Book excerpt: The Comprehensive Plan of Action for Indo-Chinese Refugees was devised to respond to the many thousands of people fleeing Vietnam and Laos in the 1980s. The principal objectives of the CPA 1989 were to reverse that exodus by putting in place the political and practical framework that would stem future irregular flows and return those not in need of international protection. It created a system of refugee status determination (screening) in the countries of first asylum that allowed those who met the criteria to be resettled, but those who fell outside to be returned to their country of origin. While it restored asylum in the region, there were many problems with the CPA that led to concerns that it was merely an example of political expediency.The CPA forced UNHCR to address many mandate and ethical issues. Under the CPA, UNHCR was the primary vehicle through which many of the burden-sharing arrangements were coordinated and steered. The Agency played a pivotal, and in many respects novel, role in all aspects of the CPA in the region, particularly in Vietnam. For UNHCR, the CPA was confirmation that to protect refugees and the institution of asylum, the organisation had to be actively engaged at all stages and places in the displacement cycle, including with non-refugees and in countries of origin.

The international response agreed on in Geneva in 1979 was in line with Western Cold War values, but by 1988 it had begun to unravel. The new international response took the form of the Comprehensive Plan of Action for Indochinese Refugees (CPA), which was in place from 1989 to 1996. This paper offers a detailed look at the process of negotiating the CPA, its contents, how it was received, and its implementation. At the time it was agreed, the CPA was revolutionary in two ways: first, it was comprehensive, and second, it was predicated on the right of Vietnamese boat people to land and to be processed for refugee status. As a result, the CPA both saved lives and marked the transition from blanket recognition of refugee status to individual status determination -- all in a region whose countries had not ratified the Refugee Convention." --

Book excerpt: This issue of the International Journal of Refugee Law is devoted to the Comprehensive Plan of Action (CPA) for Indo-Chinese asylum seekers in South East Asia, a regional agreement aimed at resolving the problem of outflows from Vietnam. Under the agreement, resettlement offers were no longer to be linked to the simple fact of departure, but to "recognized refugees" only. Recognition was to be determined by a consistent refugee status determination process. The idea of a region-wide status determination policy is unique and forms the focus for this issue, which draws on papers prepared for a 1992 colloquium in Manila, organized by the Jesuit Refugee Service Asia/Pacific. Andrew Shacknove analyzes the current shift, among affluent states, away from a commitment to offering asylum towards a policy of containment in or near the country of origin. Sten Bronée provides a history of the origins of the CPA, while Arthur Helton and Roda Mushkat assess the refugee status determination process, the former in relation to the region as a whole, the latter with special reference to Hong Kong. The final paper is by Carole McDonald and offers an account of the damaging effects of detention on unaccompanied minors and other children as a consequence of CPA procedures and delays. The full texts of the CPA and the 1988 Memorandum of Understanding betweenUNHCR and Vietnam are included.
