Book excerpt: Nearly all major roads and bridges in the United States are part of the federal-aid highway system and are therefore eligible for assistance from the Emergency Relief Program (ER) of the Federal Highway Administration (FHWA). ER assistance is restricted to roads and bridges on the federal aid highway system, which essentially includes all public roads not functionally classified as either local or rural minor collectors. For disaster-damaged roads that are not federal-aid highways, states may request reimbursement for emergency road repairs from the Federal Emergency Management Agency (FEMA). FEMA may also allow limited funding under its Public Assistance Program for such things as snow removal and related operating costs during extreme snowfalls, which are not eligible for ER funds. This book describes FHWA assistance for the repair and reconstruction of highways and bridges damaged by disasters or catastrophic failures. It begins with a brief discussion of the legislative origins of federal assistance, and then addresses eligibility issues and program operation. Moreover, this book discusses agricultural disaster assistance; presents backgrounds on emergency agricultural land assistance programs; describes snow assistance and assistance for severe winter storms, the declaration process, the criteria used to make eligibility determinations, and the types of assistance that are provided after the President has issued a major disaster declaration for the incident; discusses federal non-agricultural programs for emergency water assistance during droughts; commercial fishery disasters; and examines the Disaster Unemployment Assistance (DUA) benefits.

Book excerpt: The Emergency Relief for Federally Owned Roads Program, or ERFO Program, was established to assist Federal agencies with the repair or reconstruction of Federal roads, which are found to have suffered serious damage by a natural disaster over a wide area or by a catastrophic failure (23CFR668.201). The purpose of this manual is to provide federal land management agencies with guidance and instructions to apply for federal assistance under the ERFO program. Federal, tribal, state, and local governments that have the authority to repair or reconstruct federal roads may apply for ERFO funds, but only the federal land management agencies (FLMA) can apply directly as an “Applicant.” The other governmental entities must apply through an “Applicant.” The intent of the ERFO program is to pay the unusually heavy expenses in the repair and reconstruction of Federal roads 23CFR668.205 (a). The ERFO program is not intended to cover all repair costs nor interim emergency repair costs that are necessary to repair or reconstruct Federal roads. Agencies have the responsibility to perform emergency repairs and fund the unexpected expenditures, shift project priorities and manage reduced traffic service levels that a natural disaster can present. Emergency relief work shall be given prompt attention and priority over non-emergency work.

Chapter Two provides a series of disaster preparation strategies for transit agencies to consider implementing well before a disaster appears imminent. This includes a selection of recommended practices in the areas of planning, operations, contracts, and asset management that will help a transit system better withstand and more quickly recover from a disaster. Chapter Three includes an overview of key disaster response and recovery programs and resources, including information on disaster relief programs available from FTA, FEMA, the Federal Highway Administration (FHWA) and some non-Federal sources. This chapter provides basic guidelines and instructions on identifying the appropriate program and applying for funding. Chapter Four presents detailed information about FTA's Emergency Relief (ER) Program, including an explanation of key program policies and requirements, such as applicant and project eligibility, special conditions for emergency relief grants, and requirements associated with floodplains and insurance. It also includes instructions on applying for waivers from FTA requirements when necessary to support disaster response and recovery. Finally, this manual provides resources in several appendices, including the ER Program Final Rule, frequently asked questions, a glossary, and contact information for FTA, FEMA, and state emergency management offices. This reference manual has been produced by FTA's Office of Program Management in cooperation with FTA's Office of Transit Safety and Oversight.
