The central complaint was that the Crown had breached the principles of the Treaty by failing to actively protect the claimants' ability to exercise their rangatiratanga and decide for themselves how they would settle their historical claims. The report looks at whether the Crown's decision to recognise the claims trust's deed of mandate was fair and reasonable and made in good faith. The Tribunal found that the Crown had failed to act reasonably, honourably, and in good faith and had thus breached the Treaty principles of partnership and active protection"--Publisher information.
