In accordance with the Council on Environmental Quality requirements contained in 40 CFR 1500--1508.9, the Environmental Assessment examined the environmental impacts of the Proposed Action and discussed potential alternatives. Based on the analysis of impacts in the EA, conducting the proposed action, construction of an analytical laboratory and demolition of the existing facility, would not significantly effect the quality of the human environment within the meaning of the National Environmental Policy Act of 1969 (NEPA) and the Council on Environmental Quality regulations in 40 CFR 1508.18 and 1508.27.

Book excerpt: The ''National Environmental Policy Act of 1969'' (NEPA) requires Federal agency officials to consider the environmental consequences of their proposed actions before decisions are made. In complying with NEPA, the United States (U.S.) Department of Energy (DOE), National Nuclear Security Administration (NNSA) follows the Council on Environmental Quality regulations (40 ''Code of Federal Regulations'' [CFR] 1500-1508) and DOE's own NEPA implementing procedures (10 CFR 1021). The purpose of an environmental assessment (EA) is to provide Federal decision-makers with sufficient evidence and analysis to determine whether to prepare an Environmental impact statement (EIS) or issue a Finding of No Significant Impact. This EA has been prepared to assess environmental consequences resulting from the construction and operation of a Biosafety Level 3 (BSL-3) laboratory facility within the boundaries of the Los Alamos National Laboratory (LANL). LANL is one of the national security laboratories under the authority of the Under Secretary for Nuclear Security of the NNSA who serves as the Administrator for Nuclear Security and Head of the NNSA (50 USC Chapter 41, Section 2402(b)). The objectives of this EA are to (1) describe the underlying purpose and need for NNSA action; (2) describe the Proposed Action and identify and describe any reasonable alternatives that satisfy the purpose and need for NNSA action; (3) describe baseline environmental conditions at LANL; (4) analyze the potential indirect, direct, and cumulative effects to the existing environment from implementation of the Proposed Action and other reasonable alternatives; and (5) compare the effects of the Proposed Action with the No Action Alternative and other reasonable alternatives. For the purposes of compliance with NEPA, reasonable alternatives are identified as being those that meet NNSA's purpose and need for action by virtue of timeliness, appropriate technology, and applicability to LANL. The EA process also provides NNSA with environmental information that can be used in developing mitigative actions, if necessary, to minimize or avoid adverse effects to the quality of the human environment and natural ecosystems should NNSA decide to proceed with implementing the construction and operation of a BSL-3 facility at LANL. Ultimately, the goal of NEPA and this EA is to aid NNSA officials in making decisions based on an understanding of environmental consequences and taking actions that protect, restore, and enhance the environment.

Book excerpt: This Environmental Assessment addresses the environmental effects of a proposed action and the no action alternative to comply with U.S. Environmental Protection Agency (EPA) ground water standards at the Naturita, Colorado, Uranium Mill Tailings Remedial Action Project site. In 1998, the U.S. Department of Energy (DOE) completed surface cleanup at the site and encapsulated the tailings in a disposal cell 15 miles northwest near the former town of Uravan, Colorado. Ground water contaminants of potential concern at the Naturita site are uranium and vanadium. Uranium concentrations exceed the maximum concentration limit (MCL) of 0.044 milligram per liter (mg/L). Vanadium has no MCL; however, vanadium concentrations exceed the EPA Region III residential risk-based concentration of 0.33 mg/L (EPA 2002). The proposed compliance strategy for uranium and vanadium at the Naturita site is no further remediation in conjunction with the application of alternate concentration limits. Institutional controls with ground water and surface water monitoring will be implemented for these constituents as part of the compliance strategy. This compliance strategy will be protective of human health and the environment. The proposed monitoring program will begin upon regulatory concurrence with the Ground Water Compliance Action Plan (DOE 2002a). Monitoring will consist of verifying that institutional controls remain in place, collecting ground water samples to verify that concentrations of uranium and vanadium are decreasing, and collecting surface water samples to verify that contaminant concentrations do not exceed a regulatory limit or risk-based concentration. If these criteria are not met, DOE would reevaluate the proposed action and determine the need for further National Environmental Policy Act documentation. No comments were received from the public during the public comment period. Two public meetings were held during this period. Minutes of these meetings are included as Attachment 1.

