This book argues that the Court's land expropriation jurisprudence can only be understood against the political, cultural and institutional context in which it was shaped. Security and economic pressures, the precarious status of the Court in the early years, the pervading ethos of collectivism, the cultural symbolism of public land ownership and the perceived strategic and demographic risks posed by the Israeli Arab population - all contributed to the creation of a harsh and arguably undemocratic land expropriation legal philosophy. This philosophy, the book argues, was applied by the Supreme Court to Arabs and Jews alike from the creation of the state in 1948 and until the 1980s. The book concludes with an analysis of the constitutional change of 1992 and its impact on the legal treatment of property rights under Israeli law.

Before Eminent Domain concentrates on western Europe and the English colonies in America. As Reynolds argues, expropriation was a common legal practice in many societies in which individuals had rights to land. It was generally accepted that land could be taken from them, with compensation, when the community, however defined, needed it. She cites examples of the practice since the early Middle Ages in England, France, Germany, Italy, and Spain, and from the seventeenth century in America. Reynolds concludes with a discussion of past and present ideas and assumptions about community, individual rights, and individual property that underlie the practice of expropriation but have been largely ignored by historians of both political and legal thought.

The study centres on the body of the soldier, the cultural production of images and representations of gender which advance theoretical discussions around war, masculinity and violence. Mlambo employs a transcultural comparative approach based on a persistent factor found in both societies: land expropriation. Often articulated in a framework of patriarchy, land appropriation takes place in the context of war-shaped masculinities. This book fosters a deeper understanding of social processes, adding an important new perspective to the study of military violence, and paying attention to veterans' claims for rewards and compensation. These claims are developed in the context of war and its direct consequences, namely expropriation, confiscation and violence. Land Expropriation in Ancient Rome and Contemporary Zimbabwe contributes to current efforts to decolonise knowledge construction by revealing that a non-Western perspective can broaden our understanding of veterans, war, violence, land and gender in classical culture.

To foreign capital Mexico owes her new awakening. Industrialization has brought with it educational phases which have developed a new nationalistic trend in Mexican policy. The Constitution of 1917, the Agrarian Laws, the Labor Law, and the Law of Expropriation represent the attempt to change a primitive society into a collectivist society. Working to defeat this social reform are the interests of foreign capital invested in Mexico. The conflict was brought into the open first by the land expropriations in which the United States was the big loser. On March 18, 1938 Cardenas announced the expropriation of seventeen oil companies in which Great Britain had the greater interest. The question of the justice of the act and the method of indemnification constitute a very real international problem.

The essays included differ from past discussions, including those provided by law-and-economics, by providing richer accounts of community. By and large, prior discussions by property theorists treat communities as agglomerations of individuals and eschew substantive accounts of justice, favoring what Charles Taylor has called "procedural" conceptions. These perspectives on ownership obscure the possibility that the "community" might have a moral status that differs from neighboring owners or from non-owning individuals. This book examines a variety of social practices that implicate community in its relationship to property. These practices range from more obvious property-based communities like Israeli kibbutzim to surprising examples such as queues. Aspects of law and community in relationship to legal and social institutions both inside and outside of the United States are discussed. Alexander and Peñalver seek to mediate the distance between abstract theory and mundane features of daily life to provide a rich, textured treatment of the relationship between law and community. Instead of defining community in abstractly theoretical terms, they approach the subject through the lens of concrete institutions and social practices. In doing so, they not only enrich our empirical understanding of the relationship between property and community but also provide important insights into the concept of community itself.
