If the great railway corporations of the country are using their unlimited power without abusing it, if they are transporting the commerce of the country at reasonable rates, with fairness to the general public, with a just regard to the rights of individuals, and without favoritism to places and persons, then they might justly regard government control and regulation as "unnecessary and meddlesome interference." If, however, the public is suffering serious wrong, if there are far-reaching abuses in the transportation of its commerce, if the railway companies are not only carrying the commerce of the country but controlling the commerce of the country, determining where it shall be massed, where the markets shall be located, and their control; if they are discriminating in favor of the large shipper, creating and fostering industrial and commercial monopoly, then there rests upon the several state legislatures and upon congress an obligation to act, and to act at once, with all the determination and patriotism commensurate with the duty to preserve government itself. Capital and labor, wherever employed in the creation of wealth, - whether in mining, or in manufacturing, or in agriculture, - in short, material production, in every field of human activity, is absolutely dependent upon transportation. If there be lack of judicial poise in this regard, it is, at all events, palliated by free confession in advance. Nor is the history of the assumption by public authority Of its inherent right to control railroads, as narrow an interest as it at first appears. Transportation, as a service, is the commodity produced by common carriers. The manner in which the price of this commodity has been brought under governmental regulation has a direct bearing upon another problem just beginning to open up; namely that of the con trol by the state of the prices of other things. It is not unlikely, in my judgment, that the final solution1 of the so called Trust Problem in the United States, Whether for good or ill, may ultimately contain as one important feature, the determination by governmental authority Of reasonable prices for such prime necessities of life as milk, ice, coal, sugar and Oil, when produced under monopolistic conditions. This view is shared by my colleague Professor Taussig in his Principles of Economics. It is also distinctly set forth by President Van Hise Of the University Of Wisconsin, in his recent Con centration and Control. When the seed Of such an industrial policy is planted, as I believe it possible in time, the soil will have been richly prepared for its reception by our experience in the determination of reasonable charges for the services of railroads and other public utilities. Whether the doctrine elabo rated in railroad cases is to govern the courts in passing upon charges prescribed by the legislatures for private industries which have become so far affected with a pub lic interest as to be subject to government control of their rates - such as warehouses and stock yard companies is not clear, especially in view of such cases as Budd vs New York, Brass vs. Stoeser, and Cotting vs. Kansas City Stock Yard Company. Mr. Justice Brewer's re marks in the last named case, though uttered obzter, are interesting because of their suggestion of a different form of review in cases involving industries of this kind. How ever that may be, there is no doubt that the doctrine of judicial review worked out for railroads applies also to the regulation of other forms of public business. And so the same restraints placed upon government control of railroads exist in the case of all public service or quasi public corporations, limiting, for example, the public regulation of street railway fares, and of gas and water rates. These facts lend additional interest to the follow ing inquiry as to the limits which the courts may set, under our Constitution, to public control Of railroad rates, and as to the justice and expediency of such limitation.
