Book excerpt: This book aims to investigate the life and work of Paul Koschaker (1879-1951), who was one of the most prominent legal historians during the first half of the 20th century. From the 1930s onwards, Koschaker is renowned for having attempted reaffirm the authority of Roman law, which was experiencing a major crisis at German universities at the time, mainly due to the Nazi regime's disdain for this subject. Above all, he intend to emphasise the role Roman law played as a cornerstone of European legal tradition, as was masterfully depicted in his book 'Europa und das romische Recht'. Moreover, Koschaker had many other areas of interest throughout his career, such as cuneiform laws and comparative legal history issues. This work in particular attempts to provide the first comprehensive study of Koschaker's biographical experiences, as well as his scientific and academic stances, which have come to light as a result of the discovery and analysis of numerous previously unpublished archival sources.

Book excerpt: Globally, there has been a shift from securities being held directly by an investor, to a situation in which many securities are held via an intermediary. The existence of one or more intermediaries between the investor and the issuer has a potentially significant impact on the rights of the investor, the role and obligations of the issuer, and on the position and responsibilities of the intermediary. However, different jurisdictions have dealt with the issues arising from intermediation in a variety of ways. In the UK, for example, the concept of a trust is used to explain the different rights and obligations which arise in this scenario, whereas in the US the issues have been addressed by legislation, in the form of UCC Article 8. This variety is problematic, given that it is possible for an investor to hold securities in a number of different jurisdictions. A new UNIDROIT Convention on the issue of Intermediated Securities, the Geneva Securities Convention 2009, aims to create a common framework for dealing with these issues. This collection of essays explores the issues that arise when securities are held via an intermediary, and in particular assesses the solutions put forward by the new Convention on this issue. It will be essential reading for practitioners and academics.

The book presents nine papers by eminent scholars from Ukraine, Austria, Canada, and the United States that examine a wide range of topics relating to the last four hundred years: religious culture and the role of clergy as agents of modernization; national identity and transnational religious phenomena; the relationship between sacred tongues and modern language formation; the interaction of secularizing trends with ritual and tradition; the interrelation of religious hierarchies and political movements; and popular belief in relation to religious dogma. The book focuses on Ukrainian territories, but attention is also drawn to Belarusian territories, inasmuch as the Ruthenian (i.e., Ukrainian and Belarusian) lands shared common religious and cultural institutions in the early modern period. The majority of the essays address Ukrainian or Eastern Christian religious formations, but other religious groups, such as Jews, are also discussed. In light of the modern-day globalization of Ukrainian religious groups and the rise of diasporas, some of the essays also cover Western Europe and the Americas. The inward-looking inquiry considers shares as items of personal property. Nowadays those who think of themselves as shareholders often stand one step removed from the share itself. They hold what this book christens a sub-share. This part of the book asks in what sense shares and sub-shares can be conceived to be things, how those things are alienated, and how they are protected in litigation. The outward-looking inquiry then asks whether personal property can be contemplated as a sub-category of the law of things and, more particularly, as the law of all things locatable in space, alienable, or vindicable in court. The outward inquiry considers three boundaries. Within the law of property the line between realty and personalty proves relatively uncontroversial; the second boundary lies between property and obligations; the third between wealth and non-wealth. The second boundary is the main concern. Respect for it necessitates a differentiation between the law of property in the strict sense and the all-encompassing law of wealth, even where the consequence might be to exclude shares and sub-shares from the law of property. In maintaining the value of careful proprietary taxonomy and in reviving the underlying concepts on which it depends, this book opposes modern scepticism as to the possibility and desirability of precision in legal classification. In these commitments it could fairly be styled a post-modern study of personal property. Winner of the SLS Birks Prize for Outstanding Legal Scholarship 2006 - Second Prize.
