Rather than follow most philosophers in conceiving rhetoric as a specific way of speaking or writing, it shows that rhetoric is better understood as a dimension of all human discourse and action—what the author calls “rhetoricity”. This book provides the first philosophical treatment of rhetoricity. It is motivated by two ongoing developments. The first is the debate between Alain Badiou and Barbara Cassin about philosophy’s relation to rhetoric. Both Badiou and Cassin are critical of rhetoric, albeit for different reasons. Second, there has been a growing resurgence of interest in rhetoric considering the recent rise in authoritarian politics as well as new forms of propaganda driven by “persuasive technologies”. This book identifies the common target of Badiou’s and Cassin’s otherwise incompatible critiques: rhetoric’s conception of audience. It offers a fresh take on the “new rhetoric” project of Chaïm Perelman and Lucie Olbrechts-Tyteca, putting their work into conversation with the Badiou-Cassin debate. The book then turns to the hermeneutic philosophy of Paul Ricoeur in search of an expanded conception of audience. It shows that Ricoeur’s hermeneutic philosophy allows us to extend Perelman and Olbrechts-Tyteca’s psychological notion of audience to texts themselves and to argue that human beings have a rhetorical capacity to reflect on audiences in search of what is potentially persuasive. The Rhetoricity of Philosophy will be of interest to scholars and advanced students working in contemporary European philosophy, rhetoric, argumentation studies, and social theory.

Drawing on research conducted in collaboration with the French Institute for Radiological Protection and Nuclear Safety (IRSN), the ideas that are put forward rely on a review of the practices of specialists in human and organizational factors concerning nuclear safety. The author shows that the French approach depends on maintaining a technical dialogue between the regulatory authority (ASN), IRSN and nuclear operators. This method of risk management is known as "French cooking" in the Anglo-Saxon world, where a more formal regulatory approach is taken. This technical dialogue does however hold certain benefits, particularly in the field of human and organizational factors, where it allows an advancement of the state of knowledge, which remains incomplete. After the Fukushima accident, in the face of an ongoing European and global re-evaluation of the safety of nuclear power and alignment towards the Anglo-Saxon standard, the French cooking approach may yet be able to make a significant contribution. The main purpose of the Colloquium was to commemorate the publication in 1958 of the books La nouvelle rhétorique: Traité de l’argumentation, and The Uses of Arguments, by, respectively, C. Perelman/L. Olbrechts-Tyteca, and S. Toulmin. But another important goal was to take stock of the state of rhetoric and argumentation theory at the beginning of a new century. It was a unique event, without parallel in Portugal and worldwide - considering its theme and its aims -, which gathered some of the World’s most renowned rhetoric and argumentation theorists: Alan Gross, Douglas Walton, Erik Krabbe, Frans V. Eemeren, F. Snoeck Henkemans, Guy Haarscher, John Anthony Blair, Marianne Doury, Oswald Ducrot, Ruth Amossy. The book includes a variety of very important contributions to rhetoric and argumentation theory, ranging from those that naturally fall within the subject matter, to the areas of philosophy, linguistics, communication theory, education theory and law theory. The “art”, as it was called in the Medieval curricula, is no longer a discipline amongst others and has became, according to the view of some specialists and largely owing to Perelman and Toulmin influences, a “new paradigm” of rationality for our age, which auspiciously encompasses all fields of knowledge and culture. Ricoeur, Lacan, P. M. Schuhl, Koyré sur le thème : Pourquoi y-a-t-il désaccords entre philosophes, juristes et autres domaines ... Le désaccord qui oppose certains philosophes entre eux ne les disqualifie-t-il pas ? La philosophie est-elle capable de dépasser le désaccord ? Ces questions n'étaient pourtant pas nouvelles déjà Descartes se les posaient. Mais Perelman se définit comme anticartésien, comme Pierce qu'il admire, et son oeuvre envisage la question du désaccord d'une tout autre manière que Descartes. On peut poser la question ainsi : Pourquoi la doctrine cartésienne du désaccord est-elle inacceptable pour Perelman ? Alors que le désaccord était pour Descartes le signe de l'erreur, Perelman en revendique la légitimité. Le désaccord entre les perspectives théoriques des philosophes semblait presque inadmissible au premier, il se trouvera au contraire expliqué et même justifié dans les domaines juridiques et politiques par Perelman. Ce travail se propose de réaliser un examen général et critique de l'oeuvre de Perelman afin de souligner les imprécisions et indécisions qui demeurent dans cette oeuvre at qui ne peuvent être résolues que par une orientation interprétative déterminée. Le plus grand attrait de l'oeuvre de Perelman réside en effet dans un profond paradoxe, relatif à la revendication de la rhétorique pour la constitution de la raison. C'est par la rhétorique que se comprendraient les thèmes du jugement, de la justice, de la raison et enfin de la liberté. Le jugement rhétorique déterminerait les critères de la justice, leur application aux cas particuliers et la rhétorique serait fondatrice de la rationalité. Enfin et surtout la liberté de pensée se gagnerait par une activité rhétorique. Ce travail ne vise d'ailleurs pas à réduire la force de ces paradoxes mais à les reconduire vers leur enjeu ultime à savoir la question de la liberté de la raison. La liberté ne se fondant selon Perelman ni sur une spontanéité immotivée ni sur un savoir scientifique, elle doit se comprendre comme liberté de la raison rhétorique. Prenant le contre pied de ce présupposé, Perelman soutient au contraire que seule une rhétorique argumentée est rationnelle et juste. L'étude du droit positif le confirme : l'argumentation juridique est essentiellement rhétorique et c'est ce qui fait sa valeur. Les parties au procès, les différentes instances juridictionnelles et enfin la dogmatique juridique prétendent à la liberté et à la rationnalité et les établissent, pour une part, lorsqu'elles tentent de se persuader mutuellement du bien-fondé de leur interprétation de la loi.
