Book excerpt: Depuis le début des années 1990, les pays industrialisés cherchent à promouvoir le retour au travail des allocataires sociaux et multiplient les réformes visant à les "activer". On observe une tendance lourde au renforcement des obligations liées au travail, pouvant aller jusqu'à l'instauration de programmes de travail obligatoires. L'activation peut également passer par le développement d'aides à la recherche d'emploi, de formations ou de stages professionnels. L'ouvrage propose une analyse inédite de l'ensemble de ces mesures sous le prisme des droits humains, plus particulièrement du droit au travail. Ces mesures favorisent-elles la réalisation du droit au travail ou constituent-elles une restriction à la liberté de choisir son emploi ? Pour répondre à cette question, l'auteure procède à une analyse systématique et rigoureuse de la jurisprudence internationale relative au droit au travail. Ce corpus jurisprudentiel, rarement exploité et peu connu des praticiens, se révèle particulièrement fécond, notamment parce que le droit au travail comprend le libre choix de l'emploi et l'interdiction du travail forcé. L'auteure mène parallèlement une réflexion théorique sur le rôle et le pouvoir d'action des droits humains. Le recours aux droits sociaux se meut, pour l'essentiel, dans une logique défensive des acquis du modèle social. Face à la crise de l'Etat-providence, l'auteure propose de se détacher de cette approche et de mobiliser les droits humains comme cadre de discussion, d'apprentissage et de recomposition progressive des politiques sociales. Elle combine les apports de deux théories contemporaines, l'expérimentalisme démocratique de Michael Dorf et Charles Sabel et l'approche par les capacités d'Amartya Sen, pour proposer une théorie pratique de la fonction jurisprudentielle, qui reconnecte les droits et le politique, en vue d'assurer une transformation démocratique du modèle social sous l'égide des droits.

Book excerpt: La constitutionnalisation du droit au travail a permis la reconnaissance de la responsabilité de l'État envers les personnes sans emploi, et donné un fondement au système d'indemnisation du chômage. Mais, en 1958 avec le premier régime d'assurance chômage obligatoire, cette responsabilité a été transférée en partie vers les partenaires sociaux. Cependant, dès les années 80, le régime a fait l'objet de critiques portant sur ses effets désincitatifs au retour à l'emploi. Sous l'influence de l'OCDE et de l'UE prônant une activation des dépenses passives de l'assurance chômage, le régime français d'assurance chômage a progressivement été réformé et l'aide au retour l'emploi est devenue une mission fondamentale. Cette mutation a entraîné au sein du droit du chômage, la pénétration d'une logique de contrepartie et la mise en exergue du devoir de travailler. Comme le démontrent les textes conventionnels et légaux, elle a engendré une responsabilisation des chômeurs indemnisés face au risque chômage. Conformément aux expériences menées dans certains pays de l'UE, cela s'est notamment traduit par une obligation implicite de moyens portant sur le retour vers l'emploi, comme l'illustrent le durcissement des conditions légales d'indemnisation, la contractualisation des liens unissant les chômeurs au service public de l'emploi ou les mesures de reclassement destinées à mettre en adéquation l'offre et la demande d'emploi. Cette réforme de l'assurance chômage soulève par conséquent diverses questions d'ordre juridique, relatives à l'impact de la politique d'incitation au retour à l'emploi, tant sur le régime d'assurance chômage que sur le statut des demandeurs d'emploi indemnisés.

Ce livre propose une analyse systématique des logiques d'intervention qui façonnent ces nouvelles formes de protection sociale. Book excerpt: Cette thèse a pour objectif de saisir les modalités d'intervention de Pôle emploi sur le marché du travail, depuis sa naissance en 2009. Au sein de l'opérateur public de placement, les interactions entre le travail des gestionnaires et celui des conseillers constituent le cœur de cette recherche. Testant l'hypothèse selon laquelle les réformes successives des administrations auraient modifié le statut du chiffre dans l'action publique, l'auteur étudie les mécanismes par lesquels l'Etat s'autorise à objectiver les résultats de son intervention sur le marché du travail. Fondé sur une observation du travail d'accompagnement et sur des entretiens avec les cadres de Pôle Emploi, ce travail éclaire les pratiques quotidiennes de mesure de l'efficacité de l'Etat. Deux pressions s'exercent sur les agents de Pôle emploi : l'une provient des objectifs imposés par les tutelles et l'autre de l'augmentation du nombre de demandeurs d'emploi. L'enquête analyse les bricolages élaborés par les agents pour résoudre ces tensions. L'activité des conseillers à l'emploi apparaît, sous cet angle, comme un travail de catégorisation visant à valoriser chacun des 5,5 millions d'inscrits dans trois langages distincts : celui du marché, celui des prestations d'aide à la recherche d'emploi et celui du droit du travail. Les conseillers éprouvent alors la contradiction entre l'individualisation des politiques d'activation des dépenses de chômage et le caractère collectif du sous-emploi actuel. Cette thèse rend ainsi intelligible le décalage entre le volontarisme politique en matière de lutte contre le chômage et le sentiment d'impuissance des agents de l'Etat mandatés pour mener cette lutte.

Book excerpt: This book breaks new ground by bringing together recent research into the determinants of marginalization risks for the unemployed and research into new social policies for combating marginalization. It examines the major controversies about how far entrapment in unemployment is due to resource constraints, motivational problems, or skill deficiency. It examines the forms that new policies have taken, the way they vary between EU countries, and the effects they have had on the life experiences of the unemployed. Its central concern is how far the new policies developed in the 1990s, in particular the spread of activation and welfare-to-work policies, address the major sources of vulnerability of the unemployed. The chapters draw on the results of a number of major comparative research programmes funded by the European Commission. These provide for the first time rigorous comparative data across a range of different countries. They bring together the insights of researchers from different disciplines: economists, jurists, social-psychologists, and social policy analysts. The book shows that while the new policy initiatives helped to mitigate the severity of the experience of unemployment, they were far from providing an adequate response to the underlying factors that put people at risk of marginalization. These were primarily due to skill deficiencies that were rooted in disadvantages that people experienced when they were young and in the persisting inequalities in training opportunities during people's work careers. The case is made for a major new policy initiative to improve the quality of working life of the low-skilled and their opportunities for skill development.
