Book New York State Public School Superintendents Perceptions of the Efficacy of the Impasse Procedures Under the Taylor Law and the Effect of the Impasse on School Climate electronic Resource

Download or read book New York State Public School Superintendents Perceptions of the Efficacy of the Impasse Procedures Under the Taylor Law and the Effect of the Impasse on School Climate electronic Resource written by Deborah L. Fox and published by . This book was released on 2012 with total page 132 pages. Available in PDF, EPUB and Kindle. Book excerpt: The purpose of this quantitative and qualitative research was to investigate New York State public school superintendents' perceptions of the efficacy of impasse procedures within the Taylor Law, including the Triborough Amendment, to study perceptions of the nature of the relationship between union and district leaders during impasse, and to examine perceptions of the impact of impasse on school climate for students, parents, and teachers. Superintendents also recommended changes to the impasse procedures within New York State's Taylor Law. An invitation to participate in the research was initially sent to all New York State public school superintendents and BOCES (Board of Cooperative Educational Services) district superintendents. Those who served as superintendents of districts during a period of impasse in teacher negotiations during the past ten years were invited to participate in an online survey to collect data for this research. Ninety-five percent of responding superintendents believe the current impasse procedures within the Taylor Law are ineffective. Superintendents overwhelmingly perceive the Triborough Amendment to the Taylor Law to have a negative effect on settling teacher contract negotiations by prolonging periods of impasse due to continuation of all terms and conditions of employment for teachers for an indefinite period of time until a contract settlement is reached.Two-thirds of superintendents perceived impasse in teacher contract negotiations to contribute to a negative to highly negative relationship between union and district leaders. School climate for teachers was most significantly impacted with respondent superintendents reporting 73.1 percent of teachers negatively or highly negatively affected by impasse. Results from this research will be particularly important to public school system leaders, teacher union leaders, and New York State policymakers.

Book Labor Relations in Education

Download or read book Labor Relations in Education written by Todd A. DeMitchell and published by R&L Education. This book was released on 2010-01-16 with total page 212 pages. Available in PDF, EPUB and Kindle. Book excerpt: Collective bargaining in the public schools of the nation has its legal roots in the industrial labor model fashioned in the 1930s out of labor strife between union organizers and private businesses. This industrial union labor model was transplanted almost wholesale into the public sector over fifty years ago when teachers, fire and police personnel were granted the legislative right to collectively bargain their wages, benefits, and terms and conditions of employment in most states. What impact has this industrial model had on public education and on the relationship between teachers and administrators? Labor Relations in Education explores unions and collective bargaining in the public schools of America. The history of the laws, the politics of the response to collective bargaining and unions, and the practices of bargaining and managing a contract are explored in this volume. Changes that may move labor relations into professional relations and away from the industrial labor union model and diminish the schism that exists between educators are discussed. A fully developed simulation is included to employ the practices and concepts discussed in the book.

Book excerpt: Updated and revised to reflect new policy and legal decisions, the Fifth Edition of "Public School Law: Teachers' and Students' Rights," provides an all-inclusive treatment of the current status and evolution of the law governing public schools, making it the most comprehensive and well-documented text of its kind. The text addresses legal principles applicable to practitioners in a comprehensive manner avoiding the extensive use of legal terms while still providing thorough documentation for further exploration of issues. It uniquely blends a detailed treatment of landmark cases with a thorough discussion of the legal context, trends, and generalizations to guide all school personnel in their daily activities. Comprehensive coverage of students' and teachers' rights are presented in a clear, straightforward manner. In this new edition, changes in the law and emerging areas of controversy, such as the Religious Freedom Restoration Act, student-initiated devotional activities, discipline of children with disabilities, use of metal detectors in student searches, drug testing of students and employees, judicial oversight in school desegregation, and implementation of affirmative action plans are highlighted. New to This Edition: The content in all chapters has been updated and rewritten, and new sections have been added to reflect recent litigation and capture emerging issues of legal concern. New chapter on special education law (Rights of Students with Disabilities), with charts illustrating IDEA Due Process and applicable laws, reflects the level of legal activity in this area. Increased coverage on numerous topics including sexualharassment, zero tolerance policies, internet use, drug testing, vouchers, and high stakes testing maintains the timeliness of the text so that readers will have access to the most current legal decisions. Extensive documentation in the footnotes, at the bottom of each page, includes not only cases, but also relevant articles for further review. Book Corporal Punishment in U S Public Schools

Download or read book Corporal Punishment in U S Public Schools written by Elizabeth T. Gershoff and published by Springer. This book was released on 2015-01-27 with total page 125 pages. Available in PDF, EPUB and Kindle. Book excerpt: This Brief reviews the past, present, and future use of school corporal punishment in the United States, a practice that remains legal in 19 states as it is constitutionally permitted according to the U.S. Supreme Court. As a result of school corporal punishment, nearly 200,000 children are paddled in schools each year. Most Americans are unaware of this fact or the physical injuries sustained by countless school children who are hit with objects by school personnel in the name of discipline. Therefore, Corporal Punishment in U.S. Public Schools begins by summarizing the legal basis for school corporal punishment and trends in Americans’ attitudes about it. It then presents trends in the use of school corporal punishment in the United States over time to establish its past and current prevalence. It then discusses what is known about the effects of school corporal punishment on children, though with so little research on this topic, much of the relevant literature is focused on parents’ use of corporal punishment with their children. It also provides results from a policy analysis that examines the effect of state-level school corporal punishment bans on trends in juvenile crime. It concludes by discussing potential legal, policy, and advocacy avenues for abolition of school corporal punishment at the state and federal levels as well as summarizing how school corporal punishment is being used and what its potential implications are for thousands of individual students and for the society at large. As school corporal punishment becomes more and more regulated at the state level, Corporal Punishment in U.S. Public Schools serves an essential guide for policymakers and advocates across the country as well as for researchers, scientist-practitioners, and graduate students.

Book The Business of Reforming American Schools

Download or read book The Business of Reforming American Schools written by Denise Gelberg and published by State University of New York Press. This book was released on 1997-10-02 with total page 354 pages. Available in PDF, EPUB and Kindle. Book excerpt: Focusing on the influence of the business community on schools, this book describes how popular business management theories and production processes have been imported into schools during periods of societal upheaval in order to create a sense of order and efficiency while meeting the objective of producing a workforce that meets the specifications set down by employers. Unlike other books that say why schools need to be reformed or how that reform should proceed, this study takes a critical look at the latest call to restructure schools in light of the economic, social, and political forces that affect the education establishment and the children of our nation.
