factor) to give partner country estimates of exports FOB. Similarly, reported exports FOB are multiplied by 1.06 to give partner country imports CIF.

Book excerpt: This quarterly issue of Direction of Trade Statistics (DOTS) provides, for about 160 countries, tables with current data (or estimates) on the value of imports from and exports to their most important trading partners. The yearbook and quarterly issues of the DOTS publication provide tables with current reported data (or estimates) on the value of merchandise trade statistics (exports and imports) by partner country for all IMF members. In addition, similar summary tables for the world, industrial countries, and developing countries are included. The yearbook provides, for the most recent seven years, detailed trade data by country for approximately 184 countries, the world, and major areas. Other countries may report monthly data that are less current, or the information may be compiled and made available in quarterly or annual frequency. For some countries, the data reported to the United Nations Statistical Division also have been used. Estimation occurs if a reporting country does not report trade with its partners for a specific period. In order to provide guidance regarding the sources of the figures for individual countries, figures in the country, world, and area pages are shown with symbols to the right of the figure.
