Book excerpt: Mega-regional agreements have recently stirred controversy, producing a clash between the founding principles of liberalisation and protectionism, giving rise to competence issues between the European Union and its Member States. Although scholarly work has focused for years on the controversial “social clause”, it is now worth carrying out a detailed, legal analysis of the labour standards contained in the mega-regional trade agreements adopted and negotiated by the EU and the US. The topic gives rise to much controversy, as it is influenced by political convictions and election results. For this reason, it poses one of the most significant challenges to international labour law. Based on these considerations, this book examines the social dimension of three of the most relevant mega-regional trade agreements, namely TTP, CETA, and TTIP. It is argued that trade liberalisation should be accompanied by progress in the social and labour field.

The comparative approach offered in this book adds to this synthesis by providing examples of speci c recent developments in fourteen Member States and Turkey. Book excerpt: This book is the first to connect global labor history and the history of human rights: By focusing on democratic labor oppositions in Spain and Poland between 1960 and 1990, it shows how workers in authoritarian regimes addressed repression and whether they developed a language of rights in the light of a globally dynamic human rights discourse. The study argues that the democratic labor oppositions in Spain and Poland were both variants of emancipatory and democracy-oriented social movements with global interconnections that emerged in the 1960s. It reveals that the demands for free and independent trade unions, which in both countries became a flashpoint in the fight for broader democratic demands, was not always discussed in rights terms, but rather presented as an inevitable necessity. At the same time, these labor movements and their intellectual allies morally delegitimized state repression against workers and thereby employed the concepts of democracy, participation, solidarity, progress and eventually, rights. Integrating the history of two European semi-peripheric societies into a broader narrative, this book is relevant for readers interested in global labor history, human rights history and the history of democratization in Europe in the late twentieth century.

Book excerpt: In spite of the fact that detective fiction has been the most popular genre utilised by Spanish authors over the last thirty or so years, the female detective has appeared in such works on relatively rare occasions. Less frequent are Spanish female authors of detective fiction who employ a female detective as their main character. One author who has broken this stereotype is Reyes Calderón, with her female juez de instrucción (examining magistrate), originally created because the author was convinced that one popular, female, main character detective that did exist was simply "a man who was wearing a skirt" (interview with author). With the creation of her Basque character who, over the series, evolves from law-school professor to member of the Spanish Supreme Court, Calderón is able to "design a normal woman who confronts abnormal situations" (interview with author). Through such, Reyes Calderón aptly portrays both how far Spanish women have come since the days/restrictions of the Franco dictatorship but yet how remnants of conservative thought still pervade their mindset. She thus uses the most popular of genres to make a myriad of cultural observations concerning her native country and the women of "her generation". This book focuses on the female detective in Hispanic literature; the Lola MacHor Series, where via the main character Lola, Calderón is conducting a cultural studies experiment/explanation of modern-day Spain; concomitant issues of characterisation and Calderón's debt to Naturalism; Spanish novel writing and narrative style; and the pervading conservative/feminist dichotomy as it transpires in Spanish social commentary and moralising.

Without our history of effective collective bargaining there would be no mutual understanding, no industrial peace, no constructive cooperation between social partners. Yet there is a feeling today that this history has drawn to a close; that our post-industrial world demands something different, something our tradition of collective bargaining and collective agreements cannot give us. What information and insight can we gather to verify or challenge this feeling? This was the first major question addressed by the distinguished delegates to the twenty-seventh World Congress of Labour and Social Security Law held at Montevideo, 2'5 September 2003. The aim of the conference was to discover current problems regarding the existing structures and functions of collective bargaining in industrialized countries today'problems readily identifiable in the context of economic globalization, falling union density, the increase in atypical and knowledge-based workers, and the 'tertiarization' or declining economic importance of manufacturing-based industry. This bulletin contains some of the most important papers devoted to this major theme of the conference. It presents twenty national reports, each written by a scholar well-versed in the law and practice of collective bargaining in the country covered. Two introductory reports deal with such general issues as the varying competences of representatives under different legal systems, labor union representation within the public sector, the development of collective bargaining in EC law, the levels and structures of collective bargaining practice, and the widening gap between the relevant legal norms and real situations. The national reports were drafted on the basis of a questionnaire, which appears as an annex. This allows the reader to easily compare the solutions set forth for consideration in the various countries under review. The Actors of Collective Bargaining will be of great value for all practitioners and academics in the field of industrial relations.
