Available in PDF, EPUB and Kindle. Book excerpt: "The most dishonorable act that can dishonor a man." Such is Félix Grandet’s unsparing view of bankruptcy, adding that even a highway robber—who at least "risks his own life in attacking you"—is worthier of respect. Indeed, the France of Balzac’s day was an unforgiving place for borrowers. Each year, thousands of debtors found themselves arrested for commercial debts. Those who wished to escape debt imprisonment through bankruptcy sacrificed their honor—losing, among other rights and privileges, the ability to vote, to serve on a jury, or even to enter the stock market. Arguing that French Revolutionary and Napoleonic legislation created a conception of commercial identity that tied together the debtor’s social, moral, and physical person, In the Red and in the Black examines the history of debt imprisonment and bankruptcy as a means of understanding the changing logic of commercial debt. Following the practical application of these laws throughout the early nineteenth century, Erika Vause traces how financial failure and fraud became legally disentangled. The idea of personhood established in the Revolution’s aftermath unraveled over the course of the century owing to a growing penal ideology that stressed the state’s virtual monopoly over incarceration and to investors’ desire to insure their financial risks. This meticulously researched study offers a novel conceptualization of how central "the economic" was to new understandings of self, state, and the market. Telling a story deeply resonant in our own age of ambivalence about the innocence of failures by financial institutions and large-scale speculators, Vause reveals how legal personalization and depersonalization of debt was essential for unleashing the latent forces of capitalism itself.

Download or read book A Bank s Duty of Care written by Danny Busch and published by Bloomsbury Publishing. This book was released on 2017-08-24 with total page 461 pages. Available in PDF, EPUB and Kindle. Book excerpt: In recent years, an increasing number of clients and third parties have filed claims against banks such as for mis-selling financial products, poor financial advice, insufficient disclosure of and warning about financial risks. The scope of a bank's duty of care seems to expand, not only to include protection of consumers against unclear risks of complicated products but also protection of professional parties against more obvious risks of relatively straightforward products. This topic raises many questions, both at a theoretical and practical level. This book provides a rich source of information about how various jurisdictions (Germany, Austria, France, Italy, Spain, the Netherlands, England and Wales, Ireland, and the United States of America) deal with these questions and how answers are found or embedded in their national legal systems. The book also contains a detailed chapter on the MiFID I and II conduct-of-business provisions. Finally, the book provides a thorough comparative analysis and perspective.

Available in PDF, EPUB and Kindle. Book excerpt: Through extensive interviews with the key participants, Professor Borins reveals the interplay of organizational ideologies and interests and leaders' personalities that characterized the conflict. He traces its evolution from the early formation of a francophone pressure group, through the airline pilots' strike in June 1976 in support of the controllers, to the agreement between the pilots' and controllers' unions and the Minister of Transport which the French Canadians saw as a humiliating defeat, and to the eventual acknowledgement by the Clark government in August 1979 that bilingual air traffic control was safe. Borins discusses the implications of these events for public policy and French-English relations and concludes that the federal government's ability in this case to meet francophone demands quite rapidly is cause for optimism about the ability of the federal state to accommodate francophone aspirations.

Download or read book Unnaturally French written by Peter Sahlins and published by Cornell University Press. This book was released on 2018-08-06 with total page 473 pages. Available in PDF, EPUB and Kindle. Book excerpt: In his rich and learned new book about the naturalization of foreigners, Peter Sahlins offers an unusual and unexpected contribution to the histories of immigration, nationality, and citizenship in France and Europe. Through a study of foreign citizens, Sahlins discovers and documents a premodern world of legal citizenship, its juridical and administrative fictions, and its social practices. Telling the story of naturalization from the sixteenth to the early nineteenth centuries, Unnaturally French offers an original interpretation of the continuities and ruptures of absolutist and modern citizenship, in the process challenging the historiographical centrality of the French Revolution.Unnaturally French is a brilliant synthesis of social, legal, and political history. At its core are the tens of thousands of foreign citizens whose exhaustively researched social identities and geographic origins are presented here for the first time. Sahlins makes a signal contribution to the legal history of nationality in his comprehensive account of the theory, procedure, and practice of naturalization. In his political history of the making and unmaking of the French absolute monarchy, Sahlins considers the shifting policies toward immigrants, foreign citizens, and state membership.Sahlins argues that the absolute citizen, exemplified in Louis XIV's attempt to tax all foreigners in 1697, gave way to new practices in the middle of the eighteenth century. This "citizenship revolution," long before 1789, produced changes in private and in political culture that led to the abolition of the distinction between foreigners and citizens. Sahlins shows how the Enlightenment and the political failure of the monarchy in France laid the foundations for the development of an exclusively political citizen, in opposition to the absolute citizen who had been above all a legal subject. The author completes his original book with a study of naturalization under Napoleon and the Bourbon Restoration. Tracing the twisted history of the foreign citizen from the Old Regime to the New, Sahlins sheds light on the continuities and ruptures of the revolutionary process, and also its consequences.
