Book excerpt: Excerpt from Hand-Book of the Law of Bills and Notes In preparing a new edition of Mr. Norton's book, it has been deemed advisable to print as an appendix the Negotiable Instruments Law, which has already been adopted in fifteen states, as well as in the Dis triet of Columbia. It is obvious that even an elementary book upon Bills and Notes must contain references to this law, which, while it is, in the main, declaratory in its efiect, settles some doubtful points, and necessarily changes rules in many jurisdictions upon points con cerning which a conflict of laws existed. The text of the law as print ed in the appendix is that of the New York act, such few modifications as have been made by the various states being mentioned in the notes. The law is also valuable to the student, even in states which have not adopted it, as furnishing a concise statement of rules, which for the most part are of universal application; and for this reason the editor has throughout the book, in the footnotes, inserted references to the appropriate sections of the law, at the same time pointing out any changes effected by them. Much new matter has been incorpo rated, and this has necessitated some alteration of the former text. At the suggestion of many teachers, the publishers have adopted the device of printing in bold type in the footnotes and text the names of all cases there cited which are to be found in certain of the collee tions of leading and illustrative cases on Bills and Notes in use in the law schools. The cases so printed are to be found in Ames' Cases on the Law of Bills and Notes, Huffcut's Negotiable Instruments, and Johnson's Elements of the Law of Negotiable Contracts (second edi tion). The present editor wishes to express his great obligation to Prof. Ames, whose Index and Summary at the end of the cases, unquestion ably the most important contribution to the subject that has been made in America, he has constantly consulted; and to Prof. Hufl'cut, whose Negotiable Instruments is an invaluable commentary upon the Negotiable Instruments Law. Accordingly, it has been necessary to enlarge the book greatly by the addition of many cases; and this has been done with the aim to collect a set of illustrative cases which shall present as comprehensive a view of the subject as can be treated in a course in school. The plan of the book is to lead the student, in his study, to look upon the law of the subject from the standpoint of the law merchant; accordingly, cases have been selected, when possible, which put in the foreground the customs of merchants and bankers as the basis of decision. The head-notes to the cases are aimed to enforce the point, and, at the same time, to present a concise and, as far as possible, a continuous statement of princi ples and rules, which are illustrated by the cases. Book excerpt: Excerpt from Cases on the Law of Bills and Notes: Selected From Decisions of English and American Courts For years past the science of law has been taught by lectures, the use of text-books and more recently by the detailed study, in the class-room, of selected cases. Each method has its advocates, but it is generally agreed that the lecture system should be discarded because in it the lecturer does the work and the student is either a willing receptacle or offers a passive resistance. It is not too much to say that the lecture system is doomed. Instruction by the means of text-books as a supplement or substitute for the formal lecture has made its formal entry into the educational world and obtains widely; but the system is faulty and must pass away as the exclusive means of studying and teaching law. It is an improvement on the formal lecture in that the student works, but if it cannot be said that he works to no purpose, it is a fact that he works from the wrong end. The rule is learned without the reason, or both rule and reason are stated in the abstract as the resultant rather than as the process. If we forget the rule we cannot solve the problem; if we have learned to solve the problem it is a simple matter to formulate a rule of our own. The text-book method may strengthen the memory; it may not train the mind, nor does it necessarily strengthen it. A text, if it be short, is at best a summary, and a summary presupposes previous knowledge. If, however, law be considered as a science rather than a collection of arbitrary rules and regulations, it follows that it should be studied as a science. Thus to state the problem is to solve it; the laboratory method has displaced the lecture, and the text yields to the actual experiment. The law reports are in more senses than one books of experiments, and, by studying the actual case, the student co-operates with the judge and works out the conclusion however complicated the facts or the principles involved. A study of cases arranged historically develops the knowledge of the law, and each case is seen to be not an isolated fact but a necessary link in the chain of development. The study of the case is clearly the most practical method, for the student already does in his undergraduate days what he must do all his life; it is curiously the most theoretical and the most practical. Book excerpt: Excerpt from The Law of Bills, Notes and Checks The object designed for the following volume is to guard those dealing with commercial paper and point out the dangerous spots as determined by the leading decisions of the courts of all the states. Although apparently plain, the provisions of the Negotiable Instruments Law have been the subject for many thousand legal actions and but few sections have escaped the necessity of legal interpretation. It was the aim to condense these decisions in language that would be plain to the bank clerk, bank director and the layman dealing with commercial paper, and also to collect the leading decisions for the legal practitioner for ready reference. The want of a book of this nature has been generally expressed by bankers and the legal profession, and although the author makes no pretension to. having fulfilled the requirements, it is hoped that the book may be found of service. In order that important matters might be more forcibly impressed on the reader's mind, illustrations of negotiable and non-negotiable paper have been supplied, as have also forms used in connection with commercial paper and banking. It has been the aim of the courts in tho forty-four states in which the Negotiable Instruments Law has been adopted to construe the law to make it uniform wherever questions of the interpretation of the statute have been presented. Were this not the case the object of the framers and advocates of the law would be lost and the intent of the State Legislatures towards uniformity be reduced to wreckage. While the Law is, with few exceptions, uniform, the numbering of the sections vary. For convenience the numbering of the New York' statute has been followed, with a table of the corresponding sections of the other states. From an almost overwhelming mass of law and precedent selection has been made of what seemed to be the most important and useful. Trusting that the volume may often aid and seldom mislead, it is submitted to the legal profession, bankers and others dealing with commercial paper.
