Indeed, many scholars have argued it is the greatest opinion handed down by the greatest Chief Justice, in which he declared the act creating the Second Bank of the United States constitutional and Maryland's attempt to tax it unconstitutional. Although it is now recognized as the foundational statement for a strong and active federal government, the immediate impact of the ruling was short-lived and widely criticized.Placing the decision and the public reaction to it in their proper historical context, Richard E. Ellis finds that Maryland, though unopposed to the Bank, helped to bring the case before the Court and a sympathetic Chief Justice, who worked behind the scenes to save the embattled institution. Almost all treatments of the case consider it solely from Marshall's perspective, yet a careful examination reveals other, even more important issues that the Chief Justice chose to ignore. Ellis demonstrates that the points which mattered most to the States were not treated by the Court's decision: the private, profit-making nature of the Second Bank, its right to establish branches wherever it wanted with immunity from state taxation, and the right of the States to tax the Bank simply for revenue purposes. Addressing these issues would have undercut Marshall's nationalist view of the Constitution, and his unwillingness to adequately deal with them produced immediate, widespread, and varied dissatisfaction among the States. Ellis argues that Marshall's "aggressive nationalism" was ultimately counter-productive: his overreaching led to Jackson's democratic rejection of the decision and failed to reconcile states' rights to the effective operation of the institutions of federal governance.Elegantly written, full of new information, and the first in-depth examination of McCulloch v. Monroe—not uniquely among the American founders—hated political parties, even writing that he "always considered their existence as the curse of the country." Yet his career saw the rise, fall, and rebirth of American political parties. In The Founders' Curse, historian Brook Poston tells the story of Monroe's decision to help create the Jeffersonian Republican party, his efforts to destroy the Federalists and eliminate the need for parties, and the role he played in their rebirth as various parties developed after the battle to succeed his presidency in 1824. Book excerpt: This third volume in the ten-volume series covers the career of Henry Clay from the Second Session of the Sixteenth Congress, where he engineered the second Missouri Compromise, to the presidential election of 1824, when he found himself eliminated as a candidate. Upon his return from Congress in 1821, Clay practiced law and interested himself in Transylvania University, among other things. Elected again to the House of Representatives and to the Speakership in the Eighteenth Congress, Clay resumed his leadership in national affairs; his concerns at this period were principally with the Monroe Doctrine, the Spanish and Greek revolutions, and internal improvements and the tariff. A continuing thread in the volume is the presidential campaign of 1824. Clay's correspondence illustrates the changes in political techniques brought about by the emergence of the Jacksonian type of campaign. Sectionalism, already revealed as a danger to the Union, continued as an important issue. Clay's optimistic anticipation of his election of course proved incorrect, and the volume ends with Clay in the powerful but uncomfortable position of being able, by throwing his support to one of three candidates before the House of Representatives, to choose the next President of the United States. Publication of this book was assisted by a grant from the National Historical Publications and Records Commission.
