Book excerpt: Cette communication a été présentée à la conférence sur l'évaluation de l'assurance-chômage, tenue dans le cadre du Forum canadien de recherche sur la situation de l'emploi (FCRSE), à Ottawa, le 15 octobre 1994. Dans quelle mesure les enquêtes-ménages permettent-elles de déterminer correctement le nombre de personnes qui touchent des prestations d'assurance-chômage et les montants qu'elles touchent? L'Enquête sur la dynamique du travail et du revenu (EDTR) est une nouvelle enquête longitudinale qui comporte des questions sur les prestations d'assurance-chômage (montant des prestations et mois au cours desquels elles ont été touchées). Dans la présente étude, nous examinons des renseignements relatifs aux prestations d'assurance-chômage fournis par les répondants lors de l'essai sur le terrain de l'EDTR, en 1993, en les comparant avec des données de référence, en l'occurrence les renseignements fournis par ces personnes sur leur déclaration de revenus.

Book excerpt: Dans cette étude, qui est fondée sur des données de l'Enquête sur la dynamique du travail et du revenu (EDTR), on examine trois groupes de personnes en chômage : celles rarement en chômage, celles toujours en chômage et les chômeurs chroniques. Aux fins de cette étude, le groupe de personnes rarement en chômage fait référence aux 10 % de personnes chômant le moins. Les personnes toujours en chômage, c'est-à-dire celles qui n'ont pas réussi à se trouver un emploi lorsqu'elles s'en cherchaient un, constituaient un autre 5 % de chômeurs. Les chômeurs chroniques sont classés dans la tranche supérieure des 10 % restants des personnes qui passaient plus de temps que quiconque en chômage, soit entre 48 % et 99 % de leur temps d'activité.

It stems partially from the platforms’ economic impact, which is felt most acutely in certain sectors: Uber drivers compete with taxi drivers; Airbnb hosts compete with hotels. Other consequences lie elsewhere: Uber is associated with a trend toward low-paying, precarious work, whereas Airbnb is accused of exacerbating real estate speculation and raising the cost of long-term rental housing. While governments in some jurisdictions have attempted to rein in the platforms, technology has enabled such companies to bypass conventional regulatory categories, generating accusations of “unfair competition” as well as debates about the merits of existing regulatory regimes. Indeed, the platforms blur a number of familiar distinctions, including personal versus commercial activity; infrastructure versus content; contractual autonomy versus hierarchical control. These ambiguities can stymie legal regimes that rely on these distinctions as organizing principles, including those relating to labour, competition, tax, insurance, information, the prohibition of discrimination, as well as specialized sectoral regulation. This book is organized around five themes: technologies of regulation; regulating technology; the sites of regulation (local to global); regulating markets; and regulating labour. Together, the chapters offer a rich variety of insights on the regulation of the sharing economy, both in terms of the traditional areas of law they bring to bear, and the theoretical perspectives that inform their analysis.
