Book excerpt: Transplanting International Courts provides a deep, systematic investigation of the most active and successful transplant of the European Court of Justice. The Andean Tribunal is effective by any plausible definition of the term, but only in the domain of intellectual property law. Alter and Helfer explain how the Andean Tribunal established its legal authority within and beyond this intellectual property island, and how Andean judges have navigated moments of both transnational political consensus and political contestation over the goals and objectives of regional economic integration. By letting member states set the pace and scope of Andean integration, by condemning unequivocal violations of Andean rules, and by allowing for the coexistence of national legislation and supranational authority, the Tribunal has retained its fidelity to Andean law while building relationships with nationally-based administrative agencies, lawyers, and judges. Yet the Tribunal's circumspect and formalist approach means that, unlike in Europe, Community law is not an engine of integration. The Tribunal's strategy has also limited its influence within the Andean legal system. Transplanting International Courts also revists the authors' path-breaking scholarship on the effectiveness of international adjudication. Alter and Helfer argue that the European Court of Justice benefitted in underappreciated ways from the support of jurist advocacy movements that are absent or poorly organized in the Andes and elsewhere in the world. The Andean Tribunal's longevity despite these and other challenges offers guidance for international courts in other developing country contexts. Moreover, given that the Andean Community has weathered member state withdrawals and threats of exit, major economic and political crises, and the retrenchment of core policies such as the common external tariff, the Andean experience offers timely and important lessons for Europe's international courts.

Book excerpt: Land Grab is a rich ethnographic account of the relationship between identity politics, neoliberal development policy, and rights to resource management in Garifuna communities on the north coast of Honduras, before and after the 2009 coup d’état. The Garifuna are a people of African and Amerindian descent who were exiled to Honduras from the British colony of St. Vincent in 1797 and have long suffered from racial and cultural marginalization. Employing approaches from feminist political ecology, critical race studies, and ethnic studies,Keri Vacanti Brondo illuminates three contemporary development paradoxes in Honduras: the recognition of the rights of indigenous people at the same time as Garifuna are being displaced in the name of development; the privileging of foreign research tourists in projects that promote ecotourism but result in restricting Garifuna from traditional livelihoods; and the contradictions in Garifuna land-rights claims based on native status when mestizos are reserving rights to resources as natives themselves. Brondo’s book asks a larger question: can “freedom,” understood as well-being, be achieved under the structures of neoliberalism? Grounding this question in the context of Garifuna relationships to territorial control and self-determination, the author explores the “reregulation” of Garifuna land; “neoliberal conservation” strategies like ecotourism, research tourism, and “voluntourism;” the significant issue of who controls access to property and natural resources; and the rights of women, who have been harshly impacted by “development.” In her conclusion, Brondo points to hopeful signs in the emergence of transnational indigenous, environmental, and feminist organizations.

In a comparative analysis of Guatemala, El Salvador, Costa Rica, Honduras, and Nicaragua, James Mahoney argues that these political differences were legacies of the nineteenth-century liberal reform period. Presenting a theory of "path dependence," Mahoney shows how choices made at crucial turning points in Central American history established certain directions of change and foreclosed others to shape long-term development. By the middle of the twentieth century, three types of political regimes characterized the five nations considered in this study: military-authoritarian (Guatemala, El Salvador), liberal democratic (Costa Rica), and traditional dictatorial (Honduras, Nicaragua). As Mahoney shows, each type is the end point of choices regarding state and agrarian development made by these countries early in the nineteenth century. Applying his conclusions to present-day attempts at market creation in a neoliberal era, Mahoney warns that overzealous pursuit of market creation can have severely negative long-term political consequences. The Legacies of Liberalism presents new insight into the role of leadership in political development, the place of domestic politics in the analysis of foreign intervention, and the role of the state in the creation of early capitalism. The book offers a general theoretical framework that will be of broad interest to scholars of comparative politics and political development, and its overall argument will stir debate among historians of particular Central American countries.

Drawing on ethnographic and archival research alongside his own experiences growing up in Luanda, Tomás shows how the city’s physical and social boundaries—its skin—constitute porous and shifting interfaces between center and margins, settler and Native, enslaver and enslaved, formal and informal, and the powerful and the powerless. He focuses on Luanda’s “asphalt frontier”—the (colonial) line between the planned urban center and the ad hoc shantytowns that surround it—and the ways squatters are central to Luanda’s historical urban process. In their relationship with the state and their struggle to gain rights to the city, squatters embody the process of negotiating Luanda’s divisions and the sociopolitical forces that shape them. By illustrating how Luanda emerges out of the continual redefinition of its skin, Tomás offers new ways to understand the logic of urbanization in cities across the global South.

Neither stratified by wealth nor strictly egalitarian, Wanano society is "ranked" according to rigidly bound descent groups. In this pioneering ethnographic study, Janet M. Chernela decodes the structure of Wanano society. In Wanano culture, children can be "grandparents," while elders can be "grandchildren." This apparent contradiction springs from the fact that descent from ranked ancestors, rather than age or accumulated wealth, determines one's standing in Wanano society. But ranking's impulse is muted as senior clans, considered to be succulent (referring to both seniority and resource abundance), must be generous gift-givers. In this way, resources are distributed throughout the society. In two poignant chapters aptly entitled "Ordinary Dramas," Chernela shows that rank is a site of contest, resulting in exile, feuding, personal shame, and even death. Thus, Chernela's account is dynamic, placing rank in historic as well as personal context. As the deforestation of the Amazon continues, the Wanano and other indigenous peoples face growing threats of habitat destruction and eventual extinction. If these peoples are to be saved, they must first be known and valued. The Wanano Indians of the Brazilian Amazon is an important step in that direction.
