Il traite les œuvres philosophiques que sont le Tractatus et l'Éthique comme si elles relevaient de sciences telles que la mécanique, l'astronomie, etc., et utilise des modèles géométriques appropriés à leur interprétation. L'étude comparative du Tractatus et de l'Éthique, qui ne cessent d'exercer leur influence sur la pensée humaine, permet de conclure que le Tractatus, œuvre du XXe siècle, renoue avec le rationalisme du XVIIe siècle exprimé par Spinoza.

This anthropology addresses the question what it means to be human, capable of participating in moral life. Dierckxsens argues that Ricœur shows that this participation implies being a self, living a singular lived existence with others and being responsible in institutions of justice. Through experiencing life one comes to learn taking moral decisions and the reasons for moral life. The wager of Ricœur’s hermeneutical approach to moral anthropology is—so Dierckxsens argues—to understand moral life on the basis of the interpretation of lived existence, rather than on the basis of cultural or natural patterns only, like many contemporary moral theories in analytical philosophy. Ricœur’s moral anthropology is thus particularly timely in that it offers a critical argument against contemporary moral relativism and reductionism. By bringing together Ricœur’s moral anthropology, and recent moral theories this book offers a novel perspective on Ricœur’s already well-established moral theory. Dierckxsens moreover offers a critical perspective by arguing that we should revisit certain moral concepts in Ricœur’s moral anthropology and in contemporary moral theories in analytical philosophy. He evaluates certain concepts in Ricœur’s work, such as the concept of universal moral norms and how it stands against cultural differences in morals. He moreover interrogates certain ideas of contemporary analytical philosophy, such as the idea of cultural moral relativism and whether we can find a common morality across the cultural differences. By placing Ricœur’s ideas on moral life within the context of the contemporary scene of moral theory, this book contributes well to Studies in the Thought of Paul Ricœur.

The ancient ethical vision of man's nature and goal (we achieve fulfilment by living our lives according to reason, the highest and noblest element of our nature) survives, even, to some extent, in Descartes. But it is put into question especially by the revival of St Augustine's thought, which focuses on the contradictions and disorders of human desires and aspirations. Analyses of behaviour display a powerful suspicion of appearances. Human beings are increasingly seen as motivated by self-love: they are driven by the desire for their own advantage, and take a narcissistic delight in their own image. Moral and religious writers re-emphasize the traditional imperative of self-knowledge, but in such a way as to suggest the difficulties of knowing oneself. Operating with the Cartesian distinction between mind and body, they emphasize the imperceptible influence of bodily processes on our thought and attitudes. They analyse human beings' ignorance (due to self-love) of their own motives and qualities, and the illusions under which they live their lives. Their critique of human behaviour is no less searching than that of writers who have broken with traditional religious morality, such as Hobbes and Spinoza. A wide range of authors is studied, some well-known, others much less so: the abstract and general analyses of philosophers and theologians (Descartes, Jansenius, Malebranche) are juxtaposed with the less systematic and more concrete investigations of writers like Montaigne and La Rochefoucauld, not to mention the theatre of Corneille, Molière, and Racine.

Book excerpt: Appointed by Pope John XXIII to the Pontifical Commission on Population, Family, and Birth, Fuchs ultimately found himself disappointed in his three years of service and spent the next thirty years exploring a broad array of issues pivotal to a reconstruction of Roman Catholic natural law theory. This is the first full-length analysis of Fuchs's efforts. Beginning historically by looking at Fuchs's writings and beliefs before the Pontifical Commission appointment, including his defense of natural law during the "situation ethics" debates of the 50s and 60s, the concept of personal salvation, and the status of "nature" and "human nature," Graham moves to the intellectual conversion that inspired Fuchs to reconsider his concepts following the commission appointment. From there, Graham engages in a sustained critique of Fuchs's natural theory, addressing both the strengths and weaknesses to be found there and suggest possible avenues of development that would make a positive contribution to the ongoing quest to rehabilitate the Roman Catholic natural law theory that continues to dominate the landscape of moral theology today.

The study of the different systems shows that there exist at least three methods to contradict the classic choice-of-law rule. The course is structured around the analysis of these three methods. Firstly, it is the criticism of the rigid character and the unpredictability of the traditional rule that triggers the temptation of a manipulation of the choice of law rule. The author then points out that one could question its abstract and arbitrary character, which leads on the one hand to an attempt to hierarchization, and on the other hand, to a diversification of the choice-of-law rules. Lastly, it is the principle of the foreign law's purpose to govern legal relationships in the same way as the lex fori that is questioned, which leads to its partial elimination to the profit of a more or less systematic application of the territorial law or of the one of the court hearing the action. General Course on Private International Law, Friedrich K. Juenger According to Friedrich Juenger, Professor at the University of California in Davis, the outstanding characteristic of the conflict of laws is the lack of consensus on the discipline's goals and methods. He proposes to put the accent in his course on the events for which public international law must find a solution in order to avoid the constant danger that threatens the discipline: that is, to become a simple academic game. Three examples of reported cases and the kinds of issues they raise are given in the Introduction. Professor Juenger next gives a detailed historical overview of the conflict of laws, from Antiquity to Mancini. In addition, the author presents the emergence of new orthodoxies, or rather proposes to re-examine the traditional doctrines, and points out the advantages of a teleological approach. That allows him to revisit the three cases mentioned in the Introduction.
