Many countries in Asia have long traditions of public deliberation, in both democratic and undemocratic settings, some of which continue today. Yet in the face of pressures from complex governance, popular protests and democratization, certain deliberative practices – notably deliberative polling – have been ‘parachuted’ into the region without regard to historical or traditional practices of deliberation. And, the motivations differ. Some states have made use of public deliberation in order to contain dissent, while others have more emancipatory goals in mind. The contributors to this book take a comparative perspective on the emergence and evolution of deliberative practices in Asia, and their relationships with democracy. They analyse the main motivations for introducing public deliberation in different political regimes and the effectiveness of public deliberation in Asian countries for solving problems and improving governance. In doing so they evaluate whether deliberative democratic tools, can apply to all societies regardless of their political and cultural differences. Book excerpt: Indonesia suffered an explosion of religious violence, ethnic violence, separatist violence, terrorism, and violence by criminal gangs, the security forces and militias in the late 1990s and early 2000s. By 2002 Indonesia had the worst terrorism problem of any nation. All these forms of violence have now fallen dramatically. How was this accomplished? What drove the rise and the fall of violence? Anomie theory is deployed to explain these developments. Sudden institutional change at the time of the Asian financial crisis and the fall of President Suharto meant the rules of the game were up for grabs. Valerie Braithwaite's motivational postures theory is used to explain the gaming of the rules and the disengagement from authority that occurred in that era. Ultimately resistance to Suharto laid a foundation for commitment to a revised, more democratic, institutional order. The peacebuilding that occurred was not based on the high-integrity truth-seeking and reconciliation that was the normative preference of these authors. Rather it was based on non-truth, sometimes lies, and yet substantial reconciliation. This poses a challenge to restorative justice theories of peacebuilding.

Zurn shows why a normative theory of deliberative democratic constitutionalism yields the best understanding of the legitimacy of constitutional review. He further argues that this function should be institutionalized in a complex, multi-location structure including not only independent constitutional courts but also legislative and executive self-review that would enable interbranch constitutional dialogue and constitutional amendment through deliberative civic constitutional forums. Drawing on sustained critical analyses of diverse pluralist and deliberative democratic arguments concerning the legitimacy of judicial review, Zurn concludes that constitutional review is necessary to ensure the procedural requirements for legitimate democratic self-rule through deliberative cooperation. Claiming that pure normative theory is not sufficient to settle issues of institutional design, Zurn draws on empirical and comparative research to propose reformed institutions of constitutional review that encourage the development of fundamental law as an ongoing project of democratic deliberation and decision.

The legislative process of the 2017 Election Act was the case study employed to examine this assumption. The underlying thinking was that there was a contest between “wealth power” (oligarchy) and “participation power” (democracy). The power of wealth controls the party and government institutions. Notwithstanding the presence of participation power, there was, however, no balance between wealth power and participation power, because the formal control of politics was in the hands of party oligarchs. This study is purposed to bridge the gap in knowledge by exploring how the party oligarchs maintain the policymaking, reputedly using cartelized strategies, to defend the status quo. By employing the oligarchy and cartelization concepts, the central question of this inquiry focused on how the party oligarchs mastered the policy process in post-Suharto Indonesia. Qualitative findings indicated that the party oligarchs engineered the legal process in parliament applying cartelized strategies to defend privileges they obtained from collusive interpenetrations with the state. Understanding the “oligarchic cartelization” theoretical postulate is a fundamental step for party members to improve their performance in public offices. The results of this study can also be a useful reference for pro-democracy activists to defend the ontological essence of public participation in implementing representative democracy at an appropriate level.

Book excerpt: As Brazil and other countries in Latin America turned away from their authoritarian past and began the transition to democracy in the 1980s and 1990s, interest in developing new institutions to bring the benefits of democracy to the citizens in the lower socioeconomic strata intensified, and a number of experiments were undertaken. Perhaps the one receiving the most attention has been Participatory Budgeting (PB), first launched in the southern Brazilian city of Porto Alegre in 1989 by a coalition of civil society activists and Workers&’ Party officials. PB quickly spread to more than 250 other municipalities in the country, and it has since been adopted in more than twenty countries worldwide. Most of the scholarly literature has focused on the successful case of Porto Alegre and has neglected to analyze how it fared elsewhere. In this first rigorous comparative study of the phenomenon, Brian Wampler draws evidence from eight municipalities in Brazil to show the varying degrees of success and failure PB has experienced. He identifies why some PB programs have done better than others in achieving the twin goals of ensuring governmental accountability and empowering citizenship rights for the poor residents of these cities in the quest for greater social justice and a well-functioning democracy. Conducting extensive interviews, applying a survey to 650 PB delegates, doing detailed analysis of budgets, and engaging in participant observation, Wampler finds that the three most important factors explaining the variation are the incentives for mayoral administrations to delegate authority, the way civil society organizations and citizens respond to the new institutions, and the particular rule structure that is used to delegate authority to citizens.

Cities - both as political and material entities - are increasingly playing a critical role in shaping the trajectory and impacts of climate change action. However, their policy, planning, and governance responses to climate change are fraught with tension and contradictions. While on one hand local actors play a central role in designing institutions, infrastructures, and behaviors that drive decarbonization and adaptation to changing climatic conditions, their options and incentives are inextricably enmeshed within broader political and economic processes. Resolving these tensions and contradictions is likely to require innovative and multi-level approaches to governing climate change in the city: new interactions, new political actors, new ways of coordinating and mobilizing resources, and new frameworks and technical capacities for decision making. We focus explicitly on those innovations that produce new relationships between levels of government, between government and citizens, and among governments, the private sector, and transnational and civil society actors.
