Book excerpt: This article analyses the criminal offences against economy in the Criminal Code of Kosovo which are increasingly becoming an important object of study, both at national and international levels. The criminal offences against economy are in principle blanket nature offences, guiding nature, since the vast majority of such norms are further delineated in other bylaws, while the criminal code provisions provide on criminal offences, thereby guiding towards another legal or sublegal provision. Economic and financial crimes in Kosovo are already making a remarkable increase, as proven by statistical records of state authorities. The increased rate of economic crimes is a result of many factors and circumstances present in Kosovo, which may be different from regional countries. The inefficient fight and prevention of organized crime and corruption in the period between 1999-2010 was stimulated and favoured by several specific factors that are identified and elaborated upon in this article.

Book excerpt: Serious economic crimes and violations of economic, social and cultural rights have often been neglected in criminal proceedings and/or reports of truth commissions following economic transitions or armed conflict. Although economic crimes have often resulted in a substantial loss of profit to economies and societies at large, they have neither been widely nor effectively prosecuted. Central- European and the Balkan region are not exception to this rule. However, as argued in the article, from Nuremberg on, there have been attempts and successful examples of prosecuting war profiteering cases. Even quite recently, the International Criminal Court's prosecutor called for such a prosecution to be conducted before the ICC. The study focuses on criminal responsibility for severe economic offences committed in transitional periods, as well as on establishing serious economic criminal offences as crimes under international law. it explores legal and social preconditions under which serious economic offences may be characterized as crimes under international criminal law.

The prevention, control and punishment of such crimes is thus confronted with a strong globalisation. Moreover, continuous technological evolutions and socio-economic developments make the distinction between socially desirable and undesirable behaviour more problematic. Besides, economic and financial misconduct is notoriously difficult to detect and investigate. In light of these challenges, legislators and law enforcers have been searching for adequate responses to combat economic and financial crime by adapting existing policies, norms and practices and by creating new enforcement mechanisms. The purpose of this volume is to analyse those challenges in the field of economic and financial crime from different perspectives, and to examine which particular solutions criminal justice systems across Europe give to those challenges. The main purpose of the Criminal Code amendments was to facilitate the conviction of organizations further to the commission of offences by its representatives, to induce them to do more to protect their employees and the public. Meanwhile, recent case law developments, more specifically the cases of R. v. Pétroles Global Inc. and Canada v. Maxzone Auto Parts (Canada) Corp., demonstrate that, going forward, organizations will face a greater risk of criminal prosecution and conviction for the acts and omissions of their representatives, especially for subjective mens rea offences under the Competition Act and the Criminal Code. Although the changes made to the Criminal Code are now nearly 10 years old, it was only recently that the courts were called upon to analyze the effect and scope of the changes. In light of recent case law, this article discusses the impacts of the 2004 amendments in terms of subjective mens rea offences. In addition, this article analyzes and comments on the scope of the Bill C-45 amendments as they relate to economic offences and the participatory liability of organizations, the determination of the sentence, and the imposition of probation conditions suitable to organizations.

Book excerpt: A concern that economic crime is changing & increasing has led to frequent calls for justice systems around the world to respond with dramatic new investigatory & prosecutorial powers. This discussion paper questions the need for such justice innovations. It first clarifies three preliminary concepts: the role of profit, globalization, and technological change in determining criminal behaviour. To understand profit-driven crime, it then presents a classification of such crime into several distinct economic categories that are not based on characteristics of the offender: predatory, market-based, and commercial offences. The classification shows how the these types of crimes vary in terms of their economic nature & impact and their legal implications. Section 4 discusses the relationship between criminal activity and its impact on economic welfare. Section 5 describes ten major complications that the traditional justice system faces in coping with economic crime. The final section discusses alternative approaches to address profit-driven crime.
