Book excerpt: François Ewald's landmark The Birth of Solidarity—first published in French in 1986, revised in 1996, with the revised edition appearing here in English for the first time—is one of the most important historical and philosophical studies of the rise of the welfare state. Theorizing the origins of social insurance, Ewald shows how the growing problem of industrial accidents in France throughout the nineteenth century tested the limits of classical liberalism and its notions of individual responsibility. As workers and capitalists confronted each other over the problem of workplace accidents, they transformed the older practice of commercial insurance into an instrument of state intervention, thereby creating an entirely new conception of law, the state, and social solidarity. What emerged was a new system of social insurance guaranteed by the state. The Birth of Solidarity is a classic work of social and political theory that will appeal to all those interested in labor power, the making and dismantling of the welfare state, and Foucauldian notions of governmentality, security, risk, and the limits of liberalism.

Additionally, Michel S. Laguerre seeks to explain the rise of the postdiaspora condition: an emancipatory metamorphosis of diaspora status. Laguerre pays particular attention to the crossborder services that the state provides, transfrontier mechanisms developed by various institutions, as well as extraterritorial forms of management and governance. He sheds light on complex crossborder arrangements and management, the multiplicity of crossborder agencies and organizations, and the promulgation of new laws that provide a legal basis for these extraterritorial undertakings by the state. The ability of emigrants to hold citizen status—and to enjoy access to the same rights and privileges as those offered to residents of the homeland—sets the cosmonational context for the performance of the postdiaspora condition.

Book excerpt: This book addresses emerging questions concerning who should bear responsibility for shouldering risk, as well as the viability of existing and experimental governance mechanisms in connection with new technologies. Scholars from 14 jurisdictions unite their efforts in this edited collection to provide a comparative analysis of how various legal systems are tackling the challenges produced by the legal aspects of genetic testing in insurance and employment. They cover the diverse set of norms that surround this issue, and share insights into relevant international, regional and national incursions into the field. By doing so, the authors offer a basis for comparative reflection, including on whether transnational standard setting might be useful or necessary for the legal aspects of genetic testing as they relate to the insurance and employment contexts. The respective texts cover a broad range of topics, including the prevalence of genetic testing in the contexts of insurance and employment, and policy factors that might affect this prevalence, such as the design of national health or social insurance systems, of private insurance schemes or the availability of low-cost direct-to-consumer genetic testing. Further, the field of genetics is gaining in importance at the international and regional levels. Relevant concepts – mainly genetic tests and genetic data/information – have been internationally defined, and these definitions have influenced definitions adopted nationally. International law also recognizes a “special status” for human genetic data. The authors therefore also consider these definitions and the recognition of the special status of human genetic data within regional and national legal orders. They investigate the range of norms that specifically address the use of genetic testing in employment and insurance, encompassing international sources – including human rights norms – that may be binding or non-binding, as well national statutory, regulatory and soft-law mechanisms. Accordingly, some of the texts examine general frameworks relevant to genetic testing in each country, including those that stem from general anti-discrimination rules and norms protecting rights to autonomy, self-determination, confidentiality and privacy. In closing, the authors provide an overview of the efficiency of their respective legal regimes’ approaches – specific and generalist – to genetic testing or disclosure of genetic information in the employment or insurance contexts, including the effect of lack of legal guidance. In this regard, some of the authors highlight the need for transnational action in the field and make recommendation for future legal developments.

Le 5 juillet 2011, l'Académie des sciences et l'Académie des technologies se sont associées pour consacrer un nouveau colloque aux derniers développements du droit et de la pratique des brevets, en tant qu'outils de l'innovation et de la valorisation. Les actes de ce colloque sont consacrés dans un premier temps au droit positif des brevets d'invention et de leur valorisation. Dans un second temps, sont examinées les évolutions, positives ou négatives, que l'économie mondialisée risque de produire ou a déjà commencé de produire sur le droit actuel, de même que les réactions qu'elle suscite, ou devrait susciter, à tort ou à raison. Pour mener ces réflexions, les Académies ont fait appel aussi bien à des intervenants issus du monde de l'industrie qu'à des chercheurs et universitaires, mais également à des représentants de cabinets de brevets, de l'Office européen des brevets et de la Commission européenne. D'élément d'une stratégie d'entreprise à une stratégie d'État, le droit des brevets, souvent encore national, est confronté à cette économie mondialisée. De celle-ci découle également la multiplication des acteurs intervenant dans ce champ d'action traditionnellement restreint aux relations entre inventeurs et employeurs d'une part, brevetés et licenciés d'autre part. Le monopole accordé par le brevet est-il à remettre en cause ou doit-il être modifié du fait de cette évolution ? Autant de questions auxquelles le présent ouvrage contribue à répondre.

Smith argues that while transformation has occurred in France's financial and education sectors, only relatively marginal shifts have occurred elsewhere in French society. To explain this pattern of continuity and isolated change, the book strongly nuances claims that neo-liberalism, globalization or a rise in populism have been its causes. References to these trends have impacted upon French politics to varying extents, Smith argues; however, France continues to be dominated by issues which are specific to the country and linked to its deep societal structures and history. Smith provides a comprehensive account of French society and politics and in doing so proposes an insightful analytical framework applicable to the comparative analysis of other nations.
