Book The European Union Legal Order

Download or read book The European Union Legal Order written by Fabian Amtenbrink and published by . This book was released on 2013 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The impact of the European Union legal order on the private law systems of the Member States can only be fully understood when put in the broader context of the raison d'être of European integration and the emergence of a supranational legal order, as well when appreciating the basic mechanics behind the processes that drive the Europeanization of the legal orders of the Member States of the European Union (EU). In fact theses mechanics are quite distinct from those traditionally to be found in the constitutional legal order of states, but also from those in public international law. Highlighting these differences, this contribution first of all observes the the nature of European law as it has emerged since the establishment of the European Coal and Steal Community and thereafter the European Economic Community (Treaty of Rome). Thereafter the two basic tools driving the integrationist efforts of the EU are explained, followed by an overview of the internal market provisions that - arguably even more so than European legislative activities and harmonization measures - are behind the deep intrusion or, to phrase it in somewhat less hostile terms, the adaptation of the national legal orders of the Member States. Indeed, the removal by the Court of Justice of the European Union (CJEU) of barriers to the free movement of inter alia goods and services has been instrumental to the assimilation of the Member States across a vast variety of policy areas and legal fields, including private law. Finally, this contribution concludes with a few reflections of the values underlying the EU's (legislative) activities.

  • Author : Anthony Arnull
  • Publisher : Oxford University Press
  • Release : 2017
  • ISBN : 0198749988
  • Pages : 177 pages

Download or read book European Union Law written by Anthony Arnull and published by Oxford University Press. This book was released on 2017 with total page 177 pages. Available in PDF, EPUB and Kindle. Book excerpt: The European Union is rarely out of the news and, as it deals with the consequences of the Brexit vote and struggles to emerge from the eurozone crisis, it faces difficult questions about its future. In this debate, the law has a central role to play, whether the issue be the governance of the eurozone, the internal market, clawing back powers from Europe, or reducing so-called Brussels red tape. In this Very Short Introduction Anthony Arnull looks at the laws and legal system of the European Union, including EU courts, and discusses the range of issues that the European Union has been given the power to regulate, such as the free movement of goods and people. He considers why an organization based on international treaties has proved capable of having far-reaching effects on both its Member States and on countries that lie beyond its borders, and discusses how its law and legal system have proved remarkably effective in ensuring that Member States respect the commitments they made when they signed the Treaties. Answering some of the key questions surrounding EU law, such as what exactly it is about, and how it has become part of the legal DNA of its Member States so much more effectively than other treaty-based regimes, Arnull considers the future for the European Union. ABOUT THE SERIES: The Very Short Introductions series from Oxford University Press contains hundreds of titles in almost every subject area. These pocket-sized books are the perfect way to get ahead in a new subject quickly. Book Human Rights Protection in the European Legal Order

Download or read book Human Rights Protection in the European Legal Order written by Patricia Popelier and published by . This book was released on 2011 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Ensuring the protection of human rights in Europe has become a highly complex exercise. Where courts are faced with a human rights claim, they not only have to examine the validity of that claim, but they also need to have a clear understanding of the human rights catalogue that is to be applied (i.e. human rights as guaranteed by the national constitution, human rights as protected under EU law, based or not on the Charter, and human rights as identified in the European Convention of Human Rights). This book zooms in on various aspects of the interaction between courts in the complex European system of human rights protection. While other books take either a European or a national approach, this book studies both the co-existence between the European Court of Human Rights and the European Court of Justice, and the impact of this dual mechanism of European human rights protection on the protection offered within specific EU Member States. This makes the book valuable for academics and practitioners who specialize in fundamental rights, EU law, or constitutional law. (Series: Law and Cosmopolitan Values - Vol. 1)
