Book excerpt: Scandinavian design is still seen as democratic, functional and simple, its products exemplifying the same characteristics now as they have done since the 1950s. But both the essence and the history of Scandinavian design are much more complex than this. Scandinavian Design: Alternative Histories presents a radically new assessment, a corrective to the persistent mythologies and reductive accounts of Scandinavian design. The book brings together case studies from the early twentieth century to today. Drawn from fields as diverse as transport, engineering, packaging, photography, law, interiors, and corporate identity, these studies tell new or unfamiliar stories about the production, mediation and consumption of design. An alternative history is created, one much more alive to national and regional differences and to types of product. Scandinavian Design analyses a century of design culture from Denmark, Finland, Norway and Sweden and, in so doing, presents a sophisticated introduction to Scandinavian design.

Available in PDF, EPUB and Kindle. Book excerpt: Protecting designs is complex and diverse; it involves deciding whether to protect them by design law, copyright law, or by both laws. A single protection may be under- or overprotective but two or more can be overprotective if there are no rules regulating the overlap. Legal systems in Europe and abroad have struggled to find the most adequate solution to this problem. This book traces the history of the design/copyright interface of fifteen countries, selected for their diversity in the way they dealt with the interface. It examines how these countries have coped with the problems engendered by the interface, the rules they applied to it over time and the reasons for legislative changes. This analysis reveals the most appropriate rules to regulate the interface at EU and global level and will appeal to academics, practising lawyers, judges, students and policymakers all over the world.

Book Ownership of Rights in Audiovisual Productions

Download or read book Ownership of Rights in Audiovisual Productions written by Salokannel and published by Martinus Nijhoff Publishers. This book was released on 2023-09-14 with total page 399 pages. Available in PDF, EPUB and Kindle. Book excerpt: In a single generation audiovisual production technology has made two enormous leaps: interactivity and digital exploitation. Any law that deals with satellite transmission must take into account the ownership rights in audiovisual productions, and maintain a clear perspective on how existing laws in the field have been adapted - and will continue to be adapted - to protect authors. Who owns the digital exploitation rights in the audiovisual work? Who is entitled to collect remunerations collected from private copying? How do moral rights affect the licensing of rights in audiovisual works? These are some of the most contentious questions dealt with in this book. The book provides a comprehensive comparative framework for analysis of the regulation of ownership of rights in audiovisual productions in Europe. It is the first presentation that examines these issues in the light of revised Nordic copyright laws and the respective national regulations of Germany, France, Belgium, the United Kingdom and the United States. In addition, the book explains in detail how international and European Community regulations affect rights owners in audiovisual productions. The audiovisual sector is also an area where the differences between the civil law systems of author's rights and common law based copyright systems are particularly pronounced. This book clarifies some of the common misunderstandings encountered in this respect.

Book excerpt: What is the relationship between creativity, cultural heritage institutions and copyright? Who owns culture and cultural heritage? The digital age has expanded the horizon of creative possibilities for artists and cultural institutions - what is the impact on legal regimes that were constructed for an analogue world? What are the tensions between the safeguarding of cultural heritage and the dissemination of knowledge about culture? Inspired by a three year research project involving leading European universities, this book explores the relationship between copyright and intellectual property, creativity and innovation, and cultural heritage institutions. Its contributors are scholars from both the humanities and the social sciences - from cultural studies to law - as well as cultural practitioners and representatives from cultural heritage institutions. They all share an interest in the contribution of intellectual property to the role of cultural institutions in making culture accessible and encouraging new creativity.

Available in PDF, EPUB and Kindle. Book excerpt: Recent years have seen a number of pressing developments in copyright law: there has been an enormous increase in the range and type of work accorded protection; the concept of the ‘original work’ has entered into national copyright acts; and intangible entities are now entitled to protection by copyright. All these are consequences of legislative and technological developments that can be traced back over two centuries and more. the result. This book presents an interdisciplinary study of the growth of copyright law, largely based on archival research and on archival materials only recently made available online. The new history here articulated helps to explain why print is no longer today the sole or even the chief object of copyright protection. Taking its key examples from British, French and Danish copyright law, the book begins by exploring how the earliest copyright laws emerged out of the technological understanding of a printed ‘copy,’ and out of the philosophical notions of originals and copies, tangibles and intangibles. Dr Teilmann-Lockgoes on to examine the concept of the ‘work’ as it develops both conceptually and legally, as the object of protection, and then explains how, in a curious consequence, 'the work' turns the ‘copy’ into the 'mere' material instantiation of the intangible 'original'. The book concludes by addressing the considerable and complicated problems now emerging in copyright law following the inclusion of design within the scope of its protection. In this field Danish law, striving to protect Danish design, has been setting the trend for over a hundred years. In its examination of terminological exchanges between the diverse legal traditions and philosophical discourse, and in its thorough investigation of particular terms central to copyright legislation, this interdisciplinary book will be of great interest to scholars and students of copyright and intellectual property law; it also makes an important contribution to literary studies, legal history and cultural theory.

Available in PDF, EPUB and Kindle. Book excerpt: The edited volume deals with the expansion and institutionalization of intellectual property norms in the twentieth century, with a European focus. Its thirteen chapters revolve around the transfer, adaptation and the ambivalence of legal transplants in the interface between national and international projects, trends and contexts.ÿ The first part discusses the institutionalization of copyright and patent law in the framework of the bigger political and economic projects of the twentieth century. The second and third parts of the collection review relevant processes in the communist regimes and the post-communist societies, respectively. The essays refl ect on the concept and the mechanisms of expansion of intellectual property rights by pointing at processes of enculturation, transnationalization and universalization of norms, as well as practices of incorporation and resistance. The contributors lay a particular emphasis on the role and activity of social actors in the establishment and validation of intellectual property norms and regimes, from the function of experts and creation of expert cultures to the compelling power of popular street protests.
