Su estructura difiere de las constituciones anteriores. Comprende nueve títulos, que tratan: 1) de los principios fundamentales; 2) de los derechos y garantías fundamentales, según una perspectiva moderna y que abarca los derechos individuales y colectivos, los derechos sociales de los trabajadores, la nacionalidad, los derechos políticos y de los partidos políticos; 3) de la organización del Estado, en la que estructura a la federación con sus componentes; 4) de la organización de los poderes: Poder Legislativo, Poder Ejecutivo y Poder Judicial, con la manutención del sistema presidencialista, derrotado el parlamentarismo. Contiene, además, un capítulo sobre las funciones esenciales de la Justicia, con ministerio público, abogacía pública (de la Unión y de los Estados), abogacía privada y defensa pública; 5) de la defensa del Estado y de las instituciones democráticas, con mecanismos del estado de defensa, del estado de sitio y de la seguridad pública; 6) de la tributación y del presupuesto; 7) del orden económico y financiero; 8) del orden social; 9) de las disposiciones generales. Finalmente, viene el Acto de las Disposiciones Transitorias. Ese contenido se distribuye en 245 artículos en la parte permanente, y 73 artículos más en la parte transitoria, reunidos en capítulos, secciones y sub-secciones.

Futbolera tells the stories of women athletes and fans as they navigated the pressures and possibilities within organized sports. Futbolera charts the rise of physical education programs for girls, often driven by ideas of eugenics and proper motherhood, that laid the groundwork for women’s sports clubs, which began to thrive beyond the confines of school systems. Futbolera examines how women challenged both their exclusion from national pastimes and their lack of access to leisure, bodily integrity, and public space. This vibrant history also examines women’s sports through comparative case studies of Argentina, Brazil, Chile, Costa Rica, Mexico, and others. Special attention is given to women’s sports during military dictatorships of the 1970s and 1980s as well as the feminist and democratic movements that followed. This book explores the pivotal role that football played as part of Colombian President Juan Manuel Santos’ national unity project centred on the peace process with the FARC. Football has huge political and social capital in Latin America, and has often been rhetorically deployed by governments for various ends; rarely, however, has football’s power and potential been used in such a deliberate, strategic and active way towards a national peace process and targeted such enduring divisions that have historically impeded a sense of a united nation and national identity. Football in Colombia is understood popularly as one of the few things capable of uniting the country, a belief that Santos seized upon as the national team had a successful campaign in the 2014 World Cup. This first book on Colombian football in English explores previous iterations of football nationalism in the country, including the El Dorado and ‘Narcofootball’ eras, before analysing Santos’ three-pronged strategy empowering professional and amateur football, including the use of political speeches and Twitter, legislation and public policy, and Sport for Development and Peace campaigns, with a particular focus on football in the FARC demobilisation and reincorporation camps following the historic peace agreement.

Millions of people schedule their lives and build identities around it. The World Cup tournament, played every four years, draws an audience of more than a billion people and provides a global platform for displays of athletic prowess, nationalist rhetoric, and commercial advertising. Fútbol is ubiquitous in Latin America, yet few academic histories of the sport exist, and even fewer focus on its relevance to politics in the region. To fill that gap, this book uses amateur fútbol clubs in Chile to understand the history of civic associations, popular culture, and politics. In Citizens and Sportsmen, Brenda Elsey argues that fútbol clubs integrated working-class men into urban politics, connected them to parties, and served as venues of political critique. In this way, they contributed to the democratization of the public sphere. Elsey shows how club members debated ideas about class, ethnic, and gender identities, and also how their belief in the uniquely democratic nature of Chile energized state institutions even as it led members to criticize those very institutions. Furthermore, she reveals how fútbol clubs created rituals, narratives, and symbols that legitimated workers' claims to political subjectivity. Her case study demonstrates that the relationship between formal and informal politics is essential to fostering civic engagement and supporting democratic practices.

It has always been all of these things. Perhaps also it has always been political. In recent years, however, it has become something else besides: economic. Nowadays a lot of money is invested in sport, and sporting competitions often generate enormous amounts of revenue. This has entailed serious repercussions, especially for the relations between individual sportsmen/sportswomen and the sporting clubs and federations that act as brokers for their careers. Into this protected area for decades a closed shop now come the European institutions, especially the European Court of Justice and the European Commission, with the declared intention of ensuring respect for the exigencies of Community law while at the same time protecting the specificity and the integrity of sport. This important book presents an in-depth analysis of the viability under Community law of traditional sports regulations such as transfer rules and nationality clausesboth sets of rules seriously compromised by the Bosman case of 1995. The author asks in particular whether certain rules elaborated by sporting associations can withstand the test of compatibility with the free movement provisions of the EC Treaty. In the light of Bosman, he also rigorously investigates: whether valuable arguments exist for keeping certain sporting rules and practices entirely outside the scope of the EC Treaty; and whether the private nature of sporting clubs constitutes a stumbling block for the application of the relevant free movement rules. Practical Regulation of the Mobility of Sportsmen in the EU Post Bosman comes at a moment when clarification of where this complex and contentious matter currently lies is essential if we are to gauge where it is going. The topic is of special and increasing interest, as official declarations on sport were attached to the Treaties of both Amsterdam and Nice. And, if the draft Constitution for Europe actually enters into force, sport will even become an official area of Union policy.
