Book Legal Implications of Territorial Secession in Spain

Download or read book Legal Implications of Territorial Secession in Spain written by Carlos Fernández de Casadevante Romani and published by Springer Nature. This book was released on 2022-09-30 with total page 443 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book deals with the secession/separation of territorial entities and the legal consequences that derive from it both for the parent state and for the seceded/separated entity or the entity that intends to secede/separate. This subject is approached from the triple perspective of international law, comparative law, and Spanish law.International law, because it is this legal system which contains the general legal framework within which this issue must be dealt with. Thus, for example, the legal basis of the right to self-determination, the constituent elements of the state, the recognition of states and governments, succession in the matter of treaties, succession in membership of International Organisations, etc. Moreover, international law is also the reference invoked by secessionist/independentist political projects within states in an attempt to provide a legal basis for the legality of their claim.Comparative law, in order to find out not only how most state constitutions deal with secession or independence of their territories, but also the jurisprudence handed down by national courts on the matter (USA, Canada, Italy, France, Spain, among others). And finally, Spanish Law, because the perspective chosen to address the object of study is from the perspective of Spain.

Book Sport in Socialist Yugoslavia

Download or read book Sport in Socialist Yugoslavia written by Dario Brentin and published by Routledge. This book was released on 2018-09-24 with total page 302 pages. Available in PDF, EPUB and Kindle. Book excerpt: The history of sport in socialist Yugoslavia is a peculiar lens through which to examine the country’s social, cultural and political transformations. Sport is represented as one of the most popular and engaging cultural phenomena of social life. Sport both embodied the social dynamics of the socialist period as well as revealing questions of the everyday lives of the Yugoslav people. Ultimately, sport was closely intertwined with the country’s overall destiny. This volume offers an introduction into the myriad social functions that sport served in the Yugoslav socialist project. It illustrates how sport was central to the establishment of Yugoslavia’s physical and leisure culture in the early post-Second World War period, an international promotional tool for Yugoslav communists championing the ideological superiority of the ‘Brotherhood and Unity’ and the Non-Aligned Movement, as well as a social field in which the ideological contradictions of Yugoslav socialism became increasingly apparent. The chapters expand the existing knowledge of the processes that defined Yugoslav sport and contribute to a more nuanced understanding of socialist Yugoslavia in the years between 1945 and 1991. This book was originally published as a special issue of The International Journal of the History of Sport.

Book State Succession in Cultural Property

Download or read book State Succession in Cultural Property written by Andrzej Jakubowski and published by OUP Oxford. This book was released on 2015-06-04 with total page 401 pages. Available in PDF, EPUB and Kindle. Book excerpt: The demise and rebirth of states brings with it a set of very complicated legal issues, among which is the question of how to deal with that state's cultural heritage, whether within its boundaries or not. Through a historical analysis of state dissolution and succession and its impact on cultural heritage from 1815 to present day, the work will identify guiding principles to facilitate the conclusion of agreements on the status of cultural property following the succession of states. Studying primary materials and evidence of state practice that has not been available before, the work will propose a novel approach to state succession from the perspective of the emerging interest of the international community to safeguard cultural heritage. State succession is one of the most obscure areas of international law since its rules are characterized either by their absence or their inconsistency. This book explores to what extent the principles and practice of state succession correspond to the evolution of the concept of cultural heritage in international law. It provides an extensive analysis of the alternations of the international practice and legal doctrine of state succession to tangible cultural heritage since the formation of the European nation-states in the nineteenth century - through the experience of decolonization to the post-Cold War dissolution of multinational states. The book has been awarded Prize of the Professor Manfred Lachs Foundation and Kozminski University in Warsaw for the best monograph in public international law published by a Polish author in 2015, in the category of debuts. On 24 November 2016, the book State Succession in Cultural Property by Andrzej Jakubowski was awarded the Prize of the Professor Manfred Lachs Foundation and Kozminski University in Warsaw for the best monograph in public international law published by a Polish author in 2015, in the category of debuts.

This book was released on 1993 with total page 458 pages. Available in PDF, EPUB and Kindle. Book excerpt: This two-part study examines the law governing maritime boundaries and their delimitation, with special attention being paid to the situation in the Mediterranean Sea. The first part of the work looks at the general principles of international law which operate in relation to maritime boundaries and attempts to elucidate a set of substantive rules of law which can be applied in all cases. The second part applies these rules to a number of important and problematic episodes involving boundary disputes in the Mediterranean Sea, in particular those which have centered upon enclosed and semi-enclosed areas. The work will be of particular value to lawyers concerned with law of the sea disputes especially those with a keen interest in the outcome of outstanding problems in the Mediterranean.
