This book was released on 2014-06-18 with total page 36 pages. Available in PDF, EPUB and Kindle. Book excerpt: Measures and policies to protect employees from bullying and harassment are a common way to ensure that employers fulfill their contractual obligations and their statutory duties to their employees: their existence does not mean that an employer has a problem. In June 2011 the House of Commons Commission agreed such a policy-the "Respect Policy"-to deal with possible bullying and harassment by Members or their staff towards House of Commons staff. That policy had two facets: an informal procedure and a more formal procedure. Although well intentioned, in practice there were at least two flaws in the formal part of the Respect Policy: investigations were undertaken by a House of Commons official, who might be considered to have an interest; and Members had no right of appeal if a complaint was upheld while staff could appeal if it was dismissed. The formal part of the procedure was therefore suspended in November 2012. In March 2014 the House of Commons Commission agreed a further draft of the revised Respect Policy and the unions considered that draft to be "a basis for an effective and proportionate policy". The Respect policy now has four stages, rather than two: stage one: internal resolution (issue raised and possible mediation), stage two: internal resolution (formal grievance meeting), stage three: Commissioner for Standards (consideration), stage four: Commissioner for Standards (investigation and possible referral to the Committee on Standards). The Committee is content for the House of Commons Commission to conclude an agreement with the unions based on the draft Respect Policy

Book excerpt: Oversight of executives has always been a key function of parliaments and one that is central to developing the relationship between the executive and legislative branches of government. However, in reality governments are taking a more pronounced role in controlling legislation, diluting the influence of parliament. This book plots this trend in parliaments across Europe, to illustrate points of convergence and divergence. Book Human dignity and fundamental rights in South Africa and Ireland

Download or read book Human dignity and fundamental rights in South Africa and Ireland written by Anne Hughes and published by PULP. This book was released on 2014-04-11 with total page 659 pages. Available in PDF, EPUB and Kindle. Book excerpt: Post-apartheid South Africa has yielded enlightened judicial decisions in contrast to the limited interpretation of human rights in Ireland. The value of human dignity with its central position in international law underpins both countries’ Constitutions, but has left a more striking mark in South Africa. There it has impacted significantly on punishment for crimes, family life, children’s rights, defamation, sexual violence investigations, substantive equality and socio-economic rights. Practical guidance can be gleaned from South Africa to revitalise Irish jurisprudence. While its focus is on South Africa and Ireland, this book draws on the experience of many countries and regions.

Book International Medical Malpractice Law

Download or read book International Medical Malpractice Law written by Dieter Giesen and published by BRILL. This book was released on 1988-01-01 with total page 1000 pages. Available in PDF, EPUB and Kindle. Book excerpt: This monograph is the most comprehensive comparative law study of legal responsibility arising from medical care presently available. It is written for doctors as well as health care administrators and legal professionals. Focusing on the problems of civil liability, it presents the development, points of contact with, and differences between the modern law of medical liability stemming from both the Common Law and Civil Law traditions of England, Scotland, Eire, New Zealand, Australia, Canada, the United States, South Africa, France, Belgium, West Germany, Switzerland, and Austria. It demonstrates the extent to which both problems of medical law and trends towards their solution are already familiar in these legal systems. The work describes principles and trends, not by confronting the reader with national reports' and separate chapters on different legal systems; rather, the relevant legal problems are analyzed from an integrative, comparative viewpoint. The main thrust of the presentation is the analysis of numerous court decisions -- the number of which is rising ominously in the United States -- on the civil liability of doctors and hospitals for damages arising from substandard treatment or inadequate disclosure of information to the patient. References to the legal and medical literature, indexes, and a refined system of cross-references, together with an important collection of appendices covering legal and ethical declarations make this work accessible as a handbook and reference work for the legal and social problems encountered today in the wide area of law, ethics, and medicine.
