Justifica este estudio reconocer que la tecnología es motor de desarrollo, y no un mero generador de riqueza, por lo que resulta fundamental dimensionar su impacto y fuerza transformadora en la sociedad. Revisar la relación entre la tecnología como fuente de transformación, el mercado como espacio del tráfico internacional de bienes intangibles y el derecho como marco regulador resulta necesario para interpretar la manera en que este contexto permea las relaciones negociales sobre bienes intangibles. El desarrollo de los temas se divide en dos grandes partes. La primera, "Nociones generales sobre transferencia de tecnología", introduce el tema de qué es la tecnología, cuáles sus formas de protección, sus modelos de interpretación y da ejemplos de tipos contractuales para transferir una tecnología. La segunda, "Explotación de tecnologías a través del contrato de licencia", explica esta figura jurídica para, finalmente, cerrar con el registro de contratos de transferencia de tecnología importada a Colombia. Dentro de los hallazgos, se tiene que los contratos se han vuelto más flexibles y abiertos para dar entrada a la autorregulación y al uso de gran variedad de figuras atípicas, y así hacer posible la circulación de intangibles en un mundo globalizado. De esto se concluye que en los procesos de construcción de los acuerdos, cuando se negocia su realización, deben valorarse no solo los intereses interpartes, sino además la influencia de nuevos reguladores, ámbitos territoriales de libre competencia y una variedad de aspectos que hacen de la realización de un contrato una labor artesanal.
