This book was released on 2018-01-04 with total page 358 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Hand-Book of the Law of Sales The object of this handbook is to present concisely the general principles of the law of the sale of personal property. The arrange ment is in the main that of Benjamin. The statement of rules and principles in the black-letter text has to a considerable extent, though with many modifications, necessitated by the difierences between the American and English law, or by other reasons, been taken from the English Sale of Goods Bill, as drafted by his Honor, Judge Chalm ers, and published together with his invaluable notes under the title of The Sale of Goods. This bill, which was purely a codify ing measure, has since been substantially enacted as An act for codifying the law relating to the sale of goods (56 57 Vict. C. 71; February 20, The writer has made frequent use both of the notes of Judge Chalmers and of the text of Benjamin on Sales. The references to Benjamin are to the sections as found in the sixth American edition, of Messrs. Edmund H. And Samuel 0. Bennett. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Handbook of the Law of Sales IN this edition a good deal of new matter has been added, many changes in arrangement have been made, and chapters 1, 3, 4, 7, and 10 have been partly rewritten. Many cases re ported since the first edition, especially on mooted points, have been cited in the notes. It has been deemed advisable to print in an appendix the proposed Sales Act, recommended by the Commissioners on Uniform State Laws, which has already been enacted in sev eral states, and which bids fair, like the Negotiable Instru ments Law, to be adopted generally. The act, like the English Sale of Goods Act, on which it is based, is in the main declara tory of the law, and is valuable as furnishing statements of rules which, for the most part, are of universal application. To a great extent, the statement of rules and principles in the black-letter text has been made to conform to the language of the Sales Act. References to the appropriate sections are made in the notes, care being taken to point out changes proposed, or efiected in states which have adopted the act. For purposes of comparison, the English Sale of Goods Act also has been printed in the appendix, and frequent references to it are made in the notes. F. B. T. Download or read book Handbook of the Law of Sale of Goods Classic Reprint written by John Delatre Falconbridge and published by Forgotten Books. This book was released on 2017-11-04 with total page 202 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Handbook of the Law of Sale of Goods The Sale of Goods Act, 1893, by which the law relating to the sale of goods was codified in the United Kingdom, has now been adopted, with slight modifications, in all the provinces of Canada except Quebec, the process of adoption having been completed by the enactment in Ontario of the Sale of Goods Act, 1920. Prior to the adoption of the stat ute there existed, especially in Ontario, a considerable body of case law. This case law is of course now authoritative only so far as it is consistent with the statute; but for the most part they are' in accord with each other, and the de cisions furnish useful illustrations of the statute. The arrangement of the statute is followed in the main, but in some respects the scheme of the book has necessitated some change in the order of the statutory provisions. The design of the book is to make the statute more readily avail able and more useful in Canada, and references are given to a relatively large number of recent English and Canadian cases. The alphabetical index is supplemented by an unus ually full table of contents, and the comparative table of section numbers will, it is hoped, enable a reader readily to compare the statute in force in one province with that in force in any other province or in the United Kingdom. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law of Sales I conceive law to be the aggregation of rules which courts of justice feel themselves more or less obligated to follow in deciding controversies. To some extent these rules are formulated and declared by legislative author ity. Most of them, however, have been evolved by judges themselves. These latter rules are not always easy to formulate; if they were, there would be no need for real text-books. Even the precise utterances of various judges can not always be accepted as rules. I believe that no judge has power, either practically or theoretically, to bind other judges by any declaration of rule or command, but that the only obligation felt by courts is the obligation to con form to prior judicial action. It is therefore prior judi cial conduct under given circumstances which determines the action of later judges, rather than prior declarations as to what such conduct ought to be. This character, and a synopsis of the more important principles relating to damages, in connection therewith, has been introduced, which Will prove, it is also hoped, a welcome aid. Book Illustrative Cases on the Law of Sales Classic Reprint

Download or read book Illustrative Cases on the Law of Sales Classic Reprint written by Roger W. Cooley and published by Forgotten Books. This book was released on 2017-09-17 with total page 298 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Illustrative Cases on the Law of Sales If the H. C. Keeble Company, instead of having the cotton stored in the warehouse of Phillips 81 Parish, had retained possession of it until, without any authority or license from the appellee, the cotton itself was delivered to the bank in pledge to secure the payment of the note of the H. C. Keeble Company, it is plain that the bank would not have acquired any greater title to the property than that company had to confer, and the appellee would have been entitled to recover the cotton from the bank, or to hold the bank liable for its conversion. But it is claimed that the factor, having stored the cotton in a warehouse, and obtained warehouse receipts therefor to itself, was enabled, by the transfer Of those receipts, to confer upon the bank a claim to the cotton which must prevail against the title of the true owner. Section 1178 Of the Code is relied upon as giving this effect to the transfer Of warehouse receipts by the persons to whom they are issued. The clause of that section upon which this claim is based is in the following words: The receipt of a ware houseman, on which the words 'not negotiable' are not plainly writ ten or stamped, may be transferred by the indorsement thereof, and any person to whom the same is transferred must be deemed and taken to be the owner of the things or property therein specified, so far as to give validity to any pledge, lien, or transfer made or created by such person. Book excerpt: Excerpt from A Treatise on the Law of Sales: Of as Affected by the Statute of Frauds From the pen of a writer upon the law of sales as affected by the Statute of Frauds, hardly more, perhaps, should be expected than to present the subject in as clear a light as possible, without embellishment save by way of illustration. Notwithstanding the subject has received some attention at the hands of writers on contracts and sales, yet, as one harpist may draw from the instrument an inspiration different from another, so perchance, one writer may touch a chord of harmony in presenting a legal theme which may satisfy beyond those which have preceded. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Roman Law of Sale: With Notes and Illustrations; Digest XVIII. 1 and XIX. 1 Translated; With Notes and References to Cases and the Sale of Goods Act Advantage has been taken of the Opportunity to recast several of the notes (especially those headed by a thick rubric), and to add some new ones, in order to give a somewhat more complete view of the subject. The law on two or three matters essentially connected with the contract, though treated under distinct Titles in the Corpus Jam's, has been summarised in an Appendix which is wholly new. A commentary on a text so loosely put together and so full of repetitions must necessarily be somewhat inconsecutive; it is hoped that the numerous cross-references and a very full Index will supply the necessary connecting links. This book was released on 2018-12-23 with total page 82 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Trader's Guide to the Law Affecting the Sale of Goods The law relating to the Sale of Goods has been codified by the Sale of Goods Act, 1893, and according to its learned draughtsman (mr. M. D. Chalmers), the object of this statute is to lay down rules when the parties have either formed no intention, or failed to express it. Moreover, the Act seeks to set out in one consistent whole the entire mass of law relating to its subject matter; that is to say, it endeavours to combine common law (judicial decisions) and statute law. But though the law has been codified by this enactment, yet the common law, as laid down by the judges, loses none of its force. The primary object which the draughtsman had in view in framing the Sale of Goods Act, 1893, was to substantially reproduce, in statutory shape.
