La critica offerta dal presente trattato, in particolare, muove dalla molteplicità di significati che sono attribuiti all’ambiente e dalla particolare definizione di danno ambientale, tenendo conto anche degli effetti riflessi che detto pregiudizio può spiegare nella sfera individuale dei soggetti, persone fisiche o giuridiche. La disamina, poi, si incentra sul regime della responsabilità ambientale e sulle azioni volte a prevenire e riparare i pregiudizi alle risorse naturali, con le relative modalità di attuazione. In conclusione, si affrontano le dibattute ipotesi della molteplicità di responsabili dello stesso danno ambientale e della responsabilità del proprietario o gestore dell’area compromessa.
