Book The Constitutional Jurisprudence of the Federal Republic of Germany

Download or read book The Constitutional Jurisprudence of the Federal Republic of Germany written by Donald P. Kommers and published by Duke University Press. This book was released on 2012-11-09 with total page 902 pages. Available in PDF, EPUB and Kindle. Book excerpt: First published in 1989, The Constitutional Jurisprudence of the Federal Republic of Germany has become an invaluable resource for scholars and practitioners of comparative, international, and constitutional law, as well as of German and European politics. The third edition of this renowned English-language reference has now been fully updated and significantly expanded to incorporate both previously omitted topics and recent decisions of the German Federal Constitutional Court. As in previous editions, Donald P. Kommers and Russell A. Miller's discussions of key developments in German constitutional law are augmented by elegantly translated excerpts from more than one hundred German judicial decisions. Compared to previous editions of The Constitutional Jurisprudence of the Federal Republic of Germany, this third edition more closely tracks Germany's Basic Law and, therefore, the systematic approach reflected in the most-respected German constitutional law commentaries. Entirely new chapters address the relationship between German law and European and international law; social and economic rights, including the property and occupational rights cases that have emerged from Reunification; jurisprudence related to issues of equality, particularly gender equality; and the tension between Germany's counterterrorism efforts and its constitutional guarantees of liberty. Kommers and Miller have also updated existing chapters to address recent decisions involving human rights, federalism, European integration, and religious liberty.

Available in PDF, EPUB and Kindle. Book excerpt: There is currently a proliferation of private telecommunications networks in al most every country of the world. More and more companies are setting up own privately managed and controlled telecommunications networks. Some observers fear that this development may lead to a fragmented telecommunications infra structure in which communication becomes increasingly difficult. Thus, the "net working" of private firms raises questions which resemble certain arguments in the classical "monopoly versus competition" debate in telecommunications. The central problem is whether the creation of a modern and competitive infrastructure can be left to the decentralised decision-making of private economic agents or not. In or der to assess this problem it is indispensible to look more deeply into the actual telecommunications activities of firms. In which ways do firms use telematics? In how far are their strategic options increased by telematics? Are there significant differences in the application of telematics across industries? Are there significant differences in the application of telematics across countries with differing regula tory regimes? Do large firms try to influence telecommunications policy in order to make it more responsive to their needs? These are only some of the questions focussing on the interrelation between firm's competitive strategy, their use of te lematics and the national telecommunications regulatory framework that we want to address in the following for the case of West-Germany.

Book Telecommunications

Download or read book Telecommunications written by Harry C. Katz and published by Cornell University Press. This book was released on 2019-05-15 with total page 411 pages. Available in PDF, EPUB and Kindle. Book excerpt: Telecommunications provides the first comparative description of a pivotal service industry in which deregulation, privatization, and globalization have shaped corporate strategies and structure, and altered the nature of work. A chapter is devoted to each of the countries discussed: the United States, England, Canada, Australia, Japan, Germany, Italy, Norway, Mexico, and Korea. To facilitate comparisons, the authors use a common framework in analyzing changes and their implications for work and employment relations. Most employees in telecommunications, both white-collar and blue-collar, are unionized, and that has highlighted the tension between downsizing and participatory employment strategies. The authors describe adjustment paths adopted in the Anglo-Saxon countries which emphasize a technology- and market-driven approach, in contrast to Japan and several European countries where labor and social pressures have mediated the course and consequences of industrial adjustment. The strategic approach in Korea and Mexico is again different, relying on the state to set the pace and terms of change. The United States and United Kingdom have emerged as pattern leaders in the international telecommunications industry through their aggressive deregulation and restructuring. While downsizing has devastated employee morale, experiments in alternative solutions based on union and employee participation are simultaneously underway.

Book Industry and Politics in West Germany

Download or read book Industry and Politics in West Germany written by Peter J. Katzenstein and published by Cornell University Press. This book was released on 2018-08-06 with total page 381 pages. Available in PDF, EPUB and Kindle. Book excerpt: Dynamic technological developments in industrial production, the rise of new social movements in national politics, and great changes in the international political economy have left a deep imprint on the Federal Republic. A compelling explanation of West Germany's success in maintaining economic prosperity and political stability under such challenging conditions has continued to elude observers. Under the editorship of Peter J. Katzenstein, thirteen distinguished scholars from both sides of the Atlantic here provide an original interpretation of the political economy of the Bonn Republic during the forty years since its founding, and explore in particular its extraordinary capacity for accommodating change. Whereas studies in political economy have typically focused on one level of political action—either the shop floor, or national politics, or the international system—this innovative account analyzes the interaction of change at all three levels, bringing together case studies drawn from six manufacturing and service sectors.
