Book excerpt: La cohabitation au sein d'une même unité politique de peuples porteurs de cultures différentes ne caractérise pas seulement les plus grands empires. Elle se fait aussi, à des degrés divers à certaines époques de leur histoire, dans presque toutes les nations, à la suite de conflits (guerres, colonisation, etc.), d'annexions, ou du fait de mouvements migratoires. Ce ne sont pas seulement des groupes humains d'origines différentes qui cohabitent alors, mais leurs références culturelles, leurs conceptions de la façon de gérer la vie en société, qu'il s'agisse des relations au sein de la famille, de la place accordée au religieux dans la vie publique ou des attentes et des rôles vis-à-vis de l'Etat. On sait combien les conceptions et les pratiques en matière de règlement des conflits et d'administration de la justice peuvent alors devenir l'objet de divergences profondes. Comment le pouvoir politique prend-il en compte l'altérité culturelle ? Comment traite-t-il la norme judiciaire que portent en eux les groupes soumis à lui ? L'observation de l'histoire, comme celle du monde actuel, nous montre la très large gamme de réponses du politique, qui vont de l'acceptation à l'intolérance face à la diversité des modes de penser et de pratiquer le droit et la justice. Cet ouvrage est consacré à l'analyse de situations qui illustrent la façon dont procède la justice lorsqu'elle est confrontée à la variabilité culturelle. Quelles sont les réponses à des demandes et à des pressions en faveur de la diversité ? Quelles conséquences entraîne l'acceptation du fait qu'une appartenance ethnique pourrait mériter un traitement spécifique dans le domaine de la justice ? Comment cheminer entre une modulation raisonnable et le risque des effets pervers du culturalisme, souvent dénoncés ? Comment se situent les acteurs sociaux vis-à-vis du discours de la diversité, selon les objectifs qu'ils poursuivent ? Même si ces questions ne sont pas nouvelles, elles sont très actuelles. Surtout, elles dépassent désormais le champ d'un pays particulier pour s'inscrire dans un questionnement mondial. Les positions des instances internationales, les mouvements sociaux reliés, au-delà de leur pays d'appartenance, par des réseaux mondiaux, la diffusion des idées valorisant l'identité culturelle, tout cela pose à la justice des questions qui ont de nos jours un écho jusqu'alors inédit.

Mais, doit-on la considerer comme l''unique solution lorsqu''il est demontre qu''elle peut constituer un obstacle tant au retablissement de la paix qu''a l''evolution meme de la justice.

The basic elements of authoritarianism, universality, complementarity, and pluralism should not be employed by superior powers and enforced within the procedures and values of our criminal charter. A pure criminal jurisdiction ought to have its own independent honour and its own unified diverse values including: righteousness, innocence, virtue, honesty, and the preservation of objectivity in legal judgments. At the same time, the notion of diversity should not create an artificial equality in place of authentic, dynamic protection. It is of no essential significance which criminal justice measures are exercised by a court if the rulings of the court are based on clear evidence, and most importantly, if the court has not granted immunity for major criminals through impunity as a result of corrupt proceedings. It is the independent character of criminal justice which earns it its high level of respect. The existence of pure values is the natural and essential requirement for a court and allows it to be qualified as a body with ethical and moral character. A court should not be run through the threat of force or through monopolisation, but rather with trust. Furthermore, the courts are morally required to resist enmeshing themselves in the authoritarian exploitation of criminal justice. Working towards this goal should be imperative in the mechanism of criminal jurisprudence. This is the most plausible method for decreasing the number of victims of core international crimes and achieving pluralist values of diversity"--
