L'obligation de garantie incorporée dans les contrats de cession ou de licence doit procurer au créancier la parfaite maîtrise matérielle, à travers la garantie des vices cachés et l'entière maîtrise juridique, à travers celle d'éviction, du bien pour lequel il contracte. Pour des raisons historiques (reconnaissance tardive de la propriété intellectuelle par le droit) les articles que le Code civil consacre à l'obligation de garantie ne concernent que celle des biens corporels. L'application de la garantie légale, prévue pour ces biens, à des créations immatérielles présente certaines difficultés, tant en matière de vices cachés que d'éviction. La garantie légale, analysée à travers une étude théorique, révèle donc des problèmes auxquels la garantie conventionnelle, abordée dans une approche pratique, trouve à certaines conditions des solutions efficaces. Les clauses du contrat, précisant souvent et modifiant parfois la garantie légale, permettent ainsi aux cessionnaires et licenciés de bénéficier pleinement de la protection d'une institution juridique vieille de quatre millénaires : la garantie.

A l' preuve, le constat est plut t mitig . En effet, si les proc dures se d roulant devant l'administration OAPI peuvent donner une certaine satisfaction, celles externes conduites devant les juridictions nationales des Etats membres souffrent de divers maux qui n'assurent pas un r glement judicieux du contentieux. En cons quence, diverses solutions doivent tre mises en oeuvre pour une protection plus efficace des droits de la propri t intellectuelle.
