To what extent and in which direction can we empirically observe a convergence of national policies? In which areas and for which patterns of policy is convergence more or less pronounced? This text addresses these central questions with clarity and rigour. With growing economic and institutional interlinkages between nation states, it is often assumed that there is an overall trend towards increasingly similar policies across countries. Comparative research on the domestic impact of globalization and European integration, however, reveals that policy convergence can hardly be considered as a dominant and uniform tendency which can be taken for granted. Although a number of factors have been suggested in order to account for the rather mixed empirical picture, we still have limited knowledge about the causes and conditions of cross-national policy convergence. In particular, the central mechanisms and conditions affecting both degree and level of cross-national policy convergence are yet not well understood. This book will be of great interest to all students and scholars of the European Union, European politics, and international relations. David Jacobs asks, why are national support instruments for electricity from renewable energy sources converging, even though the harmonisation of these frameworks at the European level has failed? Which causal mechanisms lead to cross-national policy similarities? And what are the implications for policy coordination in the EU? The author traces the evolution of feed-in tariffs - the most successful and most widely used support mechanism for renewable electricity - in Germany, Spain and France. He reveals increasing cross-national policy similarities in feed-in tariff design - despite the failure of harmonizing instruments at the European level. He explains these increasing policy similarities by applying policy convergence theory. Policy convergence can occur voluntarily, based on transnational communication, regulatory competition and technological innovations and these findings have important implications for European policy steering. The key to this book is the interrelation of an innovative theoretical concept (coordination of policies in the international arena via voluntary cooperation) with a very topical empirical research focus - the promotion of renewable energies in the EU. However, things have gone much more slowly than possibly imagined, although if taken in an adequate historic perspective, it is undeniable that the agreements that have led to European Monetary Union signify a really formidable jump in the process of political and economic integration in Europe. This is something many doubted would ever happen, but which is already a reality, although still in need of a period of consolidation. The most general economic consequences of the EMU have already been analysed in considerable depth. Proof of this is the literature already available. In general, there is coincidence in affirming that the balance of the results expected is clearly positive. Firstly, as a result of the anticipated gains in efficiency, a consequence of reduction of transaction costs associated to the previous existence of different currencies and of the elimination of exchange rate uncertainties.

The contributions of renowned academics from various European countries demonstrate the functional interconnection of these protection systems which result in an increasing convergence. Basic questions are reflected, such as human dignity as foundation of fundamental rights or positive action as a specific form of equality as well as the concept of rights convergence. In this latter contribution the forms of direct reception of a different legal order and of the functional transfer of principles and concepts are analyzed. Particular reference is made to the EU Charter, the United Kingdom Human Rights Act as well as to France and Germany. It becomes obvious how important interpretation is for the harmonization of national and conventional fundamental rights protection. Traditional institutional approaches like the dualist transformation concept in Germany are functionally set aside in the harmonization process through constitutional interpretation. Specific studies are dedicated to the field of the EU Fundamental Rights Charter and to the European impacts on the national fundamental rights protection in selected countries such as the “new democracies” Poland, Romania and Kosovo as well as more traditional systems such as Spain, Italy, the Nordic countries or Turkey.

The applicant states from Eastern Europe are much poorer than the current member states from Western Europe. Their democracy and in some cases even their statehood is newly established and presumably more fragile. Their economic, legal and administrative structures are less developed. This collection of essays will try to examine the origin, nature, scale and implications of this divergence. How much divergence is likely to be imported by the Union and will it hamper the process of European integration? This volume looks at differences and similarities in the field of macro-economics, welfare systems, democracy, institutional infrastructure, civic orientations and popular culture. The book shows that the map of convergence and divergence in the future EU will be very complex and will not correspond exactly with the old east-west divide. Moreover, the division lines are constantly changing with the enlargement process representing an important factor pushing individual states into a single regulatory frame, if not in a common political direction. However, there are other "unifying" factors at play: globalization produces different models and loyalties than Europeanization. Moreover, the European pulling effect works unevenly in different functional fields and in different countries. There are also many factors that produce greater divergence rather than convergence across the European Union; a certain degree of divergence is thus unavoidable. The book shows, in particular, that certain types of divergence can be beneficial rather than merely detrimental in the process of European integration.
