Book excerpt: The &“disappearance&” and torture of many people during the worst days of the authoritarian regimes that ruled many Latin American countries in the 1970s have been well documented and widely condemned as abuses of human rights. Less well known is what has become of the movements for human rights once democratic governments were restored in these countries. In this book, Michelle Bonner reveals how the defense of human rights continues today, taking Argentina as her primary example (with comparison to Chile in the final chapter). Bonner shows that the role of women&—viewed as protectors of the family&—is key to understanding how human rights movements have evolved. Moreover, the continuity of the &“historical frames&” used to legitimate their activity is an essential element in the success of their efforts, even while the claimed abuse has changed from the political repression undertaken by the dictators&’ minions to the economic hardships created by market inequities resulting from neoliberal policies. Based on extensive field research and providing a long historical view extending from colonial times to the present, this study compares the activities of the ten most prominent human rights organizations in Argentina and assesses the responses of both state and society.

Book excerpt: This edition of the Inter-American Yearbook on Human Rights, like the volumes that precede it, includes information concerning the activities of the Organization of American States in the promotion and protection of human rights. It begins with the composition of the Commission and Court, including the biographies of the members, 1988 activities of each body, reproductions of resolutions and reports by the Commission and historic correspondences and decisions by the Court. Also included is an update on the status of the American Convention on Human Rights, which reports the relation of each country to that instrument, followed by resolutions adopted in 1988 by the OAS General Assembly. The year 1988 distinguished itself particularly because the Inter-American Court of Human Rights made its first decision on a contentious case, the Velásquez Rodríguez case (Honduras). This historic decision is reproduced in Part Three of this volume. Another important 1988 development in the Inter-American system was the Protocol of San Salvador, or Additional Protocol to the American Convention on Human Rights for Economic, Social and Cultural Rights, reproduced in Part Four. Also included, in its entirety, is a report on the human rights situation in Haiti, a report requested by the Organization of American States Permanent Council in Resolution 502. The Inter-American Yearbook on Human Rights is completely bilingual (English and Spanish).

Book excerpt: Over the last few decades, debates about policing in poor urban areas have turned from analyzing the state's neglect and abandonment into documenting its harsh interventions and punishing presence. Yet, we know very little about the covert world of state action that is hidden from public view. In The Ambivalent State, Javier Auyero and Katherine Sobering offer an unprecedented look into the clandestine relationships between police agents and drug dealers in Argentina. Drawing on a unique combination of ethnographic fieldwork and documentary evidence, including hundreds of pages of wiretapped phone conversations, they analyze the inner-workings of police-criminal collusion, its connections to drug markets, and how it promotes cynicism and powerlessness in daily life. They argue that an up-close examination of covert state action exposes the workings of an ambivalent state: one that both enforces the rule of law and functions as a partner in criminal behavior. The Ambivalent State develops a political sociology of violence that focuses not only on what takes place in police stations, courts, and poor neighborhoods, but also the clandestine actions and interactions of police, judges, and politicians that structure daily life at the urban margins.

Book excerpt: This book contends that the right of access to justice (at national and international levels) constitutes a basic cornerstone of the international protection of human rights, and conforms a true right to the Law. It amounts, lato sensu, to the right to the realization of justice. In such understanding, it comprises not only the formal access to a tribunal or judge, but also respect for the guarantees of due process of law, the right to a fair trial, and to reparations (whenever they are due), and the faithful execution of judgments. On its part, the right to an effective domestic remedy is a basic pillar of the rule of law in a democratic society. In its part, the right of international individual petition, together with the safeguard of the integrity of international jurisdiction, constitute the basic foundations of the emancipation of the individual vis-à-vis his own State. This is a domain that has undergone a remarkable development in recent years. It is submitted that the right of access to justice belongs today to the domain of jus cogens. Without it, there is no legal system at all. The protection of the human person in the most adverse circumstances has evolved amongst considerations of ordre public. Such recent evolution has been contributing to the gradual expansion of the material content of jus cogens. Furthermore, the very notion of "victim" (encompassing direct, indirect and potential victims) has been the subject of a considerable international case-law. Victims have had their cause vindicated in situations of utmost adversity, if not defencelessness (e.g., abandoned or "street children", undocumented migrants, members of peace communities in situations of armed conflict, internally displaced persons, individuals in infra-human conditions of detention, surviving victims of massacres).
