With this volume, the yearbook’s formal structure has shifted from that of a journal to a thematic anthology. The theme of this year’s volume is “Reparations: Redressing Past Wrongs”. The articles contained in the publication primarily stem from contributions prepared for a conference entitled “The Right to Compensation and Related Remedies for Racial Discrimination” that was hosted by the Danish Centre for Human Rights in April 2001. The conference was organised in anticipation of the World Conference Against Racism, Racial Discrimination, Xenophobia and Related Intolerance, which was held in Durban in September 2001. The publication consists of 15 articles divided into four main parts addressing the subjects of “Reparations at the National and Regional Levels”, “Precedence and Standing of International Law”, “The Moral and Social Aspects of Reparation” and “Reflections”. Human Rights in Development is the result of a joint research project born out of longstanding co-operation between the following research institutes and centres for human rights: the Christian Michelsen Institute, Bergen; the Danish Centre for Human Rights, Copenhagen; the Icelandic Human Rights Centre, Reykjavik; the Ludwig Boltzmann Institute of Human Rights, Vienna; the International Centre for Human Rights and Democratic Development, Montreal; the Netherlands Institute of Human Rights, Utrecht; the Norwegian Institute of Human Rights, Oslo; the Raoul Wallenberg Institute of Human Rights and Humanitarian Law, Lund and Åbo Academy University, Åbo.

Book excerpt: The eleventh in the series of yearbooks on Human Rights in Developing Countries, this volume marks a departure from previous editions and a new beginning. The Yearbook will now bear the title of Human Rights in Development, to reflect the fact that it will explore the role of human rights as an integral part of the development process. The new title is also an indication of the fact that the scope of the Yearbook has widened to include human rights topics and issues in the more developed parts of the world as well as in the developing countries covered hitherto. Moreover, human rights are themselves in development and the new Yearbook plans to keep track of standard-setting in the human rights field. Finally, the new title reflects the Yearbook's aim of engaging in more international and comparative studies on the one hand and in more focused local issues on the other. With the rapid spread of new information technology and improved local monitoring capacity in developing countries, there may be less of a need for the type of nation-level country studies the Yearbook performed in the past. Two themes cut across the series of articles contained in the current edition. One, human rights promotion, is explored in various ways; one article looks at the establishment of national human rights institutions as instruments of promotion; another analyses development interventions in terms of their impact on local populations, drawing on UN and World Bank experience; yet another argues the case for using aid in human rights promotion, exemplified by Dutch aid to Guatemala; a fourth investigates the policies of the EU and ASEAN in seeking to improve the human rights situation in Burma; and finally one article looks at the work of the ILO in standard-setting and implementation in the field of child labour. The other theme, local conflict, is addressed in two articles, one looking at local communities in Latin America caught between local customs and ideologically charged civil wars and the other investigating the tensions between centralized rule and local autonomy in Kenya, recently erupting into ethnic violence. Book excerpt: Transitional justice processes are now considered to be crucial steps in facilitating the move from conflict or repression to a secure democratic future. This book contributes to a deeper understanding of transitional justice by examining the complexities of transition in postcolonial societies. It focuses particularly on Zimbabwe but draws on relevant comparative material from other postcolonial polities. Examples include but are not limited to African countries such as South Africa, Rwanda and Mozambique. European societies such as Northern Ireland, as well as other nations such as Guatemala, are also considered. While amplifying the breadth of the subject of transitional justice, the book addresses the claim that transitional justice mechanisms in postcolonial countries are necessary if the rule of law and the credibility of the country’s legal institutions are to be restored. Drawing on postcolonial legal theory, and especially on analyses of the relationship between international law and imperialism, the book challenges the assumption that a domestic rule of law ‘deficit’ may be remedied with recourse to international law. Taking up the paradigmatic perception that international law is neutral and has fixed rules, it demonstrates how complex issues which arise during postcolonial transitions require a more critical adoption of transitional justice mechanisms.

As Africans and their supporters mark the 200th anniversary of the abolition of the slave trade in the United States and Great Britain, the question becomes increasingly salient. Calls for reparations for the evils of slavery, as well as for past colonial and current economic and political abuses, can be heard across Africa and the African diaspora. Human rights scholar Rhoda E. Howard-Hassmann examines these calls for redress in Reparations to Africa. Her study analyzes the reparations movement from the perspectives of law, philosophy, political science, and sociology. While acknowledging the brutal background of the slave trade and colonialism, and the mistreatment of the peoples of Africa, Howard-Hassmann finds that the complexity of this history, along with facts of the contemporary situation, weakens the case for financial compensation, although she does recommend acknowledgment of, and apologies for, some actions. The book not only provides a bold reckoning of the root causes, both internal and external, of African underdevelopment and unrest but also suggests alternative means for restorative justice and examines the role that institutions such as the International Criminal Court can play. By including the voices of 74 African academics, diplomats, and activists interviewed by Howard-Hassmann and Anthony P. Lombardo, Reparations to Africa makes a valuable contribution to the reparations debate. In an emotionally and politically charged postcolonial environment, this book serves as a judicious guide to the search for economic justice for Africans today and into the future.
