The existing literature has focused on the adoption of unilateral divorce laws. However, researchers have overlooked another important legal reform related to divorce: changes in child custody laws. Between the 1970s and 1990s, state custody laws moved from maternal preference, also known as the tender years doctrine, to the best interests of the child doctrine, giving fathers and mothers equal treatment in child custody cases. This dissertation studies the effect of changes in child custody laws on divorce and child outcomes.

Available in PDF, EPUB and Kindle. Book excerpt: In my first essay I use data from licensed child care centers in the state of Arkansas to examine the relationship between quality and price charged. To measure quality, I use Arkansas's Better Beginnings Quality Rating and Improvement System, a tier-structured voluntary certification program which can be viewed as a voluntary increase in regulations for licensed child care centers which allows them to send an observable signal of quality to consumers. Using an hedonic pricing estimation with controls for varying geographic markets, results indicate firms with Better Beginnings classification charge higher prices once the highest levels of certification are obtained. The results provide support for policy in favor of greater reporting or release of information regarding child care characteristics, especially those associated with higher quality care, which allow child care facilities to make their quality known in a way that is easily observable. My second essay seeks to answer the question: Why do some divorcing couples use the courts to settle child custody disputes? Settlement literature predicts that cases should settle efficiently and avoid court costs under symmetric information. Shavell (1993) proposes that settlement failure occurs when the resource under dispute is indivisible and the value placed on it is so high that wealth constraints are binding. These characteristics are present in child custody disputes. In these cases, sharing children through joint custody may be impractical because parents are not able or willing to share. The paper uses the Stanford Child Custody data set to empirically analyze how indivisibility may lead to settlement failure in child custody disputes using variables such as distance between the divorced parents' households, levels of hostility, and differences in custody type filed. Other variables included in the analysis are income, home ownership, involvement levels of each parent with the children, number of children, each parent's desire to settle the divorce case outside of the courts, and the use of lawyers. Results show that parents who file for different types of physical custody and couples that display high levels of hostility are more likely to end up in court. My final essay examines the hypothesis that divorcing couples make trade-offs between child custody and child support in order to secure their preferred custody outcome. Mnookin and Kornhauser (1979) introduce the concept of "bargaining in the shadow of the law" which describes negotiations made between parents in the framework of their existing legal setting. Using data from the Stanford Child Custody Study, I test to see if parents, specifically mothers, accept lower amounts of child support in order to receive sole physical custody of their children. Using a two-stage estimation approach to account for the joint determination of child custody and child support, I find that the legal environment surrounding divorce proceedings, including aspects such as mandatory mediation along with a preference of the courts for joint custody, significantly increases the likelihood of joint physical custody. Results from the estimation of the child support equation suggest that along with the typical guideline variables such as income of the parents, number of children, and visitation, the time between separation and filing for divorce and the mother filing for divorce significantly decrease the support award while lawyer representation of the mother significantly increases the amount of child support issued. Using a selection model, I find that the significant negative relationship between the custody and support equations, accounted for in the selection term, signifies that mothers who "win" their preferred custody are accepting lower amounts of child support.

Book excerpt: I examine in this thesis the impact changes in Child Custody Law can have on children of differing family structures in terms of their educational attainment, and intergenerational educational mobility conditional on parental educational attainment and income. I then explore a possible theoretical explanation for these effects. Chapters 2 and 3 studies the empirical impact of the regime shift from maternal preference to joint custody in custody dispute adjudication in the United States during the 1980s using the one percent Integrated Public Use Microsample Series (IPUMS) of the decennial Census for the decades from 1970 to 1990. Focusing on children between the ages of 15 to 18 who were living with a single divorced and separated parent and of intact families, I found first using cross state and year variation in the timing of adoption of those laws that the children of single parent households living in states which adopted joint custody had a higher probability of high school graduation at age 18. However, children from intact families suffered a decrease in the same probability. This suggests that the law has important unintended negative effects that had thus far been neglected in the literature. The results were robust to the use of the IPUMS Current Population Survey Sample, and Stochastic Dominance Tests. Next using a new distributional overlap measure I found evidence of reduction in alienation between children of intact and single parent families, and particularly between divorced and separated parent families compared with children of widowed parents. This accords with intuition since widowed parent households would not have been affected by the changes in family law. In general, there seem to be a move towards greater intergenerational mobility as a result of joint custody law adoption. In Chapter 4, I model familial choices in labor supply and investments in the quality of children in the shadow of evolving child custody legislations, from the perspective of differential fecundity. The model is able to explain why child support payment rose with joint custody law adoption, and emphasizes the impact the law can have on equilibrium marriage, remarriage and divorce rates.

Book excerpt: This dissertation consists of three essays on the effect of changes in family law in the United States since the divorce revolution in the 1970's on household outcomes. "When Homemakers are Compensated: A Study of the Effects of Homemaking Provision in Property Division Following Divorce on Time Allocation of Married Couples" In the first essay I examine the effects of the homemaking provision in family law that gives recognition to the contribution of homemakers in marriage in the division of properties accumulated during marriage. I develop a non-cooperative bargaining framework to analyze the effects of the provision on the time allocation in household public goods of spouses. The model suggests that the law would enhance gender specialization within the family in states under the unilateral divorce regime. The empirical findings are consistent with this hypothesis. Wives are found to increase the amount of housework they performed by more than 150 hours annually at least within the first 10 years under the unilateral divorce regime when the homemaking provision has been introduced. This effect amounts to 10 percent of the sample mean for wives married prior to the reform. "An Assessment of the Impact of Homemaking Provision in Property Division at Divorce on Investment in Household Public Goods, Marital Formation and Dissolution" This chapter goes on to investigate whether the homemaking provision would enhance the marriage institution by assessing the extent to which the law affects marital formation and dissolution as well as households' investment in public goods such as child-rearing and housing. I find evidence that the homemaking provision stimulates marriage but alters the composition of the pool of individuals that marry. This selection effect tends to induce more divorce. On the net, marriage rates have been raised by at least 5.9 percent in states that have implemented the provision for over 26 year. There is also some evidence that the provision stimulates birth rates and home investment. "The Effect of Child Custody Laws on Marriage" Under the tender years doctrine child custody was virtually always awarded to the mother upon divorce. Gender-neutral custody laws introduced beginning in the 1970's provided married fathers, in principle, equal rights to custody. Subsequent marriage-neutral laws extended the rights to unmarried fathers. We develop a theoretical model of the effect of custody regimes on marriage and test the model's predictions using a unique data set that merges custody law data with data from the Current Population Survey and Vital Statistics. We find that, under marriage-and gender non-neutrality, the introduction of gender-neutral laws reduced marriage by at least 7.5 percent. There is no evidence that moving from marriage non-neutrality to marriage- neutrality affected marriage.
