Book Comparative Constitutional Reasoning

Download or read book Comparative Constitutional Reasoning written by András Jakab and published by Cambridge University Press. This book was released on 2017-04-27 with total page 867 pages. Available in PDF, EPUB and Kindle. Book excerpt: To what extent is the language of judicial opinions responsive to the political and social context in which constitutional courts operate? Courts are reason-giving institutions, with argumentation playing a central role in constitutional adjudication. However, a cursory look at just a handful of constitutional systems suggests important differences in the practices of constitutional judges, whether in matters of form, style, or language. Focusing on independently-verified leading cases globally, a combination of qualitative and quantitative analysis offers the most comprehensive and systematic account of constitutional reasoning to date. This analysis is supported by the examination of eighteen legal systems around the world including the European Court of Human Rights and the European Court of Justice. Universally common aspects of constitutional reasoning are identified in this book, and contributors also examine whether common law countries differ to civil law countries in this respect.

Book Recasting German Federalism

Download or read book Recasting German Federalism written by Charlie Jeffrey and published by A&C Black. This book was released on 1999-01-01 with total page 406 pages. Available in PDF, EPUB and Kindle. Book excerpt: Understanding Germany's federal structure is crucial to understanding contemporary Germany. The federal system shaped the way German unification was carried out, it shapes the way in which policies are made, and it plays a role in determining the way in which Germany presents its priorities in the EU. The first part of the book analyzes the nature of pre-unification West German federalism and the unique challenge posed for the federal system by unification. Part 2 takes stock of key issues in the operation of post-unification federalism, including the policy process, the role of parties in federalism, conflicts of interest over financial allocations, and the impact of deepening European integration. The final part offers a series of critical perspectives which address the long-term legacies of unification and increasing pressures for reform.

Book The Governments of Germany

Download or read book The Governments of Germany written by Arnold J. Heidenheimer and published by . This book was released on 1966 with total page 284 pages. Available in PDF, EPUB and Kindle. Book excerpt: Having achieved solid marks during an adolescent testing period, having proved capable of eclipsing the faulty patterns of earlier generations -- so the argument goes -- the West German political system should now be treated as a fully mature and democratic one. Thus, President Luebke has argued that the German "postwar period" be officially considered as having been concluded. This book should help the reader decide whether German institutions ought now to be accepted as much on face value as those of other democratic Western systems. As regards progress toward German unification, however, very little has occurred during the five-year period. Considered as both societies and political systems, West and East Germany are still very much the hostile twins they were in 1961, when the Berlin wall was built. - Preface.