Book excerpt: The US Department of Energy (DOE) proposes to conduct a program to characterize groundwater at the Nevada Test Site (NTS), Nye County, Nevada, in accordance with a 1987 DOE memorandum stating that all past, present, and future nuclear test sites would be treated as Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) sites (Memorandum from Bruce Green, Weapons Design and Testing Division, June 6, 1987). DOE has prepared an environmental assessment (DOE/EA-0532) to evaluate the environmental consequences associated with the proposed action, referred to as the Groundwater Characterization Project (GCP). This proposed action includes constructing access roads and drill pads, drilling and testing wells, and monitoring these wells for the purpose of characterizing groundwater at the NTS. Long-term monitoring and possible use of these wells in support of CERCLA, as amended by the Superfund Amendments and Reauthorization Act, is also proposed. The GCP includes measures to mitigate potential impacts on sensitive biological, cultural and historical resources, and to protect workers and the environment from exposure to any radioactive or mixed waste materials that may be encountered. DOE considers those mitigation measures related to sensitive biological, cultural and historic resources as essential to render the impacts of the proposed action not significant, and DOE has prepared a Mitigation Action Plan (MAP) that explains how such mitigations will be planned and implemented. Based on the analyses presented in the EA, DOE has determined that the proposed action is not a major Federal action significantly affecting the quality of the human environment, within the meaning of the National Environmental Policy Act of 1969 (NEPA). Therefore, preparation of an environmental impact statement is not required and the Department is issuing this FONSI.

The sites consist of two areas designated as the North Continent (NC) site and the Union Carbide (UC) site. In 1996, the U.S. Department of Energy (DOE) completed surface cleanup at both sites and encapsulated the tailings in a disposal cell 5 miles east of the original sites. Maximum concentration limits (MCLs) referred to in this environmental assessment are the standards established in Title 40 ''Code of Federal Regulations'' Part 192 (40 CFR 192) unless noted otherwise. Ground water contaminants of potential concern at the NC site are uranium and selenium. Uranium is more prevalent, and concentrations in the majority of alluvial wells at the NC site exceed the MCL of 0.044 milligram per liter (mg/L). Selenium contamination is less prevalent; samples from only one well had concentrations exceeding the MCL of 0.01 mg/L. To achieve compliance with Subpart B of 40 CFR 192 at the NC site, DOE is proposing the strategy of natural flushing in conjunction with institutional controls and continued monitoring. Ground water flow and transport modeling has predicted that concentrations of uranium and selenium in the alluvial aquifer will decrease to levels below their respective MCLs within 50 years.

Book excerpt: Groundwater impacts have been analyzed for the proposed remote-handled low-level waste disposal facility. The analysis was prepared to support the National Environmental Policy Act environmental assessment for the top two ranked sites for the proposed disposal facility. A four-phase screening and analysis approach was documented and applied. Phase I screening was site independent and applied a radionuclide half-life cut-off of 1 year. Phase II screening applied the National Council on Radiation Protection analysis approach and was site independent. Phase III screening used a simplified transport model and site-specific geologic and hydrologic parameters. Phase III neglected the infiltration-reducing engineered cover, the sorption influence of the vault system, dispersion in the vadose zone, vertical dispersion in the aquifer, and the release of radionuclides from specific waste forms. These conservatisms were relaxed in the Phase IV analysis which used a different model with more realistic parameters and assumptions. Phase I screening eliminated 143 of the 246 radionuclides in the inventory from further consideration because each had a half-life less than 1 year. An additional 13 were removed because there was no ingestion dose coefficient available. Of the 90 radionuclides carried forward from Phase I, 57 radionuclides had simulated Phase II screening doses exceeding 0.4 mrem/year. Phase III and IV screening compared the maximum predicted radionuclide concentration in the aquifer to maximum contaminant levels. Of the 57 radionuclides carried forward from Phase II, six radionuclides were identified in Phase III as having simulated future aquifer concentrations exceeding maximum contaminant limits. An additional seven radionuclides had simulated Phase III groundwater concentrations exceeding 1/100th of their respective maximum contaminant levels and were also retained for Phase IV analysis. The Phase IV analysis predicted that none of the thirteen remaining radionuclides would exceed the maximum contaminant levels for either site location. The predicted cumulative effective dose equivalent from all 13 radionuclides also was less than the dose criteria set forth in Department of Energy Order 435.1 for each site location. An evaluation of composite impacts showed one site is preferable over the other based on the potential for commingling of groundwater contamination with other facilities.

As a result of the Corrective Measures Evaluation, it was determined that monitored natural attenuation of all contaminants of concern (trichloroethene, tetrachloroethene, and nitrate) was the preferred remedial alternative for implementation as the corrective measure to remediate contaminated groundwater at Technical Area V of Sandia National Laboratories/New Mexico. Finally, design criteria to meet cleanup goals and objectives and the corrective measures implementation schedule for the preferred remedial alternative are presented.

The COOC provides guidance for implementation of a Corrective Measures Evaluation (CME) for the TA-V Groundwater. This Work Plan documents an initial screening of remedial technologies and presents a list of possible remedial alternatives for those technologies that passed the screening. This Work Plan outlines the methods for evaluating these remedial alternatives and describes possible site-specific evaluation activities necessary to estimate remedy effectiveness and cost. These methods will be reported in the CME Report. This Work Plan outlines the CME Report, including key components and a description of the corrective measures process.
